    Hi,

    Is your sponsor's (your US citizen wife) income greater than 125% of the poverty guideline requirement? I'm an F-1 visa holder and my husband is a US citizen. Reading the I-864 instructions it doesnt seem like I need to inlcude my own income info and documents.

    We're sending ours next week so I would appreciate any info. Thanks!

    Elli

    No, Her salary is $500 less than 125% of the poverty guideline requirement. That is why we included $25000 cash savings and my income as well.

  2. Hi Everybody,

    we got and RFIE on I-864. It asked for two items.

    1. For the intended immigrants income to be included in the household income it must be from a lawful source. And they asked for its prood.

    2. The complete tax return of the sponsor/petitioner for the most recent year.

    This is the set of documents we had originally included in the I-864 form:

    1.     Completed and signed form I-864;

    2.     Form G-1145 e-Notification of Application/Petition Acceptance

    3.     Information about the Sponsor:

    a.     Copy of Sponsor’s birth certificate

    b.     Copy of Sponsor’s US passport

    c.     Sponsors Tax Transcripts for 2016;

    d.     Letter of Employment in University until 2019;

    e.     Investment account statement with the value of about 25,000$;

    f.      Copy of Paychecks of the petitioner for the past 6 months;

    4.     Information about the immigrant:

    a.     Immigrant’s Letter of enrollment in the PhD program;

    b.     Current I-20 attached;

    c.     Paycheck information of the immigrant for the past 6 months;

    d.     Immigrants tax W-2 forms for 2016 and 2015;

    e.     Immigrant’s Job offer from XXXXX

    I sent the following documents:

    1.     Evidence to show that the intended Immigrant was authorized to work

    Documents attached:

    a.     Copy of valid I-94 form;

    b.     Copy beneficiary’s F-1 visa and the entry stamp;

    c.     Copy of Current I-20;

    d.     Immigrant’s Letter of enrolment in the PhD program in University;

    e.     Beneficiary’s W-2 form for 2015

    f.      Beneficiary’s W-2 form for 2016

    g.     Beneficiary’s Form 1040 for 2015

    h.     Beneficiary’s Form 1040 for 2016

    2.     Petitioner’s Complete Federal Income Tax return

    Documents attached:

    a.     Petitioner’s W-2 Form for 2016

    b.     Petitioner’s W-2 Form for 2015

    c.     Petitioner’s Form 1040A for 2016

    d.     Petitioner’s Form 1040EZ for year 2015

    My Questions:

    1. I think the reason they asked for the tax documents of the most recent year is because the 2016 tax season has not ended yet and the most recent tax year is 2015. So I sent 2015's tax documents as well. But do we have to also resubmit a new I-864 form? Since the income was different in 2015 than 2016 and hence the numbers in I-864 would be also different?

    2. Are the documents that I have included, the correct response to the above request?

    3. If these documents are the correct set, will they deny our case or will they just send us another letter and want the missing documents?

    4. Does this process delay EAD time? as I am waiting to get EAD and start my job.

    Best,

  3. Dear Friends,

    I have put this cover letter and the documents to submit to USCIS. I am a student on F-1 and my wife is a US citizen. I would appreciate if you could check it out and let me know I am missing anything.

  4. Hi All,

    My wife and I are both PhD students in US. My wife is a US citizen and she is petitioning for my green card application. Her income is 1000$ short of the poverty line for the family of size two (she is a PhD student). However I read the following lines in the instructions.

    If you included the income of the intending immigrant who is your spouse (he or she would be counted in Part 5., Item Number 1.), you must provide evidence that his/her income will continue from the current source after obtaining lawful permanent resident status, and the intending immigrant must provide evidence that he or she is living in your residence. He or she does not need to complete Form I-864A unless he or she has accompanying children.

    As I understand, since I am the only immigrant without any children and already living in the same household together, our combined income can be used to determine the poverty line. And, I do not need to fill the I-864A form.

    Question 1: I would appreciate if someone verifies that my understanding of the statement is correct.

    Question 2: I am about to graduate this summer. Therefore, the department cannot issue a letter that I would remain a student for the next year. However, already have job offers with six figure salary and I have attached it to the documents. Do you think that would be enough to demonstrate the case?

    Thank you all

    1. Yes. IOs seem to want documents with both your names on it. So things like bank accounts, lease, bills and such would be good evidence. My IO almost denied my application because he saw that we submitted 2 different addresses for the I-130 and I-485. He kept asking why we didn't live together. It will be on YOU to show on paper why the heck you guys aren't living together. It has to be painstakingly obvious. Personally I'd just wait to file until you guys had moved into a new place together and make it easier on yourselves.

    Thank you very much guys!  We can add her to my insurance and also open a mutual bank account and try to get a lease for next year together as soon as possible. Also, I read somewhere that we can get letters from her parents, and uncles and some friends (True?). Do we have to wait or I can use them as evidence as soon as we open them?

    2. I don't think you're eligible for OPT if you marry and have an adjustment of status pending. But the good news is that ~90 days after your application you will have work authorization (by applying for the I-765 along with the I-485 and I-130).

    Does this mean that three months after filing the application I Can work? Even before hearing back about the approcal/denial of the application? What if I start working and then later on the application is denied?

    And a whole new question, I NEED A LAWYER. I need someone with experience of doing this process for students. How can I find them?

  6. Hi Everyone,

    I am a last year PhD student on F1 VISA in a top school and program. My girlfriend is American, also a PhD student in the same school. We have been dating about a year. We are planning to get a courthouse marriage soon and then send the documents so that I can get my green card. But we are planning to have our wedding later this year after we graduate. I have a couple of questions:

    1. Would we have a problem regarding proofing our marriage as bona-fide given that we do not have any joint bank accounts or the same address yet (she practically lives in my apartment but she still has her own too. We are getting a new place in august when our leases end). We have traveled a lot together though and even twice to her home town. I have met all her family and there is a tone of photos and plane tickets. Do you recommend we go and open mutual bank accounts and credit cards now?

    2. How long should we wait after courthouse marriage to send our documents? Is it necessary to wait at all?

    3. Given that I am graduating in the end of summer (in 7 months), if we send the AOS, would I still be able to get OPT? What is the best course of actions for me? Do you recommend waiting and first get my OPT and then get married?

    4. Does she have to financially sponsor me? Currently we are both students and have full scholarships from university with waived tuition and monthly stipend. I would definitely get a job with six figure salary after I graduate.

    PS1: I am not going to travel outside of country because my F1 visa is single entry. So, there is no worries about doing any visa fraud case.

    PS2: I am a citizen of Iran. Do you have any experience with this?

    Thank you very much

    A poor student!
