The ban has currently been lifted, after a Federal Judge ruled that it was unconstitutional on the grounds that Trump is discriminating based on religion. People from these countries are temporarily allowed to enter, until a further judgement will be made in higher courts.
Best of luck!

Sorry that you have really bad experience in India. Its not about the country but the people as everywhere you find good and bad people. However, I think you should try to involve media (local news) here. They will get story and you will get freedom. In their presence Police also will work properly. If you like the idea, you can contact them and ask to come with Police:

How long has he been in Ireland for and is he Asylum case still pending?
Also are you aware of why he was unable to return to India? Is this going to be a reason for the US to potentially deny him?
There are a lot of questions for this thread I think...
I can imagine this is going to be complicated depending on what status he is at, his circumstances, your circumstances financially when coming to whether you have filed your taxes back in the US, whether he has a valid passport etc...
I normally don't recommend an immigration lawyer because they are costly for something that is quite simple but it doesn't sound like your case is the 'normal' type of case they see on a regular basis. Perhaps try and contact a lawyer and ask the question.
Yes, his asylum case is still pending and I am aware of the problem which stopped him to go back to his home country. Here is the main point, that we are in love and can't live apart from each other. Even though, it seems complicated but at the end I have to file K1 visa to bring him with me as I am being transferred to the US for my work.

You still need to file with the IRS. I said nothing about paying, simply filing. You still need to file: https://www.irs.gov/individuals/international-taxpayers/frequently-asked-questions-about-international-individual-tax-matters#GeneralFAQs
Thanks for you help. I will look straight into this.

Transborderwife is correct. You will have to resolve the US tax situation first. And apparently there is NO direct filing for Ireland.
I just skimmed through your other thread. You got some good advice there also. This will not be a quick and easy solution.
Are you talking about my fiance's asylum status? I still need to find out how I can begin my K1 visa journey :-)

Yes you can. I filed in December and also live overseas with my fiancé. You just need to show intent to move back together. You can search about domicile on VJ. Also if you have lived with him for more than six months overseas then you might want to consider DCF (if offered in your country) as it only takes 3 months or less.
How long are you living outside the US, and at what stage of the K1 visa process do you plan to move back?

Yes you are right, and I have that requirement to file taxes in the US, as long as the tax rate in US is higher than the country I am working in. If I am paying in another country, I need to pay the difference to the US.
However since the taxes in Ireland are far higher, I never needed to pay anything to the US

How are you going to work out the income requirement for sponsoring your fiance? Is it sufficient to be paying taxes in the country you are living in outside the US?

How does Direct Consular Filing work?

I may be wrong but I think Ireland no longer has direct counselor filing.
You will need to have domicile in the US. Have you been continuously filing taxes?
I am paying taxes here in Ireland. Over here taxes are paid by the employer before the employee receives their income, so our taxes are filed automatically :-)

Everything. If he doesn't have legal residency or status in Ireland he cannot be processed there. So his grounds for asylum are incredibly important
Are you saying that it may be possible for him to apply K1 here from Ireland, while the asylum case is still pending?

Do you know what you need to show to substantiate an Asylum claim?
The Consulate will make anything you see on here minor with their questions.
could you please restate your sentence in a clearer way? I don't understand what you mean. What does his asylum claim here have to do with the US?

Why is she seeking asylum?
At that time he had some problems which stopped him from being able to go home.

Cr1 might be better but you did not ak about that.
India is not a T Country so that is a positive, but will obviously raise a lot of questions with the Consulate as to how he could claim asylum and whether the K1 is just a clearer option.
So you could reasonably expect a longer process and lots of investigation.
What is a 'T country'?

I already mentioned his country in my opening statement

Apologies, I missed your question the first time. My fiance is originally from India, and is currently an asylum seeker living with me in Ireland.

1. No personal experience, but if he is currently legally resident in Ireland pending the asylum case, he should be able to have his medical and interview there.
2. It should not.
3. If you filed US taxes with the IRS, and since you can transfer within your company so financial sponsorship is not a problem, this should not be a major issue. You will need to prove that you will move back before or at the same time as your fiance; show transfer papers for work, evidence of having bought or rented a home, that sort of thing.
Anyone who makes an asylum application does not have legal status in that country until their asylum case is granted, after which they will gain legal status in that country as a refugee. Asylum cases in Ireland currently take between 5-10 years for the applicant to be granted refugee status here.

I am currently working for an American company here in Ireland, and I will be able to transfer to an American branch over there, when my fiance has got a visa to come. My income is well above the 100% and 125% poverty limits for the visa. We are currently living together, and I don't like the idea of living apart for the 5 months it will take to apply for K1. My family all live in the US and I think I will ask my Dad if I can put down his address for the form.
I don't believe joint sponsorship can be accepted for the fiance visa, as the affidavits of support for K1 are not legally binding in the same way as those for K3 applications.
What I am most interested in finding out is whether K1 applicants with a history of asylum in another country get accepted into the US. Has any heard of successful applications of this kind, or have you faced a similar situation?

My partner is an asylum seeker in Ireland and haven't got approved yet. . I want to apply K1 fiance visa for him. Please guys let me know that, is it possible for us to file our case here in Ireland while he is on asylum process, or he has to apply K1 from his own country. additionally, I am an US citizen and currently working in Ireland. I haven't lived in US since last 18 years. So basically my questions are as follows :-
1- Are we eligible to apply k1 in Ireland or we have to apply from his home country which is India ?
2- Will his asylum in Ireland impact our K1 visa application ?
3- Is it a problem that I haven't been living in US for long ?
Please guys help us out by giving suggestion as we are big confused at the moment that where to start. Thanks for everyone in advance
Which address should we post K1 packet?
in K-1 Fiance(e) Visa Case Filing and Progress Reports

Hi guys,
It sounds silly to ask, but which address should we post our k1 packet to if we are posting from abroad?
I plan to post with Express Post from Ireland, Would anyone have an idea whether this will be delivered via the USPS once it gets to America, or by some other courier?
Thanks very much for your help on this.
