    Do you think it is ok to take our 15 month old son to the AOS interview? He is an American citizen, so he doesn't need to be there, but it is difficult for us to find a babysitter as we are based in San Fran but having our interview in LA.

    i'm a little concerned about going to our interview next week.2 months after my husband came here to work we married,though previously we talked online.we have a 2 1/2 month old and our marriage is bona fide,but i'm afriad they will question why we married so quickly.do you think bringing the baby will help.

    MY HUSBAND HAD POSTED THE MESSAGE ON THIS SITE.yES WE HAD TALKED ONLINE AND WERE ONLINE FRIENDS FOR ABOUT 2 YEARS,BUT WE HAD NO INTENT OF MARRIAGE WHEN HE CAME HERE.hE CAME HERE TO WORK AND INFACT i HAD BEEN DATING SOMEONE A MONTH OR TWO BEFORE HE CAME TO AMERICA.sO WHAT INTENT IF ANY DID MY HUSBAND OR i HAVE OF MARRIAGE?NONE.aS FAR AS MY DATING RELATIONSHIP WITH THE OTHER GUY THE RELATIONSHIP WAS NOT WORKING SO i STOPPED DATING HIM.wHEN MY HUSBAND DID COME HERE TO WORK ,hE HAD CALLED ME AND i HAD WENT TO SEE HIM AND TO HANGOUT,i HAD GONE BACK AND FORTH AND VISTED HIM A FEW WEEKENDS AND IN THE SHORT TIME WE HAD SPENT TOGETHER,WE HAD REALLY BONDED.i FELT IN MY HEART THAT I COULD SPEND THE REST OF MY LIFE WITH HIM,AND I ASKED HIM TO MARRY ME ABOUT 2 MONTHS AFTER HE ARRIVED IN AMERICA.SOME PEOPLE MAY SAY ITS CRAZY TO MARRY SOMEONE YOU JUST MET,BUT I WENT BY MY FEELINGS,pLUS i KNEW A GIRL WHO MARRIED A GUY AFTER ONE WEEK OF KNOWING EACH OTHER AND THEY ARE 5 YEARS LATER STILL HAPPILY MARRIED AND WITH KIDS.aLSO,AS FAR AS MY HUSBANDS H2B VISA,WE DIDN'T KNOW EACH OTHER IN PERSON, I CAN SEE IF IT WAS A FRIEND HE HAD GROWN UP WITH OR A FAMILY MEMBER,BUT THATS NOT THE CASE.

  3. If when you had your interview for the H-2B you already knew you were going to be moving in with your now wife and getting married and going to file for AOS so you could remain here, then you have committed visa fraud and I have no advice to offer...

    If on the other hand you did not plan to Marry and remain in the USA and file for AOS, the fact that you knew your now wife should not stop you from being approved at interview...

    What concerns me if the fact that you openly admit that you lied at your H-2B interview by saying you did not know anybody here in the US... a simple statement saying "I have a few friends I know from the internet, but I have never met them" would have covered that question...

    The question is ether you are going to continue your journey with a lie or you are going to be honest and truthful and hope for the best.... the consequences of continuing with a lie are great... if at anytime the lie is found out USCIS can revoke your status right up to and including Citizenship... They would say that your H-2B was invalid because you lied and therefore your AOS was based on entry using an invalid visa and you are not eligible for AOS, so it would be revoked and Citizenship would be denied because you would then not be eligible...

    Think very carefully about the way you want this to go....

Me and my wife meet online 3 years ago.I 2005 i came in US with H2-B visa.At the embassey when they ask me if i know anyone in the US or have any friends i said NO because i was afraid i wont get the VISA.We are now married about 1 year and a half and we have a new born baby 2 months old.We live toghether since i came in US and we share bank accounts and have lots of pics and evidence that we are a real couple.Soon we have to go to the AOS interview and i dont know what to tell them how we meet.Because if i say i lied when i got my VISA , they would say i came here with H-2B non-immigrant visa with the intend to emmigrate.Or should i say we meet here in US??? Technicaly we meet for the first time when i came here.Do they consider that knowing someone in the US id only talking online.Do they put alot of questions about how we meet at the interview? Thnak you!!!

