  1. Yay! We just got our interview date for June 26th!  I had sent the marriage cert in and the website still was saying Action required: send documents so I called this morning and the lady at the NVC said yes, they have them and then said our interview date was set already!  
    I have called the NVC a total of 3 times during this process and have had very positive and helpful people every time.

    Yes, that is what I plan on doing. I was looking closer at the copies my lawyer sent in and the marriage cert is almost impossible to read so that is probably why and I would agree with them that it needs to be re-sent.  No point in fussing, just resend, what ever makes it quicker. IMO.

So my lawyer submitted my docs 5/4.  Today (5/9) I got an e-mail saying he was missing the marriage cert. but it is in the documents so I guess we'll resend it.  Also he missed one of my W2's from 2016 but they just want us to bring that to the interview.  they might have missed the Marriage cert as it was on the same page as my wife's birth Cert.  I plan on calling the NVC tomorrow to make sure.  But I am happy that they are moving so quickly!

    If it says "At NVC" and your AOS information is missing.. Then yeah, it's most likely a CC... 

     

    Thanks for the link, I never got that before, I always got to the CEAC login page to submit the DS-260 and it never gave me any updated info of status.

    The petitioner doesn't need to send a copy of their birth certificate.  It's just the beneficiary that does.  The petitioner only sends all the AOS (financial documents).  Did your lawyer cc you into the email so you can see exactly what has been sent?  I'd be wanting to make sure exactly what's been sent so you know.  Your wife will need a police clearance too.  I had to get a Canadian police clearance myself as I lived there previously, and it's quite quick to get when you're in Canada.    

     

    You've definitely done the right thing by not doing the AOS when she was there.  You would have had a very hard to get past immigrant intent. 

    My birth certificate was to prove my US citizenship.  Why we used that instead of my passport is beyond me.
    He did not CC me unfortunately.  
    My wife's police clearance is done and supposed to be in there.  
    He definitely has all the documents listed on the NVC website.

    Yes, your lawyer does sound very incompetent.  You need to send both your IV and AOS documents together otherwise they won't start reviewing your case.  You will likely get a checklist because of the missing documents. We had to send ours in two emails because the size of the all the attachments was too big for one email.

    Have you checked the requirements for Canada and what you need to send?  Here is the link to what everyone is required to submit.

    Can you not just email the IV documents yourself if you have them all?  I don't think it matter who emails the NVC (that's what I was told last night anyway).

    Thanks, I believe he sent all of them in as he has them all and asked for a copy of my birth Cert (I am the Petitioner). 

    I feel like asking him for a discount on the balance of money I owe him since I have caught a couple mistakes he made and have taught him a few things about immigration processes.  But am not sure if that is appropriate... and I have a hard time figuring out how to say it.

    It could be that he doesn't do many Canadian based immigrants, more Mexican and Adjustment of Status cases that are different...? IDK

    The sad thing is that we could have simply done an AOS for my wife as she was down here visiting me but we were trying to do everything legally.  She was pregnant and her visa was going to expire too close to her due date to travel.  So she went back to Canada for a bit so she could come down on another visitor's visa over the time of our child being born so we could be together during that time. She was harassed and turned back at the border.  Too scared to attempt another entry, we applied for a greencard and here we are. We have been apart for a little over 10 months now and I am missing a LOT time with my new born daughter (we have been married 9 years and have 3 children, all dual citizens except my wife)

  7. So I have some questions about the NVC document submission.  Unfortunately I seem to have hired a very inept immigration attorney and have subsequently been doing my own research. He said he was busy and would get to the AOS Friday (a week after he had all the info needed)  So after I got home from work Wednesday, I filled out the I-864, signed it and emailed it to him saying that I would help him out.  Needless to say, he got on it first thing this morning (Thursday).  But then he was going to Snail mail my docs to the NVC.  I was like, "why are you not emailing them for EP?"  He had no idea about it! 
    Now he submitted the AOS and supporting documents via e-mail and told me that eventually I will need to complete the IV Package but not now.  So I am confused because it appears the DS-260 and supporting documents are the IV package.  I have completed the DS-260 online and submitted it almost 2 weeks ago.  All fees have been paid since April 22nd.  So when am I supposed to send the supporting documents for IV package?  Were they supposed to be submitted with the AOS supporting documents?

    After more than 7 months of painful waiting (Nebraska SC and then transferred to Texas) and feeling hopeless I got the NOA2 in the mail today!! No update online just like most of you guys. The notice is dated 4/27. Thank God. 

     

    Those still waiting, take heart! I know the feeling of frustration and hopelessness all too well.

     

    By the way, the notice says to wait 30 days before contacting the NVC however I know a lot of you started calling pretty soon after you got the NOA2, right? 

     

    For me the NOA2 date was 3/27, I received it in the mail 4/1. On 4/12 I got an email notice that it had been sent to the NVC and according to their website they sent it on 4/10.  I called the NVC on 4/18 and they said they received it on the 17th but no case number yet.  Then on the 20th I called and they gave me the case number and invoice number.  I have a lawyer (that doesn't seem to do much) so I didn't have to select an agent.  I made the payments on the 22nd and late evening on the 25th the AOS and DS-260 unlocked and we finally got them filled out and submitted.

    interestingly enough the 2016 tax transcript became available the morning that i was preparing to email my docs. so i ended up sending 2016 (as my most current year, and also reflected on i864), 2015 and 2014 tax transcripts. For extra measure, i still sent my 2016 1040/W2. Was approved quickly. I also sent employment letter listing position and salary, and 6 months worth of pay stubs. Sort of seems like overkill but reason was due to my 2014 tax year (i was in school and my income was low).

    Thanks for the info as I am in a similar situation where last year my income was really low but current and all other years are good.  I am going to be sending in my info this week, just waiting for the payment to go through and what you sent is what I plan on sending.

    After reading folks having luck on calling in and getting good news, I just tried to do the same. 1st customer service rep wouldn't let me request a Tier 2. She literally said at one point, "I don't understand what you're finding an issue with." Its the third attempt I've tried to get information on whether my application is in Texas or in Nebraska. I just get constant deflection.

     

    And zero empathy.

    You just have to keep yourself busy. Keep your mind focused on more than the pain of the process. My wife is everything to me. We've been inseparable since we met 7 years ago up until this process (we were living abroad in sweden before this). I miss her every day.

     

    Its been difficult finding the energy or enthusiasm to get out and be active and social, but its been essential in getting through it. I find running to be particularly helpful for dealing with the frustration and I've gotten back into some old hobbies to distract from the loneliness. 

     

     

    I know the feeling.  We've been married 8 years and lived in Canada until a year ago.  We have 3 children ages 5, 3 and 4.5 months.  It's so hard being separated especially from the children.  Reason I haven't moved back for the process is there is hardly any work there and I am building my business here in the US. I am really grateful for modern technology that allows us to talk and video chat easily whenever we want.

     

    On the bright side our I-130 was finally approved.
