    Saw people getting called in, and we finally got called around 9.10am? Very nice woman called us, and brought us to a room down a hallway. Handed passport and Driver's license to her, and Husband's Driver's license- she checked them and swore us in. We commented that our file was thick, and she said that it was actually quite small compared to a lot of others! lol. We asked why, she said it was because some people file more than once/appeals etc.

    Got asked a few questions- date of birth; place of birth; date of wedding; who was there; how we met; where we had the wedding; who were the witnesses etc. She looked at lease, joint bank statements, joint car insurance, and one wedding picture. :D

    Asked us if we had the approved EAD/AP with us, but we didn't (only got approval emails a few days ago!). Chatted about how some passports had really weird paper when she looked through my passport for entry stamps (mine was fine though!).

    Finally she said I was approved, and said that my security check was also cleared. YAY!. She then stamped the passport and took the I-94. Told us that we didn't need the EAD or AP anymore, and can just use the stamp to show that I can work etc. About the EAD/AP, She told us to mail it in when we got it. Told us about the lifting of conditions in 2 yrs, congradulated us and said that the stamp is valid for 60 days. :D Shook hands, said bye/thanks and that was it! Done at about 9.35am. :D

    Quite fun/painless. Phew. Am so glad my AOS was ALOT easier than expected. Now done with USCIS for 2 yrs! yay!!

    So did she ask you for your original birth cert and the petitioners proof of citizenship?

    Hi, did she asked to see the original documents? Like original birth cert , the petitioners proof of citizenship, passport stuff like that?

    I was able to request my birth certificate online and they sent it overseas. Maybe you can look up your county/city online and see if they have such a service for you. 

     

    I would try to make another police report. It's ridiculous to know at which stop it happened. Give them an estimate or tell them the route and direction you were traveling. Make sure you get a case number or even a written response. 

     

    Since your lawyer has the copies he might be able to give you certification on them. Certified copies are as good as originals in most cases. 

    No he doesn't have a passport. We are gonna apply for his replacement. I can get a birth certificate but it's a lot of hoops to jump. That's what we told the cops we estimated somewhere near Sacramento and even sacramento police wouldn't make a report. This happened July 2017. When I brought up my worries my lawyer didn't seem to concerned she said she's certain it has happened before and at least we have copies.

    It's hard to tell if it's gonna be in issue at the interview.

    For example, I didn't get asked to show anything but my ID/passport.

    But I know some officers might ask.

    I would try and get everything together asap and if you can't get something and they ask for it, explain what happened.

    Did you file a police report? It might come in handy.

    We managed to get a replacement marriage certificate and kids birth cert and also my passport that's it. The original passport that I came in with and the visa, my birth cert and husbands naturalization is still missing. I couldn't make a police report as they told me I have to know exactly where the theft happened since there were so many stops I didn't know when it happened. I only have a report from amtrak that states i reported my luggage missing. I don't have an interview date yet.

  5. So someone stole my luggage in an amtrak. Inside it were basically everything I needed for my green card interview. From my passport and i-94w, my birth cert, my husbands naturalization everything I needed. I know it's stupid of me to have not checked it in. Anyways I'm worried about my interview, I know it's required that they see the originals. It's not easy getting the replacements also it's financially straining. My lawyer has all the photocopies, do you think immigration will give me problems or will they close an eye and take my lawyers word that she has seen the originals? Whats the worse case scenario, I really can't afford to be deported.

    NOA 1 is the Notice of Action paper ... the I797C  .... that tells you they have received your paperwork. You have this.  The statement on it is correct .. it only says they have received the petition, not that they have approved it! 

     

    The NOA1  gives you legal right to stay only until the petition is decided. If the petition is rejected you must leave the country, if it is granted you will receive legal resident status. Until then , you wil be in legal no mans land!! and your lack of status is ok. 

    So I'm good to fly then with the notice of action in hand?

    Yes you are flying domestically and are in an authorized period of stay.  I do suggest requesting a new NOA1 for your I-485 from the USCIS, printing off your emailed or text message NOA1,  and/or your case status as per the USCIS website.  

    What is a NOA1??? I have the i-797C notice of action. It however states on the header. This notice does not grant any immigration status or benefits

    You are married correct?  You filed paperwork so you can stay in the USA?  That means you are "adjusting your status."  Your status before, was illegal.  You overstayed your visa that you entered with (tourist, work, student, etc.)  So you are adjusting your status so that you are no longer an illegal alien (or a tourist, student etc..) to legal permanent resident, aka green card holder, aka legal alien. 

     

    The notice was a NOA1 or notice of action.  It means they received your petitions and will work on them when they get to them.

  9. I overstayed my visa and recently filed to adjust status through my spouse. My luggage got stolen and I lost all immigration documents including my passport with expired visa. I went to my consulate to apply for a new passport. My son just had a liver transplant and I have to fly home to Oregon from San Jose.  I recently received my notice of action from USCIS that they got my application. My aunt said I shouldn't risk flying home with my passport as they will check for visa since it's a foreign passport. I have no ID whatsoever. Except for a foreign ID. Do you think it's safe for me to fly with my foreign passport and notice of action in hand. Also my passport has my maiden name and my notice of action has my married name.

  10. My lawyer haven't filed my paperwork yet she still waiting on some documents. My luggage got stolen on the Amtrak recently. Inside the luggage is all my immigration documents and his naturalization cert both my kids social security and birth cert. He is really upset to the point he called up my lawyer and said he wants to stop proceeding. He also told my grandma that he wants to divorce me and take the kids. I'm the primary care giver to both of them since birth. Can he do that since I'm illegal

    @OP

    A cousin (or their husband) cannot sponsor a green card. The purpose of the process is family reunification, which is limited to spouses, children, parents, and siblings (albeit that's a 15-30 year wait...). In-laws, cousins, grandparents/grandkids, etc. are not included (albeit you could petition for parents and then they can petition for their parents once they have a green card).

    I need a co sponsor not a sponsor. The main sponsor will be my husband

    OP, when your say "sponsor" it isn't clear whether you mean the initial I-130 filing or an I-864 affidavit of support.

  13. I overstayed my tourist visa and I'm trying to adjust status and get a spousal based green card. Unfortunately he doesn't work as he is ill now and in need of surgery. We can't find a co sponsor. Is there a way that I could get a work permit and start working and use my income?? I'm running out of options here and I'm almost desperate.

    your aunt by herself can't cover your husband?

     

    eventually he will have to have proof that he is a USC, but since you can't wait, you'll have to find someone else if your aunt doesn't make enough

     

     

    My aunt doesn't work as she has cancer now. She will be getting ssi and she owns a house but is still paying mortgage

    My lawyer said that he might even have problems getting a passport. If they deny him getting a passport he will need to go through USCIS and she said that will take a very long time we have until August to file it

  16. I need a co sponsor for my spousal based green card. My aunt and her adult son is going to be my co sponsor. She is a naturalized citizen and her son got his citizenship under her as he was under age at that time. So he doesn't have a naturalization cert. He used to have a US passport but a crazy ex tore it up. So will his mom's citizenship be enough to proof his citizenship?

    Yes I know right. And it's the same liver disease which they claim is not genetic. My husband needs a resection whilst my son need a transplant which will have to be done in California. My lawyer doesn't like the idea of me travelling back and forth without legal status
