  1. Anyone here scanned their green cards and printed a color copy for submission or is it best to just xerox a black and white version? On a side note, I just realized that if you scan the back of the card, within the black part there is an another strip of "hidden" portion with name, photo and A# in it. We never saw that before.

  2. They are requesting a copy of the Green Card. A digital photograph of a Green Card is not a copy. The back side that doesn't show up well, as you stated, is exactly what they want to see. It's actually proof that you made a copy of the actual Green Card.

    Follow their rules; don't try to make your own.

    Thanks. I don't think making up a card will work doesn't matter how realistic you make it, but I see what you are saying.

  3. I'm the U.S. Citizen. We feel this is a pretty good list. What you guys think.

    • Copy of Spouse’s green card (front and back). I actually took a picture of it with digital camera and printed a colored copy. The back site of the green card doesn't show up well with Xerox.

    • Copies of the tax return 1040 form via Turbo Tax electonic filing for 2009 and 2010, which we received for our checking account at Bank of America

    • Copies of Amica auto insurance card for 12/27/10-12/27/2011 and 12/27/2011-12/27/2012.

    • Copies of our AT&T Wireless statements from May 2010 - September 2011. We didn't print every single statement but demonstrated continuity by including about 3-4 statements from the given year.

    • Copies of our Bank of America checking account statements from May 2010 - November 2011. We didn't print every single statement but demonstrated continuity by including about 3-4 statements from the given year.

    • A copy of our Southwest Airline itinerary for September 2010 Salt Lake City trip.

    • A copy of our Southwest Airline itinerary for December 2010 Las Vegas trip.

    • Fifteen photos of various events with caption on the back of the photos.

    • Home videos of our private lives in 1080p Bluray (j/k).

  4. if your married and have the two year permanent resident card expires three years minus 90 days. then you can file to remove conditions do not file the 1-751 to remove conditions before that date or your file will be returned to you.i don't know your expire date but when you file the 1-751 the most two weeks to get a noa-1 receipt letter that will say you have a one year extension on your green card, you can use that letter to travel,DO NOT GO OUTSIDE OF THE UNITED STATES WITH OUT YOUR GREEN CARD, OR THE EXTENSION LETTER, OR YOU WON'T GET BACK IN.

    thx for the reply. here is the situation. my wife's green card expires on 12/14/2011, so we can file 90 days before which is now. my question is can we file now before she goes abroad since she is going to return before 12/14/2011. the I751 only asks for a copy of the green card, so she should be able to leave and return to the US.

    Another option is just hold off on filing I751 and wait for her to get back before sending it in. She plans on coming back 12/02/2011. Which is 2weeks before green card expiration date. We are not sure if that's cutting it close.

  5. Guys, we are about to send off our I-485 packet. In the Visa Journey guide, it states a copy of I-94, but on the official USCIS I-485 Instruction pdf file it says:

    "Attach a copy of the fiance(e) petition approval notice, a copy of your marriage certificate, and your Form I-94." (not a "copy of Form I-94")

    So should we send the original I-94 stapled in my now wife's passport or a copy of it?

  6. Guys, we can't get our official wedding ceremony before the expiration of I94. From what I understand, we can just go the the district clerk and get marriage license and have him/her sign the license with a witness to obtain the marriage certificate right? Also I'm not sure what my fiancee needs to bring. Passport, birth certificate and I94?

  7. So we are in a difficult situation because my fiancee has lived in Germany since 1992 but went to Beijing and did 4 years of high school at a German international high school. Now our 129F is approved, and files have been sent to Frankfurt, the only thing we are missing is the Police Certificate for those years she was in China. Unfortunately, her whole family is in Europe, to get the Police Certificate, she has to fly to China just for that.

    Anyone knows how strict are the embassy about the Police Certificate? It almost seem unreasonable for her to fly to China just for that when she lived in Germany for so long. If this an absolute requirement, has people found ways to obtain it without traveling? Thanks

  8. Guys, here is our timeline.

    09/12/08: I129f sent.

