  1. Hello everyone,  

    My wife is petitioning her parents from the Philippines. She is a US citizen but her income does not meet the minimum requirement so I am a joint sponsor. My wife has to file a separate form I864 for each of her parents and for me, separate form I864A. My question is for Part 5 Intending Immigrants, should I list both her parents or should I list just only one for each form meaning I would list my father-in-law for one I864A and another one for my mother-in-law. Thanks for the help.

    If you are a co-sponsor and you are in the same household as the main sponsor then you should be filing i-864A not i-864. In that case I believe you don't separate the incomes with w2's.... I guess I should assume you are living together... lol

     

    ... I'm a bit unclear on it cause I've never filled out i-864A.. maybe someone who has can answer that part better. 

    Yes, I am the co-sponsor and my wife is the main one. Thanks for the info on the I864A form, I re-read the instructions on the website and you are absolutely correct. I'm double-glad that I posted here otherwise we would have submitted an incorrect form. Thanks again Suss&Camm and oh by the way, yes, me and my wife are living together :-).

    My wife is petitioning her parents from the Philippines. She is a US citizen but has only been employed for 2 years and also her income does not meet the minimum requirement so I am a joint sponsor. I am in the process of filling up form I864 but I'm getting a little confused. For Part 6, item number 18.a. Have you filed a Federal income tax return for each of the three most recent tax years? Should I click on YES even though she's only been employed for 2 years BUT we've been filing a joint return every year since 2009. For Item 19.a b and c, should I put down our TOTAL income from our tax return even though in 19.c, she's not employed yet but again, we filed a joint return. Thank you very much, appreciate the help.
