I am after a tourist visa for an 8 day holiday (honeymoon) in May. I have seen so many forums on this site and others about weather to apply for a VISA or Esta if you have been arrested in the past. I have been arrested twice before. On both occasions i was not charged and cases closed. I received my police check which said "NO TRACE". Meaning i have no police record of these arrests. I thought great as i could apply for an esta instead of a tourist Visa. However i traveled to the US in 2012, and although i received a police check back then too which also said "NO TRACE" i still applied for a VISA and disclosed all the information regarding my 2 arrests to the interviewer, who later granted my application as i was never charged or convicted. My question now is that although my police check says "NO TRACE" should i apply for an ESTA as i have revealed my arrests to the embassy back in 2012?
Arrested no convictions. Visa or Esta but a unique situation!
