    I left the US at age 14. I was told in order for me to file CRBA for my child I had to live in the US for 5 years ..and from those 5 years 2 after the age of 14.My luck. So I had to file an i 130 form for him

Hi I am a US citizen currently living in Palestine, waiting for my husband's and sons paperwork to finish to go back and live in America. I recently filed a form i130 for my husband and and one for my son and they were approved. now I'm up to the NVC part and they are asking me to fill out affidavit of support for my husband and son .  do I fill out i864 or i864w for my 8 month old son? the exemption from i864 would be that..

    The intending immigrant is a child who will become a U.S. citizen upon entry under section 320 of the 
    Immigration and Nationality Act (INA). Under section 320, some children become U.S. citizens immediately 
    upon admission to the United States or adjustment of status to that of a lawful permanent resident (LPR). 
    A child becomes a citizen under section 320 if :
    A. At least one parent of the child is a U.S. citizen;
    B. The child is under 18 years of age;
    C. The child is residing in the United States in the legal and physical custody of the U.S. citizen parent after having 
    been lawfully admitted for .

     

    Now I am still abroad. do I file a i864w for him..C states that the child is residing in the US. But he is not in the US .He is with me here abroad waiting for his paperwork to finish.

     

    Please help me as this is a little confusing. Thank you
