That’s just horrible news.  Everyone here, even with approvals, spent a lot of time worrying and contemplating what if it happens to me.  I wish I had solid knowledge on this process to give advice that was worth your time.

I would definitely talk to one or two more lawyers.  I don’t know if it was borderline enough to think if anything else could be added by refiling.  Or if having another agent look could make a difference.

Very sad to hear this.  Offering all my sympathy.  Consider every option you have.

Thank you for your Sympathy, and yes its a horrible feeling but we are not giving up re applying asap with a different lawyer now.. They just want more proofs of some simple things which I did send but wasn't enough for him.😏

you can file again, re apply for the i601A, you will need to make it stronger, better.

did you use an attorney for the waiver and hardship letter?

what were the reasons for not moving to your spouse's country?

Yes everything was done by our lawyer the package was perfect send a lot of proves I guess the officer was having a bad day😭

I don't think so.  After the I-601a is approved you have to attend an immigrant visa interview in your home country. If you are approved at the interview you will receive an immigrant visa and shortly after you re-enter the U.S. you will receive a social security number and green card.

I believe you get an employment authorization document only if you are adjusting your status inside the U.S. (meaning you entered the U.S. legally or are covered by 245i)

    Thank you for your time.

Did you get your case and invoice number from NVC? If not then call them and get case and invoice number. After you get you case and invoice number, you have chose an agent for your case, which can be anyone ( petitioner, beneficiary or anyone you feel comfortable) in your case, it would probably be your lawyer. The purpose of the agent is that any information regarding your case will go to agent from then on. In my case, I (the petitioner) am the agent. After you do that, your agent will get an welcome email from NVC (wait about a week for the welcome email) and then you can start paying the fees one by one. In the mean time, I would recommend you to start gathering all the supporting documents you need. One suggestion. don't rely on your lawyer 100%, they intent to forget sometimes, what I figured from many Vj's member, inquire yourself  Good Luck !!

YES i did call NVC to get my case and invoice number  i called my lawyer and asked him if he had receive the letter from NVC he answered oh yes i did in the beginning of October i was like really.  I actually had to call him before he called me so he asked me to take a money order for 445$ to start the process of Visa i am guessing cause he didn't ex[plain much to me. so i am guessing like my husband entered illegally he has to travel to Ciudad Juarez thats another thing we don't know whats next. So its the Visa they are working on i guess and after that how much time does it take to receive news from NVC.   thanks

The people who get approved quickly are Philippines or they had a Current Visa. and besides I've noticed if you have a lawyer is much faster good luck.

QUESTION FOR ALL DEC 2016 FILERS IN NEBRASKA!!!! Did anyone get approved like 2 months ago or recently? Because alot of people in Feb-March 2017 with Nebraska are saying that the update on USCIS website is 2 months behind so basically that they are working on Jan-Feb. It shows Dec 9th!!!! Please let me know. This is nerve wrecking. Goodluck to everyone.

We were Just approved at exactly 9 months September 14.  with Nebraska my pd is December 14/16 and besides i been getting alot of approves on my app from December Filers. so yes they are working on December for sure.
