am in same boat too.... on the joint sponsor i864 form, under section 1, did u click on the box for iam the only joint sponsor or i am the first of two joint sponsors. i ask because my sister is amrried and her and her husband filed tax returns together. Also, what documentations are u sending for supporting documents for them

I don't remember. I think I clicked petitioner. I am the main sponsor but not the join sponsor. Thank you so much for your feedback. We sent it so if we did anything wrong we ll hear from them. Got tired and confused with all the terms.

The sponsoring spouse can enlist a secondary co-sponsor (a person outside the household) who is willing to accept full financial responsibility for the spouse who is seeking the green card. This secondary co-sponsor must submit their own Affidavit of Support (Form I-864) and must meet the above income requirements all on their own. (In other words, there can be no pooling of income or assets between the sponsoring spouse’s household and the secondary co-sponsor.)

Thanks a lot for your feedback.

  3. My joint sponsor and household member have enough combined income to meet the sponsorship requirements. My joint sponsor filled out the I-864 form and the household member filed out the I-864a form.

Since they filed joint tax returns for 2014-2016, I'm wondering how to complete p. 2 part 4: Your (the Household Member's) Federal Income Tax Information and Assets of the I-864a form. Should I just list her portion of their joint income in lines 2a-c even though that total is different than the total income on their tax return?

And should I do the same on the Sponsor's Employment and Income part of the joint sponsor's I-864 form (p. 6 part 6 numbers 19a-c)? Or do I list the total income for tax years 2014-2016 on both forms?

Thanks a lot for your help,

  4. Hello!  i would like to double check the following,  , we are going to need a join sponsor as my husband is working on his master's thesis. His dad, retired is above the poverty guidelines, he doesn't live with my husband  so not the same household. Does he need to get only the below documents ?. Thanks

Original completed signed and dated I-864.
Copy of passport info page as proof of citizenship.
Proof of residence/ domicile as a copy of driving license.
Taxe information for the recent year : there are 2 choices:
Tax return transcript ordered from IRS preferred by NVC, or Tax returns W2s, (1040) and any other schedules/worksheets.

it is ok but have you ID'd all pages with your case Number, both names and both DOB's in the upper right hand corner

the DS 260 is several pages long and when mailed without the case number and other ID on each page, you are looking at the possibility of them getting separated and misplaced

why not do online and send that way to NVC and bypass the possibility of anything getting lost in the mail of NVC office

    and things do get lost

Thanks. I m doing it online as recommended.

The US Citizen who has English as a first language needs to become an A-Student of the I-864 instructions.  Sounds like a joint sponsor is needed.

Thanks for your feedback and wit :)

I would like to double check with you what his dad, as a co sponsor but not in the same household, should send in. Thanks.

You know, I thought about this later and it occurs to me that something from Social Security COULD be needed but only if receiving income from Social Security.

I have another question from my husband and I don't really know how to navigate this form. I need your feedback on the below..I would really appreciate it your recommendation. Thanks.

I have met the income requirements for the past two years (2015-2016), but all of my money was earned overseas so I don't have W2 forms for those years (but have the Moroccan equivalent). Now I am working in the US, but only part-time since I'm finishing my MA and won't be anywhere near the income requirements for 2017. Does that matter to the NVC? Or is proof of sufficient income based solely on my tax returns from previous years?

I can submit pay stubs from my current employer to show proof of employment in the US for 2017, but they will reveal that I'm working part-time and do not meet the income requirements for 2017.  Is it possible to submit a note that says I'm not working full-time due to my MA classes - and will be back to full-time salary once I complete my degree? Or should I just get an employment letter from my company to show proof of employment instead? The site says the employment letter must be issued within the last three months, but my original employment letter was issued in April 2017 (i.e seven months ago) - just days after I was hired. Do I just ask my employer for another employment letter?

    Thanks

You only need to include a copy of the latest return or transcript. It doesn't hurt to include all three if you have them.

NVC doesn't care that you filed late, only that you filed. Whatever's on the tax transcript is okay.

I don't believe you can get one over the phone - you can always call and ask, of course, but expect to get it by mail. You don't need the earnings statement for I-864, though - the latest tax return/transcript should be sufficient.

Please I have another question from my hubby, i really need some guidance here. Thanks in advance.

Have you been billed for the 2 fees online?

if so, after the payment is received, fthey direct u to fill these forms out online

then print them out for your own records

    all is done online now

Yes everything has been paid. So it is ok if the package  documents are physically mailed to NVC and the DS 260 is done online. Thanks a lot for your feedback.

