  1. I filed the I-102 to replace an I-94, and they said they sent an approval letter but I did not receive it. After speaking to several officers, nobody knows what an approval letter is and they just say to file the form and pay $445 again. My question is, what is an acceptance letter, does it contain further instructions? Does it contain the original I-94? Does it contain a replacement? Is there a way to get a copy without paying again? They don't seem to care at all.

  2. I filed the I-102 to replace my lost I-94 and the case status says that they sent an approval letter but I did not receive it. After speaking with a USCIS officer, they said that I have to file another I-102 and pay again for them to resend it. My question is, what is in an approval letter? Is it the replacement I-94? Is it a generic letter with further instructions? Is it just notifying it's approved and the I-94 will be sent in another letter? The officer was unable and unwilling to answer these questions over the phone and just instructed me to file it and pay again. What are my options here? Thank you.

  3. Thank you aleful, she does not have any of her original documents (the apartment she stayed in burned down over 10 years ago). All she has is a new passport. Thanks for recommending i102, I'll try that, do you know if they will still charge us if they cannot provide the i94? Also, if they cannot provide the i94 is it going to be impossible to sponsor her?

  4. I am trying to sponsoring my mother who came to the US over 30 years ago using a tourist visa and over stayed. She has been here ever since.  I am trying to fill out I-485 but one of the requirements is "Evidence of Continuously Maintaining a Lawful Status Since Arrival in the United States" which we do not have.

Anyone applying under the following immigrant categories must submit evidence to show they have continuously
maintained lawful immigration status while in the United States and are therefore not barred from adjustment by INA
    section 245(c)(2)

She does not have her original passport or I-94.

The instructions clearly state that she is barred from adjustment by "INA section 245(c)(2)" - so is there something else that we can do?
