  1. For the I-131 in Part 3, it asks about date of intended departure, expected length, and all that jazz.

     

    Are we allowed to just apply for this "For the What If" I mean right now I don't have any hard dates, but my grandpa is having health issues out of the US. I am the USA citizen, my wife is the one applying for the I-131. I would hate to leave her here in the US.

     

    Can part 3 be left 'blank'?

     

    After part 3 I read, If you are applying for a non-DACA related Advance Parole Document, skip to Part 7. I guess skip 4, 5, 6?

     

    Part 7 again asks on a separate sheet of paper to explain how you qualify for Advance Parole Document. What circumstances warrant this advance Parole?

    Can I just say for the possibility if the health of my grandpa fails, or If i want to go to Canada for leisure?

    Yes, you need photos of the wedding. I think we provided about 10-15 pictures all printed out at home on regular paper.

    Am I supposed to provide the ORIGINAL certified marriage certificate? Or can I provide a copy? My wife is sentimental to the original, since its the original. lul Thank you!

     

    Also for affidavit of support I-864 I read in the rules that if you are comfortably over the minimum salary, you do not need to provide supporting funds (bank accounts, investments) is this true? Or am I better off providing EVERYTHING? Again Thank you.

     

    Literally stressing out over everything AGAIN. Also do we need to provide proof of relationship like we filed for K1 Visa or is that needed? gonna go crazy printing photos/providing my life summary...

    What is your current immigration status (if it has changed since your arrival)?

    ~Is this still K1 Visa? or has it changed? or do we leave it blank? Came in on K1 Visa...

     

    Part 2, #2

    Are you applying for adjustment based on the Immigration and Nationality Act (INA) section 245 (i)?

    ~Yes/No question. I have no idea what this is.

    I am looking at the fees for I-485 & Biometrics Fee, can someone help me confirm the total fees?

     

    I-485 Fee = USD $1,140

    Biometrics Fee = USD $85

     

    I-485 fee includes fees for I-765 (EAD) and I-131 Travel, probably not needed...

     

    I-131 is really only allowed for really good reasons right? You cannot use it to say oh I want to take a weekend trip to Canada or something like that? Must be for family/cultural/religious reasons? Or do they allow you to apply for that for tourist leisure trips?

     

    Also should I separate the checks, 2 checks? Both checks made out to " U.S. Department of Homeland Security"

  6. Hi there, my fiance and I will be flying to the US in late January with her K1 Visa.

     

    Does anyone have a brief rundown of what occurs at port of entry and what is necessary to bring besides the sealed documents from the consulate/embassy?

    Will latops/cameras/phones be searched or need to be turned on now a days? or does that vary on whoever interviews you?

  7. My Fiance's paperwork is at the Consulate in Hong Kong and she needs to file the DS-160 before she is called for the interview correct? She received the checklist from the consulate in hk, but we would just like to be sure.

     

    Also regarding my Affidavit of Support, IF you meet the minimum for support regarding the federal poverty guidelines. Are you not allowed to have a co-sponsor correct? A cosponsor is only if you do not meet it?

    Regarding the poverty guidelines, I can meet it if my current job + assets (stocks/bonds) are over the minimum for a 2 person household roughly $20,025 right then I can just file for myself say if all combined assets, for example, is around $30,000?

    I mean G325A has multiple lines for previous addresses of last 5 years, can I use 2 lines for 1 address? Basically I never moved...

    It won't hurt. lol The main goal is proving you met in person within the past 2 years. So anything that shows you two were together at the same place and has a verifiable date within 2 years of filing should be fine.

    Yes, those are the right addresses for the lockbox. The top one is for USPS while the bottom for other couriers. Which one you use is up to you. I sent via USPS Priority Mail for ~$10 and it arrived in 2 business days (sent Thursday afternoon and arrived Monday). Many others have used other services (i.e. UPS/FedEx) and did overnight delivery. That might save you like a day or so (of 6+ months) and costs a lot more IMHO.

    The addresses for the lockbox for USPS or courier is that what I put as the address for the Fiance Letter of Intent to Marry as well?

    1. Yes. Alternatively, you can put "See addendum xyz" and include the information on a new sheet. Be sure to sign the addendum.
    2. I can't speak for others, but my fiance listed her current residence in the first section, where the "Present Time" field is already filled in on the form.

    4. In your example, I would say put "Jun Fan" as the given name, and Lee as the family name.

    I have a couple questions while filling in the I129F and G325A forms, if anyone can answer them that would be great.

     

    1) For country of residence and the form asks for City, Country. Same applies for Part 2 36A/B when it asks where you will file your visa for your fiance it asks city and country

    is it Hong Kong, Hong Kong

    Hong Kong, China

    Kowloon, Hong Kong

    or Kowloon, China?

    She lives in Lam Tin District

     

    2) How exactly do you enter a Hong Kong address into the Form?

    as an example:

    Housing Department Lam Tin Estate Office

    G/F, Lam Tai House, Lam Tin Estate, Lam Tin

    Kowloon

     

    What goes into Street Name and number? I looked this up from their government housing site for a neighboring estate and there is no street name or number given

    What is the City/Town? Lam Tin or Kowloon

    What is the Zip Code or Postal Code for Hong Kong? Again the official government page does not have a zip code or postal code

    Is there a province? and again country is Hong Kong or China?

    Hi sorry to bother you again or if anyone else replies. But I would like to know when in the process the Police Certificate is needed?

    1) My fiance's address in Hong Kong is a little long to type on the G 325A form, is it ok to print it out and hand write that, while most of all the other information is typed out?

    2) In G325A under the section for 'Applicant's Last Address outside the United States of more than 1 year.' how do we indicate the To Month/Year if it is still presently residing there? do we type in 'Present' or do 02/2017?