A complete tax return including w2 form OR a tax return transcript.  Only the latest return is required but information from three returns, PLUS evidence of current income are required.  Nobody cares if you filed late.  No Social Security Administration statement of earnings is asked for.  Not sure why that was asked about.

Thanks a lot for your feedback. It has made things much clearer to me. I appreciate it.

  11. Thank you all for your feedback and advice , I have a few things to double check with you.

I m the beneficiary, so for the NVC part do I have to send the original of my birthday certificate and its translation or just the copies and keep the originals for the interview? Same question for the rest of my documents except the passport.

As for the petitioner, does my husband need a copy of all his passport pages or just the main page? Should the NVC get the original of the  tax return and transcript or just the copies?

Sorry for my many questions :( I am pretty stressed with the whole procedure.

    Thanks

Adil's response confused me too.  The I-864 is not "filled out online" in the way the DS260 is.  It's best to download the form and fill it out either on a computer or by hand.  It must be physically signed.

If you have remaining question, clearly ask them again, so they don't get lost in the shuffle.

Thanks!  The below were my original questions. They are actually my husband, the petitioner, questions. Thanks.

Do I just need to include a copy of my 2016 return with the I-864 form? Or do I need to include copies of last three tax returns?

2 I filed late this year. Do I need a tax transcript for the years I requested AND another transcript that indicates that I filed the taxes late? Or is the fact that I filed late covered by the regular tax transcript I requested? If there is special form that I need from the IRS to indicate that I filed late, how do I go about getting one?

3 I was unable to create an account online with the social security administration. Is regular mail the only way to get the earnings statement? Or is there a way to request one over the phone?

you asked about social security / you mean IRS

tell him to go to nearest office as a walk in and when your turn comes up, they will give you a transcript / needs ID and SS card / do not send in as the forms are done online and documetns get lost / wait for NVC to tell you

he will fill out the I 864 online after paying the online fee

then bill for visa application fee and fill out that online

NVC will then tell him what is needed as Morocco embassy requires more evidence than other embassies

you will (they can email this and it is best way to get things fast) a list of what NVC needs examples like the 2 criminal investigation reports, years of tax returns they need,  and any other / this letter of instrucations will have a bar code sheet

return it with all of the documents (1 mailing) and but the NVC case # CSBxxxxxxxxxx , both names and both DOB's on the upper right hand corner of EACH and

EVERY page of all documetns / papers get lost in these offices

when case is complete, it is sent to embassy with a date of interview

now, NVC will tell you what documents to bring to interview and list of doctors for medical exam

Thanks Adil for your feedback but I didn't really understand what you recommended..I am confused.

Thanks ! That's really helpful. I was panicking as I thought it would take months to get the IRS generated tax or return. I m not familiar with those terms.

  15. Hello there! I need some help with the NVC petitioner part for spouse visa . My husband, the petitioner, has been working overseas for a while, he just got back to USA and he is stuck with the following questions.

1 Do I just need to include a copy of my 2016 return with the I-864 form? Or do I need to include copies of last three tax returns?

2 I filed late this year. Do I need a tax transcript for the years I requested AND another transcript that indicates that I filed the taxes late? An I-864 from him and and I-864 from Mom.  That way, HE is not counted in Mom's household, and she is not counted in his.  Even if people live in the same house, unless they need to COMBINE income to qualify, nobody is a "household member" in the immigration context unless they are on a joint tax return or claimed as a dependent.

Thanks for clearing up things for me.  I appreciate it.

  17. Thanks you so much

3 persons if it is just going to  be you and him and his mom in the house

He should have made out tax statements for the years he worked out of the country (he is exempt from owing them well over $100,00) so if under that amount he will not owe any back taxes)   if he already filed then he will need to send in copy of the IRS transcripts to NVC when asked to produce them

If his mom is older and retired or getting SS money, there is a different way to do the I 864 supporting documents

so, let us know here what further questions you or husband have

incha allah all will be good

household income for 3 must be $25,525

Thanks a million for your feedback and thoughtful comments. I m new here, so I am still learning how to navigate the site. I have more questions but I 'll post them later. I didn'tknow how to reply to your message.

  18. Hello! We have started working on the financial support documents for the NVC stage. My husband who is American and he used to work overseas is back to the USA seven months ago. He is living with his retired mom while finishing his thesis. So, he doesnt have a job now but it is temporary. We are going to need a join sponsor which is going to be his mom.

We were advised to fill I-864 for my husband and I-864 A for his mom.

Is ther anything else we should take into consideration?  Someone mentioned I should follow the guidelines of 3 person household.

    I feel confused, please help
