  1. You have already removed conditions for your husband. That was a joint petition. The N-400 does not involve you anymore; it has to be done by the applicant himself and if you want to prepare it for him would have to state so at the bottom of the page. Rather let your husband do this on his own. If he's ready to become a US citizen, he should be ready to fill out an online form.

    That said, for the ROC petition you needed evidence of comingling. That's done and over with. For the naturalization process, such evidence is not needed. If he sends in bank account statements, it only proves that he has problems with English comprehension.

    Wow, people used to actually be informative AND supportive on this site.

    There is nothing wrong with helping your spouse - He hates paperwork, I hate doing the dishes. It’s a partnership.

    I don’t really see the point of insulting people, especially about their ability to speak English.

  2. Could be true if you met with a board of officers rather than just one IO that could have gotten up on the wrong side of the bed. Personally know of friends that were rejected because of lack of proof of either a joint lease or home ownership.

    Often wondered if any authoritative person from the USCIS comes here and reads these posts.

    Cassandra did explain her home situation to anyone that reads these posts to read, sounds reasonable to me, embellish that and explain it to the USCIS.

    Another option, is to wait another two years so you are not required to provide all this proof.

    Least during the AOS interview they let both couples explain their situation, but during the N-400 interview, also based on marriage, kick out the US spouse, that doesn't seem right to me.

    I probably will just send in all the evidence I have - that’s what I did for K-1 and AOS and it went fine (except for that RFE for not sending in my 1099s).

    I’m still conflicted about the grant deed - on the one hand it shows the truth, which is that my husband and I are lucky to have been GIVEN a house to live in by my mom. On the other hand it’s a simple document that shows no financial commitment (like a mortgage) which is what proof of marriage at this stage is all about. Could it just confuse the officer? :unsure:

    Yes I do hate that my husband might have to explain all this complicated stuff by himself, especially since his English isn’t 100% yet and he gets nervous. :blush: Lots of border harassment will do that to you. He is a great person and an excellent community "citizen", so my job is to keep his confidence up, right? (and properly fill out the paperwork! :hehe:)

  3. Hello Fellow VJers!

    It’s back to paperwork for me, looking to get my husband’s N-400 app. mailed by the end of the month! Could this really be the end :yes:

    As usual, I’m having trouble with the evidence pieces. Trying to paint a reasonable picture of a somewhat complicated situation.

    So far I plan on sending in 3 joint bank account statements, transcripts of jointly filed taxes for 2010, 2009, & 2008, a certificate of coverage for our health insurance, and the title of our jointly owned car.

    Here’s my question about lease/mortgage evidence:

    My mom and my dad owned a large duplex together. My mom gave her half to my husband and I in 2010 (we have the grant deed) and my husband and I moved in to one of the units. My dad lives in the other unit and is currently paying the entire mortgage in exchange for my husband’s remodel work on the house (mortgage is in my dad’s name). Electric/Gas bill is in both my name/ husband’s name. Water is in my husband’s name. Internet/cable is in my name.

    Should I send those bills in? What about the grant deed? Or just the tax transcripts?

    Maybe after going through K-1 I’m too paranoid about marriage evidence :wacko::hehe:

  4. Hi, new here and wondering how many are from CA? in general how long does it take to process the papers in this part of the country?

    I filed my I-751 last June 22 and my biometrics will be on Sept. 10 in San Francisco.

    As you can see from the updated list, California seems to be really moving fast :thumbs:

    I received a "card production ordered" email today from good ol' CRIS!

    Is it really possible, is this really an approval coming my way???

    We haven't received ANYTHING in the mail yet. My husband thought maybe someone was playing a sick joke on me, but it's a real USCIS email and case status is updated too.

    I really hope this is for real :unsure:

    Yep it's for real :thumbs: we got the approval letter today. I hope our luck continues and we get the card pretty fast.

    Good luck to all the other June filers, some of you should be getting approvals any day now!

    Really now I know it's just luck, our evidence was unexceptional and in the past my husband has been treated like an applicant from a "high fraud country". We really weren't expecting this.