    4) For people with Chinese names that are 'romanized' How do you enter their name? Example name of Bruce Lee's Chinese name is Lee(family) Jun Fan (given) does Jun Fan just go into 'given' with a space? or is it Jun(given) Fan(middle)?

    5) Does anyone have any experience entering in Hong Kong addresses? there is no state or province and literally the whole city is really Hong Kong, but there are so many districts. Example address.

    5. Yes, her BC will be needed for AOS (after marriage in the US).
    6. There is no set number. Technically just one good, verifiable item is sufficient. That said, most people provide a number of items along with several photos. I included 6 photos myself (plus other evidence as noted above). Again, photos are secondary evidence. Does the 20th photo add any value over the other 19 before it? Some people would include it and others might not.. I personally think 20 is overkill, but it's not unreasonable either (people have sent many, many more). They're just looking to see if you met at least once in the past 2 years. unless front loading your petition (which I don't believe is necessary for HK), evidence of an ongoing relationship is best suited for the interview.
    7. Two separate letters is recommended. You each sign your own letter. It can be typed or handwritten (most people type nowadays!). Neither one is "better" IMHO. Your beneficiary can sign the letter, scan it, and send it to you - a true "wet" signature is not actually needed for the letter of intent to marry for G-325A.
    8. You must sign your I-129F, G-325A, and letter of intent to marry. Legally, a digital signature should be acceptable, but I wouldn't risk having to fight over that. It's just not something worth fighting over. :) Just sign by hand and there won't be anything to worry about. You should send the original I-129F, G-325A, letter of intent to marry, and G-1145 (if provided). Other documents can be copies/prints. It is recommended to make a copy of everything you send so that you can either provide it in the event of an RFE (i.e. if it got lost by USCIS), or send to your fiance to take with her on the interview in case they request it there (again, if lost or something).
    9. You must fill in all forms with correct data as of the date you file. So for current address, put your current address right now. For mailing address on the I-129F, you can put any address where you can receive mail. If you move and want to update your address, USCIS has a form on their website, or you can call them.

  18. So currently my fiance is in Hong Kong, I have already moved back to the US for nearly a year, looking for work still did some odd jobs here and there, and living with my parents.

     

    I have a few questions about the K1 Visa.

    1) When I first file the I-129F, I do not need to file anything about my current income right? I'm sure my assets in stocks/bonds is enough for a two person household, and I am actively seeking employment, just haven't had too much luck here in Seattle... Can anyone tell me what is actually needed I just keep reading some percentage amount over poverty but what is the numerical value right now? thanks

    2) I-134 is only needed for if and when the interview of my Fiance at the consulate in Hong Kong. So if I get a job before the consulate interview it should be fine? I probably need one of my parents as a co-sponsor, play it safe?

    3) While filing the I-129F for my Fiance it is only my birth certificate and not her's that is needed?

    4) I recently went back to Hong Kong in December and I believe I threw away my boarding passes to get to Hong Kong, but I did keep my return flights from Hong Kong to Seattle. Is that fine? My Fiance also did come to Seattle in October 2016, but I really am not sure if she kept her boarding passes. Are itinerary enough?

    5) My fiance's birth certificate is only needed for when k1 is approved, we got married here in the USA and she's filing for AOS and the other forms right?

    6) How many pictures/proof of on going relationship do we need? is 20 too many?

    7) Also for letter certifying intent to marry, do we each need a letter or do we type/write one letter and both sign it? Also hand written or typed is better?

    8) When I do submit our I-129F and G-325A is it better to hand write or type it besides signature? Also I keep the copies and send the originals?

    9) Will it also be a problem if I put my parents address as my current address, but if and when I do get a job, move out, but within the same city? (Seattle)

     

    Also on a side note I met my fiance in Hong Kong while I was working over there for the last 6 years, but decided to move back.

     

    I feel like such an idiot for having to ask all these very simple questions. but thanks if anyone takes the time to respond.

  20. Hi there I am currently looking into which would be faster and easier for my fiance and me. Between a K1 and DCF within Hong Kong.

    Currently my fiance has a B1/B2 tourist visa because we came and visited the US a couple times prior.

     

    I would like to know if we did a DCF in Hong Kong, if it is even possible, would I need to be present for any interviews or submitting of any of the applications/information.

     

    I am planning on going to HK in May, I moved back earlier to the USA to get a job and settle down. If we got married during my visit in HK in May would we be able to file a DCF and speed up the process of receiving a 'Green Card?'

     

    Or would it be better to file for a K1 visa soonish, wait the 6-7 months, then move her over, marry in the USA, then file for the AOS?

     

    I just started looking into all of this and I would really like to the quickest/safest way and cheapest method. thanks.

    Coming on the tourist visa with any intent to Aos is a fraud. Big chance your wife/fiancee wouldn't even be allowed to enter the US in this case.

     

    Do not try to play the system. You won't bypass anything. Especially with the current administration, do you really want to risk it? Worst case scenario, you can risk a ban.

  23. So I met my fiance in hong kong 6 years ago and I decided to move back to the US to get a job and settle down first. Been a little rough and I just want to move her over here since its been nearly a year apart.

     

    She currently has a b1/b2 visa because she came earlier to go to my brother's graduation (2014), spend a christmas (2015) over here as well to visit my parents, and recently came over in october 2016 to visit as well.

     

    What I want to know is it possible to come over to the USA on a b1/b2 visa with prior visits since 2014 get married in the US, do an AOS and apply for greencard and then EAD at the same time?

     

    I know the obvious safe route is doing the k1 fiance visa, but that seems to take around 6months to process? and I was hoping to have her come over in May.

     

    Also if she were able to come over in May would it be possible to do the Medical Examinations here in the USA?
