I am well over the 125% poverty level for 2005 and 2006, but I was a student with little income in 2004. Do I need to file with a joint sponser?

Strange but good news for me. My wife received her DS-3202 choice of agent form and case number from the NVC the same day as I found out online that we got our NOA2. The DS-3202 was sent on 6/11, our I-130 was approved on 6/25.
So I guess we are a few weeks ahead of where I thought we were...

I'm in the same situation, one idea:
If you are employed, and your employer offers some sort of life insurance, why don't you add your spouse to the coverage. In my case, once I told the company I was married, she automatically became covered. I'm requesting a hard copy of her coverage and will include that with my I-130.

But why do you want this info? If it is to wwork out whether you will be succesful you are missing out key questions.

In a few cases people have been turned away when trying to visit their spouse during the visa application process. The probability of entry while applying for an immigration visa will help us decide K3 vs. CR-1

Agreed, my statement was unclear. I was just trying to say that they should not explain their living apart in a way that could lead someone to beleive that they don't view their marriage as real marriage. I really don't know if one could explain this by religious beliefs. Out of my domain.

We are are doing (did) the same. We had a small civil ceremony a few weeks ago and will have a large wedding in Church this summer. I would just make sure that when it comes to visa related issues you maintain that you wanted to marry ASAP because of love and not for immigration reasons. Leave out explainations for not living together, i.e. anything that implies that you guys don't really view it as marriage.

...I-130 form has not her employment story...only G-325A...are you talking about that form? if so, she has to fill it not you...
I am talking about the G-325a's, one G-325A for my history, one for my wife's (I'm helping her complete it).

Another detail, but not less important, is that i have been adviced here not to let holes in the time of 5 years in this case, I would put still student and employement in a chronological order.
Thanks again. For completeness, and the fact she has had only a two part time jobs in the past 5 years I will include her eductional background. For that matter, I will do the same on mine, we are both pretty young...

I wouldn't worry about any complications with your visa based on how you file your taxes. The IRS does not care about immigration status and I assume the USCIS does not care about tax status. Because you were married in 2006, if you choose so you can treat your wife as a resident alien (as far as the IRS is concerned) and file your taxes jointly.
Just calculate your taxes married single vs married joint (unless you can claim head of household which is best) and see what is best for you.
In my case, my wife was a student in Germany this year, so filing joint married saved us a lot of $. Since she does not have a SSN, you will need to apply for a tax id number from the IRS. See fwaguy reference to the IRS document. Look under resident alien categories.
Bottom line, if your wife was working, it will probably be best to file as married-seperate.

ps - do you guys think it is a good idea to send my wife's translated birth cert. although it is not requested? I've seen a few people receive RFE for this.

Does my wife's G-352a sent with the I-130 need to be the original signed sheets or can they be copies?
Our problem is that paper is slightly larger in Germany, we don't want to upset anyone by sending a bulky package.

What if her employement history only dates back 3 years? Should I put student to cover all 5 years?

I got married on 12/28/06 in Germany, to a German national.
This means I must file my 2006 Income Tax as married, correct? (Regardless of her citzenship?)

Simple question:
On the DS-230, Part II Q. 29, the petioner is the US Citizen, not the immigrating spouse, correct? This is the I-130 terminology I'm used to.
