  2. My wife and daughter arrived last November and we are now going to file their AOS. But when we went to the CIS office we were told they needed to get a new medical exam for both of them. I told the CIS lady that they still had valid medical exam from abroad but she said they still need to get an exam here in the US. I just checked the pinned item here on AOS and it states that they just need the supplement I693 to transfer the info on the foreign medical exam. My question is do they really need a new medical exam even if their current one doesn't expire until November this year? BTW we still have the DS-3025 and the Xrays. Please help I'd like to get this over with before the price increase.

  3. Thanks for the quick replies. I thought Iread here somewhere about notifying the NVC so I asked. Anyways, the I-130 is already approved so I will just file the I-485 w/ the NOA of the approval. Another question do I need to file another G-325 with the 485? I ask here cause I can't get the same answers with CIS when I ask the answers always change, at least here the people giving answers have gone through the process themselves and can empathize. TIA

  4. If you don't get the EAD before you file your taxes (and therefore cannot get an SS#), as mentioned, you can apply for a taxpayer identification number. The TIN can be obtained through the W-7, which MUST be submitted with the actual tax return. Thus, you can wait right up until the time you file to determine if you need a TIN or can get a social security number. How quickly you file, to me, depends on whether you are getting a refund or not.....at least that is how I base my decision. If you file shortly after year-end, you will most certainly need a TIN. If you wait until April 15, you should have the EAD by then and be able to acquire a social security number.

    Thanks for the help everyone. Am going to IRS now to get W7 for the ITIN since I tend to file early regardless of the situation. We'll probably file the 485 after the new year but we'll file the 765 earlier.

  5. Okay, my wife and daughter finally arrived in the US as a K3 and K4 but now a new thing needs to be started again. We went to the Social Security office to apply for a SSN and were told that she needs to get an EAD before a SSN will be issued to her and my daughter. Is this true? AFAIK they mark the cards as not authorized for work w/o Immigration approval in these cases. I told the guy that the process takes sometime to get an EAD and I need it for tax purposes, he replied to go to IRS and get a TIN. I just went to the IRS site and based on the W-7 form for a TIN she wouldn't qualify since she is eligible for a SSN once she gets her LPR status. Am confused now because of this, so please somebody help me!!!!!

  6. Congatulations on your wedding. I'm going there myself in 4days and counting, to be with my wife for her K3 interview last time we saw each other was almost a year ago.

    Just some advice, have her get all the papers you will need for the I-130 and I-129F ready so when you leave you'll have it with you. God knows how long it takes to get papers from government agencies in Manila.

  7. hi there, my husband called the embassy they said that they already mailed the packet sept. 21 and my interview schedule on nov. 8. im so happy. but until now havnt received the packet, how many days it can be mailed? why it took so long even if its from within the country mailing only? anyways hope u could help me how to prepare the requirements...thanks. please pray for me...

    If they sent via regular post office then you shouldn't be wondering why it takes long, you are talking about the Philippines after all. If they sent it via courier then tell them you have not received it yet, but also keep in mind that a typhoon just hit and all the sevices are not back to normal yet with most businesses.

    Just noticed on your timeline that your interview is 2 days before my wife and also same with the medical. :lol: She is actually going to the medical before the date indicated in her letter since the office at St.Lukes told her it would be ok. I am hoping she gets the visa before I have to return so she and our daughter can fly back with me. BTW where are you from in the Philippines? Hope you guys made it through the typhoon ok, seen the damage on tv and it looks real bad. Anyways, good luck with your interview.

  9. Need to add also that we never got a packet 3 but the packet 4 that she received looked like a mixture of the both w/o the ds-230. Is this normally the case?

    I am just too excited now to really care about the $760. But I really need to know what I should do about the I-130 if she enters w/ the K3? Will the NVC still have it if I just paid the fee but havent sent the DS-230 and I-864 or will it already be with the embassy? If the NVC has it I presume I can write them to transfer it back to USCIS, is this okay for me to presume?

    just wana ask which one is needed for me to file my spouse visa petition for my wife to be.

    is marriage contract and marriage certificate the same?

    i understand if we get married, we will be issued a marriage contract or is it a marriage certificate from our civil registrar office then there is another NSO marriage contract or certificate.

    is the marriage contract or certificate which we will get days after our civil wedding good enough for filing my spouse visa petition or do i have to wait for the NSO marriage certificate or contract which takes a a while to be released.

    help me guys pls.

    confused between marriage certificate and marriage contract... are they the same.????