    09/15/08: check deposited as evident by the receipt # on the back of the check scanned in my bank account.

    Nothing so far as today. Not even a NOA1 or anything. Checked status on the USCIS website says following:

    "On September 15, 2008, we received this I129F PETITION FOR FIANCE(E), and mailed you a notice describing how we will process your case. Please follow any instructions on this notice. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service. We process cases in the order we receive them. You can use our processing dates to estimate when yours will be done. This case is at our VERMONT SERVICE CENTER location. Follow the link below to check processing dates. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register."

    According to this they should've mailed out NOA1 back in Sept, but I never got anything in mail. Wondering if this has happened to others?

    Thx for the reply, I guess there is no good answer to this. Also for those who have went through this. Is it common to not get an NOA1 in the mail? I never got one, but my bank shows the check was cashed, and the back was stamped by US service center.

  11. Question: my fiancee's Chinese on German visa. She's finishing school in Heidelberg most likely be done with Germany by the time interview comes along. We prefer to have her stay with her parents who are in Austria and interview in Vienna. Can we put US embassy in Vienna for interview location on the I-129F or are there limitations to where you can interview?

    Can she show legal residency in Austria? I ask because the consulate who has jurisdiction would be her native country or country of current legal residence.....

    She is not legal resident of Austria because she's on Germany visa, so I guess the answer is she has to get it done in Germany. Unless all European Union countries are all consider legal.

    My fiancee and I are about to send out the package. We have some final questions.

    1. Do we need to both sign the Cover Sheet? She already left the US. We signed most of the papers when she was here two weeks ago, but I had to make corrections to the Cover Sheet.

    2. For evidence of ongoing relationship, we are planning to submit 10 good quality photos, copies of our passports showing traveling between Germany and USA. I am still debating if I should include cell phone bills. I don't feel it can add any strength to the photos and passport copies. Please give opinions.

    3. Any additional pitfalls we should be in look out for?

    Words mean things and this is a process that will highlight that fact at every turn.

    The USC petitioner would sign any cover sheet. It's their petition.

    You've not been asked for evidence of an ongoing relationship yet. You've been asked to provide primary evidence of meeting in person during the past two years. Unless you have obvious red flags to address, leave out evidence of ongoing relationship and concentrate on primary evidence of meeting, like boarding passes and passport stamps.

    Use the Guides and Examples provided here.

    Thanks for all the input. We are not very good about keeping boarding passes, but we have all the passports. I photocopied all of our passports hopefully that will be enough.

    Assume she gets the visa, should we wait until after her visit completes before send out the I-129 or we can do it during the visit.

    She hasn't done the interview for her visitor visa yet. We were wondering if she tells the consulate that she's visiting fiance, is the consulate going to say why not just wait for the fiancee visa instead of visiting now.

    Definitely. That's what happened to me. I wanted to come over for Christmas and the consulate told me I should wait for I-129F to be approved and my K-1 issued before I can go. Even though (being Ukrainian) I was working in Indonesia and had a contract indicating my expat wages to prove it. They said definitely "no" because I was in the middle of K-1 process.

    Also, when Michael and I were just dating back in the Ukraine (well before we filed for K-1), I applied for a visitor's visa and they said "no", part of the reason was (of course) me being eastern european (they didn't say that, I know for a fact), and the consular officer said "well, he's your fiance, you're gonna marry him, why don't you file for K-1 instead. sorry, we can't give you a B visa".

    Depending on which country she's from, age and occupation, she might get a visa. From personal experience, as soon as you mention "fiance/fiancee" nature of your relationship, as they automatically assume you're trying to get around the system and get married while she's in the states on her visitor's visa (there is a guestion on the application form even). Thereagain, my husband and I chose not to fool around with U.S. Immigration and be totally honest about everything, and so we did. It's paying off eventually we would like to believe.

    Give it a shot if you don't care about losing a $100 for the interview, but definitely before you file I-129F.

    So when she's going for visitor visa interview, should she say she's just visiting the states for vacation and visiting friends instead of saying visiting fiance. She will come back, and we will file I-129F after she leaves.
