    Hi there,

     

    I'm just wondering, what if I already got my NOA2 for my k1 visa application and apparently i need to cancel or withdraw it thru my fiance, will my B1/B2 visa gets cancelled already or will still remain active? Meaning, will my US tourist visa not get affected even if i decide to visit US anytime next year. I hope someone can enlighten me. Thanks in advance friends :)

    RFE's are not for using old forms as they would be rejected at the lockbox when they were first sent in.

     

    Lock-box Rejected forms for the following reasons when they first received them so 

     

    Case Rejected Because I Sent An Incorrect Fee
    Case Rejected Because The Version Of The Form I Sent Is No Longer Accepted
    Case Rejected For Form Not Signed And Incorrect Form Version
    Case Rejected For Incorrect Fee And Form Not Signed
    Case Rejected For Incorrect Fee, Payment Not Signed And Incorrect Form Version

     

    Normally RFE's are for Wrong passport photos size, Forgot to check a box or fill something on forms, asking for TOS  of website if met online,  previous Divorce decrees, etc.

    Alrighty! Thank you for clearing this out. Sorry i had no idea about this process. Declaring no RFE for all of us ;)

So its not like they are going through a particular date everyday. I am sure there are many 5/1 NOA1s that are still pending. This inefficiency baffles me

    Are they giving rfe to those who used the old forms or forms that has been expired last June 2017? Or might be something else. 

  4. Hi there. I'm a  May filer here, NO1 May12 for k1 visa. I just have a quick question, I'm planning to visit and surprise my fiancé in Cali. My history, i was on F1 visa before from Jan 2014 to oct 2015. And it didn't it expire until i get back to my home country. It got expired or withdrawn in dec 2015 by my school back then to which i didn't get ssn anymore or ead for ojt. Question is, can i still visit him regardless of the visa i got before? Or it will be going to be more difficult to pass thru the immigration officer or the border patrol at the POE once i flew there? I'm still holding a b1/b2 visa or tourist visa which expires in 2023. I'm planning to visit him this end of sept, we just had a huge fight and think that this might help. please shed some light, I am really confused and anxious to visit LA again :( Any suggestion or advise is greatly appreciated.

    Hi looking through your file, do you have to secure police clearance in the usa since you live there more than 6 mos? same case with mine since , I had been on F1 status for more than 6 mos, I am still confused if I should secure for a police clearance since it is part of the requirements to pass during the interview. what do you guys think?

Hi there again...so I was filling out our G325A form as the beneficiary, and in the section wherein you will provide the "Applicant's residence in last 5 years", shall I put the address where I stayed in the US while I was in a F1 status? I have stayed in LA for 1yr and 1/2. And also, in section "Applicant's employment in the last 5 years", shall I just declare I studied only and did not work, because there will be a 2 yrs time gap follwing my nxt wrk already here in my home country. If not, which form shall I declare then, that I had been under F1 visa previously? Appreciate your responses. Tia!

  8. Hi, anybody here experienced submitting a scanned G325A form and the Letter of Intent along with the I-129F packet to the USCIS? Will that be ok if I just email my filled out and signed form and letter to my fiance and he will just scan and include them with the other docs? Does anybody done that and will that be accepted by USCIS and just bring the originals upon the interview? Appreciate your responses. TIA

    USCIS advised that my fiancee does not change her name and goes ahead with renewing her passport in her married name so that all the documents match.  She can then change it here in the US after we get married.

    Hey Thanks so much for the info. I was thinking the same thing. I had my married name on my passport though we got annulled 2 years ago. its just that my passport has not expired yet. so its better not to have my passport name changed huh? will i get in trouble if i do that?

    Yeah its easy as it seems. However I called USCIS when I was still in the US, they told there would be no problem, maybe it will be at the POE, it will still be Immigration officer's discretion and depends on their mood lol...anybody experience this one? still confuse as I wouldn't want to be on a airport to airport status. anybody enlighten me please . TIA!

    I was once on a F1 status from Jan 2014 to Oct 2015. My class took only 9 months. But was unable to do my OPT(ojt afterschool) that would allow me to work legally for a couple of mos because I need to come back home in my home country. My question is, just wondering if I can come back to USA after my F1 expires? It's been 1 1/2 yrs past, would I be not allowed by immigration officials once I'm already at the POE of USA. I still have a 10 yr multiple entry Tourist visa (B1/B2) and would that be still active as well? or shall I need to secure another one. planning to visit again anytime soon. Please let me know what's the best thing to do. Appreciate your responses.TIA

    Theoretically your children can visit, but they may be turned away at the border for lack of ties to home (also, who will accompany them on the flight?).

    Still on the process of submitting my k1 visa application. Just wondering here if how the process goes and seeing other options. Of course, I want to get my children as early as possible after we processed the AOS. so my question here again is this, what's the best time or the earliest possible time for me to apply for K2? would it be good if I apply them same time as I apply for my AOS? Because, I won't be able to take them with me as the moment I fly to the US. Our initial plan is to get them after we get married.

    HI! Yes there were mentioned in i129f. But I was planning to get them after I process the AOS (after we get married thru K1) So was it K2 visa now?

    If your K-1 was issued within the last year, then your children can apply for K-2 visas.  K-2 visas can only be issued within one year of your K-1 issue date.  The children will need their own AOS in order to get green cards.  Your husband is the petitioner.

     

    If you file you as a green card holder, then it's two years for immigration visas for your children.  A bad choice.

     

    If your husband files for immigration visas for your children, it will take a year.

    NIce thank you for the infos. So if my k1 visa was issued aug 2016, so its still valid to apply for k2 until aug 2017? If also my children decide to pay me a visit, would they still be allowed to enter US, if they have a pending GC application? Was afraid they might not accepted thru the border, and will be send back home same day of their arrival in the US

  14. HI there! I just wanna ask, how long would the process take if I petition my 2 kids (under 10yo) after I get my Green card? I would probably get thru my fiancé visa status. And what do you call that corresponding visa for petitioning minor kids? They do have a tourist visa valid for 10 years, however would they still be allowed to enter US even during the processing? Please someone enlighten me. Appreciate your response :)
