  1. Hi guys,

    At last, after my successful AOS interview last August 20, 2007, I finally received my GC last Sept 4, 2007. It's a great feeling after what we have been through like the long waiting, worrying because of UCIS mistakenly denied my application for the "interview reschedule glitch", the MTR ordeal etc etc....

    But with your support, our family and friends especially the One whom we believe and praise definitely help us all! We trust that through prayers, patience, support of my USC wife and everybody, our AOS journey made possible and now I got my GC, a 2-year rest from USCIS is a wonderful favor!!!!

    Sorry but I kinda hard-up filling my timeline but below is a short info of my AOS journey;

    Sept 2006 - married

    Nov 2006 - filed AOS, NOA received

    Dec 2006 - biometrics

    late Dec 2006 - AOS interview scheduled in Jan 21, 2007

    early Jan 2007 - got snail mail and e-mail "interview reschedule"

    Feb 2007 - received AOS denial for non-appearance on the interview

    late Feb 2007 - filed MTR

    April 2007 - my AOS reopened

    June 2007 - got RFE (wife photo and my BC) and later my interview notice for August 20.

    August 20, 2007 - interview

    Sept 4, 2007 - GC on hand!

    To everybody thank you for the support and encouragement we got from you and to those on the process...good luck, be patient, submit what you need to submit and prayer absolutely help! We did it after the ordeal, for sure you can too!

    It's our 1st wedding anniversary on the 8th, what a great timing for us!

  2. That sucks! :angry: Didn't they give you an opportunity to appeal or defend your actions?

    Been there so I know how you feel getting a denial letter.

    Just do the things you need to do, if you need a lawyer to assist you do the MTR, it will be better, in fact I didn't pay the Motion to Reconsider fee because it's the fault of USCIS ( cancelled interview victim) that's what my lawyer said.

    Stay focus and trust me, you will eventually get the GC, in my case I waited 9 months to finally got an interview letter and I was indeed approved (easy interview), just waiting now for the card to arrived anytime.

    Also, a prayer definitely helps. Good luck and be positive!

    We don't have because we are living with our mom and the rent is free, bills are all in mom's name and we just give our share of the bills. Glad we have an affidavit from her attesting the rent free and house bills payment, AO got that sworn statement. We don't have insurance together as of this time bec I can't include my wife yet, I am still very new with my work.

    My wife and I are in a similar situation, we still live with my parents. This sworn statement that you took, was it notarized? I'm beginning to think that its a good idea for us to do the same....

    We have it notarized the statement and attached mom's DL (photocopy)

    Where were you interviewed?

    I think you're GC is approved the fact that the AO didn't say anything you were denied. AO mostly are very straight forward, our interviewer didn't even say we were approved but we did signed a letter saying I have been granted a conditional GC and the removal of condition stuff! Did you signed anything after the interview?

    Good day!

    First off, most of you can still remember my case (1-485) We were first denied because of USCIS mistake - we were the few unlucky "interview cancelled" victim.

    But we were able to straigthen up our case but with lots of frustration, worrying and waiting months.

    Today, my USC wife and I had our interview this morning in St. Louis, MO.

    The AO was a male in his 50's, very straight forward. He asked us immediately for our ID's and talked about the denied case we had before.

    Then he confirmed my name, address, date of birth, my SSN, work, my visa status when I came here in the US and the Yes or No questions then he also confirmed my wife's name, address, birthday. He double check if he had on his file our marriage certificate and birth certificates.

    He asked my wife how we met and proof of living together as married couple. We only have a savings account and asked why we dont' have checking...wife explained she can't open a checking bec of bad check she wrote before. House bills, insurance? We don't have because we are living with our mom and the rent is free, bills are all in mom's name and we just give our share of the bills. Glad we have an affidavit from her attesting the rent free and house bills payment, AO got that sworn statement. We don't have insurance together as of this time bec I can't include my wife yet, I am still very new with my work.

    After that he asked if we have photos together and we gave our photo album, he photocopied some pics like our wedding pics, photos with friends and family (about 6 of them)

    Then he said you were only married less than 2 years so I give you conditional GC, he didn't asked my passport, my 1-94 and he didn't even asked my EAD card.

    He gave us a letter to signed together and after that he said we are done. We are hoping at the end of the interview the AO will say something like "congrats you are approved"

    But as per my Atty after the interview, I called her and read the copy of the letter we signed, she confirmed we are approved!

    Here's what the copy of the letter says we signed after the interview.....

    Dear Applicant:

    Pursuant to Section to Section 216 of the Immigration and Nationality Act, you have been granted conditional permanent residence in the United States as of the date that your were admitted or adjusted to such status by an officer of the Immigration and Naturalization Service. You and your spouse must file a joint petition to have the conditional basis of your status removed. The petition must be filed within the 90-day period immediately preceding the second anniversary of the date you were granted conditional permanent resident status. If a petition to remove the conditional basis of your status is not filed within this period, your conditional permanent resident status will be terminated automatically and you will be subject to deportation from the United States.

    You must notify the Immigration and Naturalization Service of a change of address immediately. Failure to do so could cause a loss of benefits.

  6. Thanks guys but my question is why they are asking for my ORIGINAL birth certificate? I am supposed to bring that on the interview. They even mention photocopy of BC will not suffice. Just wondering....

    I have read something (but I have to get back at it and post another time here) about such request for certain countries... Can you fill us in with your timeline and profile? It could help. Thanks!

    First off, I noticed not only me got RFE but lately I read so many of us are receiving RFE (either docs were already sent or forgot to sent). I have been to other immigration forum and a lot of them got RFE too? ANY thoughts about it?

