    I am US Resident married to US Citizen. My son is 16 years old, lives in Peru, and we want to bring him to USA. My US husband would act as the Petitioner.

    I know that my husband have to fill out a I-130 form. For the specific case of my son, I think I can submit together the I-130 plus the I-485 plus the work and travel authorization.

    I have these questions:

    1) How long it would take from the day we send the I-130 form to USCIS up to the approval of it?

    2) What is the type / name of Visa he would receive?

    3) After the US Embassy in Peru issue the correspondent visa, what is the period of time that he would have to enter to USA?

    4) Is it true that I can summit the I-130 plus I-485 together? And he needs to ask for work authorization and travel parole? (He wants to work in US).

    Your husband submits the I-130 petition for your son who would eventually be issued a CR2 or IR2 visa depending on whether you and your husband have your second wedding anniversary before or after the visa is issued. Your son would then arrive qualified for a green card and able to work immediately. There is no need to adjust his status. He comes as a legal resident from day one.

    I would think in terms of one year from petition filing to visa issuance.

    Thank you very much for your answer. I got married in USA on July 2006, and my son wants to be in USA around January 2008, so I guess this is the IR2 visa right? This is case is not a K4 visa type right?

    We will be filing our AOS and EAD within the next two months. If anyone has any lessons learned from your case, please share your experiece(s).

    NOTE: We do not have any specific questions. The directions/requirements are straight forward.

    Hi Ahmari, I just received my Green Card by post yesterday and I submmited my AOS I485 on November 8th, at same time that my travel and work authorization request.

    I did all my paperwork myself with the recommendations I saw here and I read on the I485 form.

    I did everything very in order, with cover letter detailing the documents attached, and dated and signed.

    My birth Certificate and divorce papers had Official Translation to the English. I send the checks together with my file, and in the envelope I typed a reference: AOS I-485, case #... Alien #......

    They asked me (again!!!!!!) for a Medical Examination and vaccinatios/ shots, and instead of claiming, I decided to pay for it and do it again, and to not complicate my life and sent to them again this as per they requested.

    Read well the indications of the form I485 and of this forum AOS, and of the Notice of Action (also in the back).

    I did it so in order that not even had to go to an interview. Make your file a very easy file for the people working on Migration, they would realy appreciate it.

    About the Birth Certficate, they request the Big Format, I submitted big and short format of Birth and Divorce certificates (just in case), but I know somebody that submitted a short format of the Birth Certificate and they denied the papers and had to resummit everything again only for that, and they told that yet during the interview!!!!!.

    About lawyers, if you want to hire one, I recommend you that ok they do everything but YOU verify all before summiting nothing, and YOURSELF go to the post office and ask for a certfied mail/post so you receive a confirmation from the Post Office with the reception stamp of Migrations.

    Some lawyers forget to summit your papers, or the signatures, etc, I saw that, dont take risks.

    And do copy of ALL your papers before summiting them, and sign and date the Cover Letter where you detail the documents that you are sending.

  5. We applied several weeks ago for a social securtiy number for my husband. We recently received a letter stating that a SS# would not be issued to him at this moment because they found no evidence that he needed one right now. Do we need to have the EAD or green card before a SS# can be issued?

    Also, today we went to get my husband's drivers liscense. He passed the written portion last month and today we could get the actual liscense. We are having problems with his last name because it is De Freitas and on his K1 visa, the De was not put in front of Freitas. It was put behind his middle first and middle name and not carried to the above line and put in front of Freitas. The lady told us that she would put it into the computer into the "Safe system" which will approve the name or not. It was not approved therefore the approval must come from one of the USCIS offices which can take 5-7days. Is this a normal occurance? What do we do?

    I went to Soc. Sec. Office before being married with my Passport showing my K1 Visa, I94 and a Birth Certificate, and 1 week after I received my SSN by post to my house. Ask if they have somebody that speaks Spanish, in LA it is very common last names De ... Del... so that Spanish (Latin) person looking at your passport and Birth Certificate I guess she/he will do it for you. Not sure but dont lose trying.

    Then after married I went again with my marriage certificate for doing a new SSC with my married name.

    Thenk after I went for my Driver License, and a not nice woman screamed to us, because my passport and S SC had different names(single and married) and said that I can not get my driver license until I change my name in my passport :o so I simply "thank you very much lady" and I asked to other person there again the same, and this 2nd person was very nice and let me get my driver license which I received that same day. Sometimes it is about trying again with other person with more gains to help.

  6. Well they denied the Visa at the interview!!!! Reason: not enough documention proving we met before Aprii!!! We actually met in the summer of 2005 and provided 5 notarized affadvits stating so, plus phone bills, pictures from my recent trip to her country, diamond ring reciept etc etc etc. I can't believe this. My fiance saw me through a life threatening ilness at the begining of the year and a 5 month recovery and they question the validity of our relationship! I am beside myself.

    If you think that it was not fair and you realy gave to the embassy all what it was requested, contact your USA Senator (by phone) and complain with him/her, they can contact the USA embassy and ask for an explanation. It realy works.

    I have a very little question, I am for submiting my I485 for the AOS, about the translation from Spanish to English of my Birth Certificate, it must be done by a "Certfied Translator", or can I do the translation myself.

    I just called Migrations for asking and told me that can be done by any person, not some legal translation, but only want to be 100% sure.

    The other q., my husband name is the same as his father, so he use JR after his last name.

    Should I name him with his regular last name in the forms or should I include JR?

  8. My fiance is a Filipina living in S. Korea. She also lived in Japan for a six month period after the age of 16. I've read many places that she doesn't need a police certificate unless she stayed more than 12 months in another country other than the country she is residing, which would be six months.

    I read something on the Seoul consulate website that says this:

    Police certificates from countries where the beneficiary has resided after the age of 16;

    Now, I'm a little confused. We have an approved petition...has anyone dealt with this before or a situation similar? I don't want to get surprised by anything at her interview. Any help would be appreciated.

    Hi, I lived all my live in Peru but 4 months in Venezuela (I was older than 16 years age).

    I got my fiance visa and already married in USA, when I did my papers for the K1 Visa I mentioned that I lived also in Venezuela but never gave a Police Certificate from Venezuela, only from Peru, and it was ok.

    I HAVE THIS ISSUE. I ENTER TO USA WITH A K1 FIANCE VISA AND JUST GOT MARRIED TO A USA CITIZEN.

    MY KID ENTER USA WITH K2 VISA (ONLY ONE ENTRANCE TO USA), AND IS COMING BACK TO OUR COUNTRY (OUTSIDE USA) NEXT WEEK, HE PREFERS TO END HIGHSCHOOL BEFORE MOVING HERE, THAT IS IN 1 1/2 YEAR MORE.

    MY QUESTIONS:

    1) AFTER LEAVING USA, HOW HE CAN DO FOR COMING TO USA AS A VISITOR DURING THIS 1 1/2 YEAR?

    2) WHAT IS THE PROCESS I SHOULD DO FOR MOVE MY KID TO USA THEN AFTER (FOR BECOME RESIDENT)?

    I JUST GOT MARRIED SO YET FOR START MY PROCESS FOR RESIDENCE.
