  1. I really need advise and input it will be greatly appreciated. I have been married to my husband in Mexico for 4 years now I moved over to Mexico and crossed daily to work in the U.S and roughly finished my degree in the u.s. Now he has a 5 year bar that is 8 months from expiring. we had our interview last year  year on July 2017 in Ciudad Juarez where he was placed in AP, that was unexpected as we were expecting his visa to be refused and asked for I-601 & I-212 for attempting to enter illegal back in 2013.  Now my question is should I withdraw the pending application that is in AP or should I just wait to see what happens.? Thank you a lot for your answers  

  2. Hello friends sorry if im off topic Im just trying to find answers. My husband had his interview at Ciudad Juarez Mexico this past July 2017 and was placed in AP he has a 5 year ban which we already knew before going because of the FOIA. We were expecting officers to deny the visa and request us to file waiver I-212 & I-601 but they placed him in AP after finding out he was legally adopted by his u.s citizen brother when parents past away. The officers asked him for original adoption u.s  certificate which they kept. I know this does not matter and does not help anymore but I guess it catch their attention of why the son of a u.s citizen was deported. Anyways it does not help anymore I am the petitioner his wife and his 5 year bar will be almost over this year. Could I just withdraw the pending application that is in Administrative processing and reapply after the 5 year bar is over I have been waiting for 7 months in AP they update every 2 weeks? Thank you.  

  3. Thanks just a side note. I am the petitoner at the moment  not his brother anymore. He is applying for IR1 visa. We have the FOIA which states 5 years and we went to interview already. I guess we should have waited for the 5 years instead i dont know why officers at juarez would asked my husband for adoption certificate and details of that instead of just giving us the 10 years you metion and let us file for waivers. Its so weird we were expecting the same sd well

  4. Thank you all for your comments. We already went to interview at Ciudad Juarez this July he did not receive any additional bar aside from the 5 years he already had in 2013. His brother did file for him after the adoption but made the biggest mistake to file for him as a brother instead of a son that is what my lawyer told me. We don't expect to receive any benefits from the adoption anyways. Just was wondering if we could file again for visa even if it still is in AP after the 5 year bar is over. Thank you.

  5. Hello  I am U.S citizen my husband is in Mexico. My husband was brought to the u.s as a child 14 year of age and orphan he was adopted by his older U.S citizen brother. Sadly at age 20  he was removed and was given 5 year bar in 2013 for living in the u.s. CBP officers lifted his tourist visa and sent him back to mexico they did not even bother to take a look at the adoption certificate.We married in 2014 after all this happen and left to Mexico with him. We went to Juarez for husband visa. We were expecting for them to denied the visa and ask us for waiver but instead he was put in administrative processing and they asked my husband for a copy of the adoption certificate and they told him they did not have an answer at the moment the interview was about 30 minutes long . I have a feeling the administrative processing is going to take very long. His bar expires in 1 year. Could we just reappy for the visa after the bar expires while this one is still in administrative processing? Thank you for your time and help.

  6. Yes you are correct. Unfortunately his brother who was a us citizen and legal father when he was 14 still a  child and did qualified but  was not well informed. He did not hired an attorney and was told he could only petition for him as a brother and not as a son. Maybe the officer at the Interview realized they should have not removed him from the country on the first place. I guess that is why they put administrative processing.

  7. Hello friends.

    My husband just had his interview at Juarez Mexico on July 6. He has a 5 year bar that will expire on January 2019 for attempting to enter illegally but before that happened he was a orphan that was adopted in the state of Texas by his U.S citizen brother he entered with a tourist visa and one day when he crossed to Mexico and was returning to the u.s he was allowed to withdrawal his application. All I know is that the FOIA says 5 years. He went to his interview and my lawyer and me were expecting for the visa to be denied and be asked for waivers but that was not the case. The officer asked my husband for adoption certificate luckily he had them with him and he was surprised. He told him he wss going to put the case in administraive processing and ineligible under section 221g and that we could not send waivers while it was under administrative processing. Is this good or bad? Thank you 

  8. Hello I need some advise.

    My husband will be having his 1st interview at Ciudad Juarez. July 6 He has a 5 year bar which will expire in 17 months to be exact. My lawyer said he will be needing I-601 & I-212 but seen the processing times I just don't see the point of it. I rather wait for his bar to expire. He has been abroad in Mexico for almost 4 years. Life in Mexico has been rough. In case we do send the waiver will I need to pay NVC fees again and also will I have to wait again 16 weeks for another interview or do I just reschedule? Thank you for the advise.

  9. Hello Beautiful people.

    My scan date is March 8 my case complete May 18. My husband will be having his interview at Juarez Mexico July 6. We have a big problem now. :( I have a joint sponsor who did not file his income tax for 2016 so I do not have form 1040 from his side only 2015 paperwork and mine is 2016. Will there be any issue if I only take his 2015 tax paperwork and W2 & paystubs for 2016. Please advise if we should even go to interview. NVC does not want to give me any advice. Thank you for your responses.