My husband came in US with a H2B visa 2 years ago.When he got his H2B visa , he was asked if he know anyone in US or have any friends and he said no.Well we talk over the internet for about 3 years but he was scared to say that.We are married for about 1 year and a half and we have a 1 month baby togheter.My question is : Should we say the truth at the interview or should we say that we meet here in the US.If we say the truth we are scared that they will say he lied at his h2B visa interview and deport him.We apreciate any advice.Thanks

I am a us citizen and I am sponsoring my husband for AOS I-485 packet.I am stuck on the affidavid of support where they want the most recent tax year because i did not file for 2005 because the IRS told me I didnt need to because I didn't make enough money.I have a w-2 from my employer and we also have a joint sponsor since i didn't make enough money.Do i just give them a copy of my w-2 form and write a letter explaining that the IRS told me there was no need to file?Also,what box do i check?Since I did not file.

    1.I filed a single/seprate tax return for the most recent tax year.

    2.I am submitting documentation of my individual income(w-2 and 1099)

    Do I select any of those 2 questions or niether?

My husband and I are trying to finish the AOS packet to send to INS.We have been married almost 1 year and my husband has been out of status since november 30th 2005.I recieved a w-2 form for 2005 from my employer.But since i did not make enough money for 2005 the IRS told me there was no reason to file.Of,course we have a co-sponsor who is going to help us.Where it states:

    1.I filed a single/seperate tax return for the most recent tax year.

    2.I am submitting documentation of my individual income(w-2 or 1099).

    3.Do i Check none?

    (other options do not apply to me)

    I do have my w-2 for 2005 so I would assume that it would be choice 2.But since I am not 100% sure,I was hoping someone could help.

My wife didnt make enought money last year so she didnt sent her W2 to IRS.We have a joint sponsor but she have to fill a I-864 form too.At the C point when they ask how you fill the income tax there 5 checks and we dont know what to check.We found out that we need to send a letter and explain why she didnt sent her W2 to IRS but we also have to fill the form complete to avoid the risk of sending the papers back to us.Thats the only thing we need and we can send the papers.Thank you so much

    OK! A bit unclear who was posting, the wife or the husband!

    What was the reason for you not filing 1040 last year? Did you not earn enough to need to do it. It might help if you go ahead and file now anyway, then you can include a copy with your I-864. If not you need to include a letter explaining why you did not file for 2005.

    yes she didnt make enought money so she didnt send ...if we send a letter we still have to fill the form complete so we have to check something at that question

  10. I think you only need the contract between sponsor and household member if your co-sponsor is someone you live with and is family. Like your mother or father.

    Its difficult to answer the other questions because we don't know what type of visa, if any that you are adjusting from. Please let us know, and fill in your timeline so we've got more information to go from

    I came here with H2B visa last year in july 15 ,2005 thru november 30 ,2005 and i am out of status since november 30, 2005.We got married september 22, 2005 and we live in Ohio.My husband is from romania ,bucharest.

  11. Hi i am ready to send the package to INS and i have few questions.

    For the form I-864 we are using a joint sponsor because i didnt make enought money last year to sponsor my husband and i didnt send my W2 to IRS but i have the form.Well now at the point they ask in the form how you filled the income tax.What box should i check?

    For the joint sponsor do we need to fill just a form I-864 for him ...i ask that because the INS send us the package with some form called Contract between sponsor and household member.Do we need that Contract between sponsosr and household member???

    The last question is about I-30 ...at the 22nd question they ask about the office of immigration and naturalization service city and state.Should i put Cleveland Ohio??? because i live near cleveland ohio.

    At the same question number 22 they ask about city and country of american consular..should i put N/A or put my Country and city? Thank you so much guys and i am sorry for this long post.

  12. I am Out of status since August 2005 and now we are ready to send the papers.I have few Questions about those 2 forms.

    In form I-130 they ask me about Alien number.On my I-94 i didnt find any Alien number so i dont know if i should leave the field empty or put NONE or N/A.

    In form I-130 at 22nd point they ask about the city and state where i fill the papers.What should i put? the adress where i send the papers Nebraska, or Cleveland ,Ohio because i live in ohio.

    In form I-485 should i leave the field where they ask for Alien number empty or NONE or N/A and also sould i put Out of status when they ask My USCIS Staus in I-485? thank you so much!!!