    Well for an update after getting my case reopened (interview deschedule victim), my Atty got a RFE asking for my original BC (no photocopy) and my wife 2 passport pics again. We mailed it and today I got a receipt from CRIS they already recieved the requested docs. I have no idea what will happen next? ANY GUESS???

    Here I am again, in continuation of my interesting life story with USCIS (it's like a soap opera, right?) here is another update and I would like to hear any thoughts from all of you reading and following my story.

    Last episode, so to speak after almost 3 months of feeling hopeless and worried waiting for the result of my MTR appeal with my AOS denial bec of this descheduled mess I finally got a letter from USCIS reopening my case.

    This time, my lawyer received an RFE from Missouri Service Center; asking just photos for my USC wife and my original birth certificate (they need original not photocopy). I don't know why???? Anyone knows?

    I am thinking they might loss these documents because we sent this before already. But we will send them anyway, we have to go back again to Walgreens and take her photos.

    Anyone experience this before. Is there's something good about this RFE?

  9. Hi all VJers,

    I am glad to inform you that today, we received not 1 but 5 letters from NBC, Lee Summit, MO that my denied AOS application have been reopened or reconsidered. (remember I am one of the unfortunate applicants who got a deschedule-interview letters (e-mail and postal mail) and got denied for non-appearance ...filed MTR last January of this year).

    It took 3 months for them to reply my filed MTR. We are a little bit relief now, thanks for all your prayers and support and hope we will receive the interview schedule soon. THIS TIME if we got a letter descheduling my interview...WE WILL ATTEND TO IT!!!!!!

  10. Just last week we received the notice scheduling the Interview. I have read a few times where others have not gone to the interview after receiving a notice that "descheduled" it and have been denied due to not showing up for the interview.

    If you also receive a paper cancellation notice, then it's your choice. You do not risk much by going. However, if the email is all you have, then GO!

    GO TO THE INTERVIEW ANYWAY!!!!!

    We received the e-mail 5 times and the atty received the hard copy--we discussed it and both followed USCIS notice and didn't go to the interview appt.....we got denial letter 1 week after the original appt date. It happened to Waren613 also. I wouldn't take any chances--the worst is that they tell you it's cancelled---what happened to us it that the local office had no idea that we had received the cancellation notices.

    I second! Got e-mail and snail mail descheduling my interview....our cases, we have no idea what's going on now. My atty told i should be receiving a new interview sched soon...seems forever to us! Please GO TO YOUR INTERVIEW!

  11. whewwww...lol..ok thanks to both of you.....just found it weird...but when you think of the ppl who recieved cxl emails for their interviews, and didnt go...and then were turned down because they did not go....go figure.....they need to get their act straight.....could give someone a heart attack!!!!..thanks again (F)

  12. This may be a silly question but I’m a worry wart. Do traffic tickets have any effect on your AOS? I just got a ticket on Friday for a “rolling stop”. I was so annoyed and pointed out that I did stop and the cop said “legally you need to stop for 3 seconds” which I know, but have not actually counted to 3 when I stop since I was 16. I have a clean record, no tickets, no accidents, etc. Will this have an impact on my AOS?

    No, traffic tickets do not affect your AOS. so do not worry about it.

    Nice to know, CanadaGirl we have the same case, I know I stop at the flashing red light but the patrol officer said I didn't, I didn't argue with him more about it and he gave me a ticket for non stoping to stop sign. I know this will not affect my AOS bec its a minor traffic offense and glad you guys confirmed no need to worry.

  13. are you saying emails aren't enough to file a motion to reconsider (if they erroneously deny due to failure to show)?

    Emails are basically as good as your word. A person with pretty basic technical skills can easily fake an email. Now, USCIS employees may not know it, so one might just get lucky with a printout.

    Like Mary K. I recieved cancellation from my e-mail and a cancellation letter (snail mail) from USCIS. Best of luck to all of us who are in this mess!!!!

  14. Heard from our Atty today and was informed that the MTR was received on Friday.

    Now the waiting begins....AGAIN!! :ranting:

    Good luck! My MTR was received middle of Jan 2007, no reply/response yet from the local DO/USCIS. Your right waiting is killing me!!!!!!

    Keep you posted any update from my MTR and keep us informed on yours too, okay? Hope good news will come to both of us soon! Hang in there!!!!

  15. My AOS is still pending but I got my SSN and EAD ( one year validity) went to apply DL, passed the written, vision, road signs with flying colors but driving test, first attempt failed, second attempt - at last passed!

    Is this an SOP to an AOS like me, they just give me a temporary DL, bec they will verify AGAIN my infos to the capital city and wait for the physical card within 60 days and they only gave me a one year validity like my EAD card? Is this the protocol?

  16. You are not alone. I have exactly the same dilemma like yours. We should have been enjoying my greencard now if not USCIS mess up.

    This poll is inspired by all of the research I have been doing since we received the stupid letter of denial of Atif's AOS due to their error... :ranting:

    I am just curious how often this BS happens--to get a notice of cancelled appointment then to turn around and get denied because you didn't show for the appointment--like they told you!

  17. Hi guys...after months of WAITING for EAD card now WAITING again for SSN card/number.

    Those who already got their SSN/card kindly post your timeline in getting your SSN/card. Let me see who got the fastest and who still stuck.

    I just can't wait anymore for another months of WAITING ( I hope not bec I need it very badly, company applied waiting for my SSN number prior to job offer)

  18. Hi just got my EAD last week, applied SSN and as usual waiting again for the number and card....while waiting for my SSN number and card

    My question is CAN I HAVE MY TEST DRIVING AND DL EXAM without my SSN number/card yet. I am thinking to save time while waiting for my SSN I might have my test driving and exam done and when I got my SSN then ask for my DL card....

    Is this possible???Anyone please! I am from MO state. Thanks!