    So keep your spirits up everybody :yes:

    Is it still possible to do an early biometrics although I already received the cancelation letter? Or should I just wait for the new biometrics schedule.

    My advice is that a walk-in is worth a try.

    Here's my experience: Our July 9th appointment was canceled and rescheduled for July 23rd. After days of agonizing over how we were going to make the new appointment we decided to just try to do a walk-in today, expecting to be turned away. The security guard at the entrance just crossed out July 9th on the Notice (in pencil) and wrote today's date. No questions, not one word. We walked right in and were out in 10 minutes. :dance:

    Weren't the offices suppose to be jammed this week? Oakland, Ca isn't exactly light on immigration cases. The whole cancellation thing is a mystery to me...

  7. I just got home over the weekend after being away on a family emergency to find that our July 9th appointment had been canceled as well. :angry: ...We drove 14 hours for nothing! Or so I thought. We decided to just try to walk-in today. The place was empty and it was absolutely no problem! Biometrics done :thumbs:

    I also corrected my NOA because I had it wrong for some reason.

  8. What would I do without VJ? It's always nice to have people justify your illogical nervousness...I too believe that when it comes to USCIS more is more. I went with the advice of "send everything" and feel pretty good about it.

    Sending the marriage certificate from the first wedding was a great idea too. I ended up including all the evidence from our "spiritual wedding" (vs. the "civil wedding") such as the invitation, photos, rsvp cards from guests, but marked each page with a title and a date so as not to confuse them.

    I mailed our package today certified mail!!!! the tracking and waiting has begun. :thumbs:

  9. I've read ALL the posts about the different evidence people submitted and it's given me some great ideas so THANKS!

    We're in a difficult situation in that we have NO joint bills (we live with my mother and all the bills and the deed are in her name). I've tried to gather together other types of evidence. Here's what I'm planning on sending so far...

    1. Cover Sheet

    2. Personal Check (with both our names from our joint account)

    3. Form I-751 signed

    4. Copy of Permanent resident card

    5. Copy of our IDs with same address

    6. Notarized Affidavit from my mother stating that we live with her

    7. Copy of her ID and property tax bill in her name

    8. Copy of our credit cards (same number)

    9. Bank Statement March 2009 (joint checking and savings)

    10. Bank Statement Feb 2008

    11. Bank Statement Dec 2007

    12. IRS account Transcript 2008 and copy of check cashed by IRS (showing married, filing jointly)

    13. IRS Tax Return Transcript 2007

    14. Vehicle title and registration in both names

    15. 2 medical statements from husband's insurance showing me as the spouse/patient

    16. 3 Notarized affidavits from friends and a neighbor

    17. Itineraries or boarding pass stubs from 7 flights taken together

    18. 3 pages of pictures of us on trips, holidays, etc.

    19. 9 cards send to us from friends/family

    I hope it's enough...

    I also have a lot of evidence (photos, response cards, receipts) from our spiritual/religious wedding held in Mexico in 2008 where 50 people attended from the US. This is separate of course from our civil wedding we had here in the US satisfying K-1 requirements. I know there is a lot of debate about whether non legal/financial evidence such as this is even effective at all. My questions is if people think it would HURT in any way to introduce evidence of another wedding (would USCIS be confused by this...since they get confused easily)???

  10. We made an infopass appointment for next week to get my husbands passport stamped. Thanks for the advice everyone, it made be feel more secure about traveling so I could buy our plane tickets!

    Fortunately it won't be necessary because... We got the card in the mail!! :dance::dance::dance: Our mail from USCIS ALWAYS comes on Friday. This time we were out of town but my mom picked up the mail and called yesterday to let us know.

    Now I'm worried about it actually getting here, since we're leaving the country at the end of the month. We were planning on traveling on AP but this would be much better!

    I don't mean to be Suzy Raincloud, but you may want to get the passport stamped. I may be mistaken, but I don't believe you can travel on the AP once you Green Card has been approved - even if it is not yet in your hands.