    Get the copy issued by the NSO since that is what the embassy will look for. The ones you received from the civil registrar will still need to be filed by the registrar at the NSO office and this usually takes 4-6 months. For your initial filing you can use a copy of the ones given to you after your wedding but make sure your spouse gets the certified NSO document to bring with her. If I recall correctly the document you will be given is a marriage contract since AFAIK the Philippines doesn't issue marriage certificates.

  11. Ok, I think I just threw away $760 aaarggh. :crying: Anyways, I got the bill for my wife and daughter's ds-230 and paid it yesterday. But today I spoke to her and she told me she just got packet 4 w/ ds-156 and appointment date for 11/15/06. So here is my problem should I go ahead and purse the K3 or just go with the CR-1? If I pursue the CR-1 how much longer will she wait since she is in Manila? Based on the experience of other people in the site it appears that the K3 visa will be issued w/in a month of the interview. I realize others go back and get the CR-1 once it's approved but that doesn't seem like a good idea since the airline tickets for her and my daughter to Manila would be more expensive than the AOS.

    Anycase if we go ahead and pursue the K3 and decide to just do the AOS do I need to let NVC or the embassy know about it so that the I-130 can be sent back to CIS. Which do I inform about this matter NVC or embassy? I know cost wise it would probaby be better to just wait for the CR-1 but we both want her to be here by December. So I guest I really dropped the a $760 ball on this one by paying the $380x2 fee for the DS-230.

    Oh another thing is any of this tax deductible? :lol:

    BTW when I paid the ds-230 fee we had been waiting over a month for the packet 4 and wasn't sure when she would get it and I had held off on payment for a week.

    I would like to ask if I enter on a K3 visa which has a 2 years validity then I choose to stay in US and do the AOS, will I still be able to travel outside US without AP or I need to wait for my GC?

    You can travel with the K3 without advance parole as long as the visa is still valid upon entry. The advance parole is only needed if you are adjusting from another category such as H1, L1, B2, etc. It is done to preserve your application for adjustment otherwise the applicant would need to re-apply or if they are using a B2 visa they may be subject to the 212(a)(7)(A)(i) charge as an immigrant w/o a valid immigrant visa. You will be given 2 years from the time that you initially enter the US as a K3 and be given the remainder of the 2 years for each entry there after.

  13. Well, you can see by my timeline and story that I also married a lovely Filipina May 3rd, 2006. She is the Love of my life and everyday without her here in the US is utter agony.

    It takes about 8 months before your wife can come to the US, perhaps less if you get a breadk.

    As far as being apart...it is the most difficult time of my life. To be able to endure the months apart, I go see Meinda every 6 weeks. I am going to see her for my 3rd visit August 29th for 17 days.

    We are only about 2 months into the process, and we are hoping she will be here by Christmas, but no one knows how long it actually will take..

    Go for it, even though it is sooooo hard, it is worthy it!

    Have you received your I-129F approval yet? Your timeline doesn't show if you've received the I-129F approval. I filed my I-130 on April 12, 2006 and had approval on July 18, 2006, the I-129F was filed on April 26, 2006 and approved on July 20, 2006. I know what you mean about the long wait I got married last December and haven't seen my wife since then. FWIW it usually takes 5-7 months after you receive the I-129F approval and actual arrival of person petitioned if they are coming from the Philippines. Of course it's also dependent on how fast the people involved take care of the requirements they need to file. My wife just got the DS-3032 for my step daughter since I filed an I-130 for her also because I will eventually need to for her after I file the I-485 when the get here. Does anybody know if the DS-3032 is needed for my wife also if she is a K3? If not we will go ahead and send the papers for my step daughter.