    Thanks, I think we're all living under a rain cloud during this process...worse case scenario is my favorite :lol: my husband is the positive one :yes:

    I have also heard that AP is no longer valid. How would he get the passport stamp? Go back to the local USCIS office?

  12. Finally checking in to let everyone know we had our AOS interview Tuesday and got approved :dance: :dance: :dance:...I think. It's the same situation as many, we got the verbal ok but we're stuck with the FBI. Luckily we have AP and EAD so we can still go back to Mexico next month and work.

    What was really strange is that the officer felt some kind of personal connection to us and actually called us on Thursday to let us know that FBI check was going through and we should expect the green card soon :blink: (and she kept saying we are a great couple :innocent: ) You actually read a lot about officers being very personable and friendly. Some people like this... I just think it's weird because you don't know when they are asking questions as themselves and when they are testing you as an immigration officer. Before my interview someone passed me this piece of advice...

    1) Always tell the truth

    2) Don't tell too much - The officer may seem really nice and chatty but never forget that you are in front of an immigration officer whose job is to evaluate you.

    This second piece of advice was especially valuable for me since I tend to be chatty and love talking about my husband and his homeland. The officer was very informal and friendly with us (she even gave me here personal email for me to send her some tips about Mexican food). But there were many points where she was obviously trying to trick us to see if we were faking it, previously married, had children, etc. It's unfortunate that being sneaky in this way is part of the job. I held my tongue on many occasions - I think to my benefit. Thats my 2 cents.

  13. So much movement here it's hard to keep track. Congrats to everyone.

    Things seem to be working at USCIS, although the same old double messages thing happened to us again. We received the actual, physical EAD card on Aug 6th! :thumbs: Then the next day I got another CRIS update that the EAD was approved and notice was sent. Who knows. If they send me two, I won't complain (it just makes you wonder what's going on over there :blink: )

    Our EAD card was ordered today too! It will probably come around the time of our interview. It's sure nice when those CRIS emails work :thumbs:

  15. Got a CRIS email that our travel document approval notice was sent on July 28th. This is very exciting for us because we've been waiting to be able to have our wedding in Mexico (can't really do it without the groom ;) ) Our case online was also updated a day after I got the email - so I guess SOMEBODY is on top of it over there.

    Anyone have any idea when the "document" will actually arrive? Can I start buying plane tickets?

  16. Update!!!!!! :dance::dance::dance:

    I received a letter today saying my AOS has been transferred to CSC!!!!!!!

    No touches, no e-mails, so I thought it would be an interview letter.....but when I read Transfert notice I jumped in my husband's arms and accidentaly hit his nose :blush: Ok I was happy. No interview!! I made up for hit and cooked him a good lunch and I had fresh banana bread still steaming from the oven :luv:

    Edit: Forgot to mention Ive been transferred on June 28th.

    So once you get transfered to CSC you will no longer be called for an interview? Is that how it works. Just trying to get a handle on the order of things and which news I should be happy about. Not that I've gotten any news...

  17. Ok so NOW I get an email. I had a moment of panic/ excitement thinking it was something serious. But they were just letting me know they actually received the RFE info and my case is back to being processed, still at National Center.

    I really hope what I sent is acceptable.

    Is it true what the RFE letter says about EAD 90 days starting over with RFE?? I feel so behind :crying: But Arazia you give all us RFEers hope!

  18. We had a horrible experience at the California DMV on Friday trying to get a drivers license for my husband. Now that our AOS application is waiting to be processed and he has a SS#, we figured he could finally get a drivers license (which means be able to get insurance for one thing). They were so rude and then sent him away, telling him he is "illegal" because his I-94 expired :angry: . I talked to a supervisor and tried to explain the K-1 situation. He told me that my husband could not get a drivers license until he had a green card but he also can't drive on his foreign license. I know the last part has got to be false.

    Why they have to be so mean is a question I don't expect anyone here to answer. But what is the driving situation for AOS applicants? Could he have gotten his license when he arrived on K-1 (with a valid I-94) and we just missed the opportunity? What was the point of getting the SS# in the first place?
