  2. You will not have a problem with the ROC, when the time comes. From what you wrote, you have enough proof of a valid marriage, to remove conditions on your own. If you stay married, you still are a year away from removing the conditions, so I would advise you to continue to gather information proving the validity of the marriage. Do you or your husband have any life insurance? If so, gather a copy of the beneficiary designation. Same for any retirement plans from his job or yours.

    If you divorce, you can remove conditions as soon as you have the divorce documentation. Once again, should not be a problem. People do it all the time.

  5. It was certainly not my intention to insult you. And I never said that you got married for the green card. I said it was easy to infer that from your story and your comments.

    You’ve only been married for 2 months, and it’s already not going well. Yet, from your comments, you are basing your entire immigration future on trying to use your marriage for AOS, a marriage which isn’t working out. You need to develop a new plan.

    I have no idea what your original intentions were. If you say it was true love, so be it. But you’ve said yourself that if it wasn’t for your immigration problems, you wouldn’t have married so soon. And the timing reflects that the green card, while maybe not the main factor, was a great BIG factor in the timing of the marriage. 3 months ago you lose your H1-B job, 2 months ago you get married, and instantly after that you apply for AOS. USCIS always cast a skeptical eye, and the circumstance of your relationship as well as the timeline of this immigration journey is going to jump out at them as potentially fraudulent!

    You and others seem to imply that his parents are "meddling" and only out to interfere with your immigration plans. From what I’ve read, they are doing what they feel is in the best interest of their son. And that’s when I read it from your perspective! Who know what other information they are basing their actual decisions on!

    However much you may disagree, a 22 y.o. can (and should) still be able to realize that his parents have a little more worldly knowledge than him or her, and can still listen to their advice. And just because he listens and heeds that advice, doesn't make him "still a child", or immature!

    There’s nothing wrong with his parents explaining to their son the worst case scenario, and advising him. Just because they don’t bury their head in the sand and and blindly accept every choice their "adult" child make, does not make them "conservatives", over-bearing or controlling.

    As far as "Minya’s wife" is concerned, the title of the document is Affidavit of Support, and is binding for 10 years! How is calling it an "Affidavit of Support" misleading???

    While I’m sure the intentions fo the OP are to not ever need MTPB, she won't get AOS without her husband as the sponsor, and the document is binding on that sponsor for 10 years! No one ever intends to have bad luck, but it happens all the time. And if it comes down to it, the OP still needs to eat and live, and I'm sure will do whatever is needed.

    Now I’m insulted. I’ve never been called a "conservative" in my life! Don’t hang that label on me! :lol:

  6. I think you guys are a little hard on this 22 year old guy and his family. It’s easy to see how they could think that FD is just looking for a green card. The circumstances and her comments certainly could be viewed to point in that direction.

    And let’s not forget that for FD to get this green card, a 10 year Affidavit of Support has to be completed by her husband, and FD doesn’t even have a job, or any future prospects. So, his marrying her is more than just an act of love to help her stay in the US, it’s a ten-year commitment to support her. And even though FD never said what her “husband” did for a living, there’s a big chance that his parents might have to co-sponsor the affidavit of support, putting them on the hook for helping out their son’s new “wife”, as well.

    Some of the comments here make it sound like the husband’s family is being unreasonable. IMO, they are just looking out for what’s best for their young, naïve (i.e., first love / older woman), son which is what every family should be doing.

    The OP should be trying to find another way to rectify her immigration status, as opposed to playing this game of “GOTCHA” with her “husband” and his family. USCIS will see right through this at the AOS interview.

  7. You have not worked at all during the marriage. Normally, I'd be against the woman since she hasn't contributed anything financially and now wants half of everything (that he worked for), plus alimony. The divorce laws and divorce judges are so biased towards women that it's sickening.

    But in this case, the guy sounds like a real scumbag and I hope you take him for everything you can because he's obviously trying to use her lack of knowledge of the divorce system against her.

    Btw, if he doesn't want you to get a job... it's not because it will affect your alimony but because if you can't show that you are able to support your daughter then he will get full custody and won't have to pay you child support.

    Like others have said, talk to a lawyer, most don't charge for the initial consultation and will work on contingency. They will take a chunk of you get or ask the court to make him pay lawyer fees.

    You need to also get a job and a good place to live if you want any chance for custody of your daughter. No judge will award you custody if you can't feed or provide a house for your daughter.

    I agree with you 100%, KidB, the divorce laws seem biased toward the woman, but in this case, it seems justified.

    Usually, I agree that there are 2 sides to every story, but if the husband's actions in this case are half true, it doesn't matter what his side of the story is. It's obvious he is taking advantage of this lady.

    Trinity, it's been said many times in this post, and you need to take the advice. First thing tomorrow (if not today) TALK TO A DIVORCE ATTORNEY. That is the only way you will find out what you need to know to secure custody of your child, as well as what you are entitled to under the law in a divorce/separation.

    Your husband DOES NOT have your best interests in mind, and you need to protect yourself. He is lying to you about what will happen in a divorce, and you need to find out the truth. DO NOT tell him you are talking to a attorney, just go talk to one. And don't worry about the money, in a situation such as this, most likely, your husband will end up paying for your attorney as well.

    I hope you take the advice given to you, before it is too late, and you are put in a position you cannot recover from.

    BTW, where did you stay when your husband threw you out? Do you have friends that you can go to if it happens again? Please protect yourself NOW!

  8. Well, I have to say I disagree completely. I am very sorry to read that your relationship broke down so quickly after he arrived here. My advice is contrary to all of the prior posts which say “forget him and move on with your life”. I think if you are both willing, and if you still believe the relationship can be salvaged, you should try to open up a line of communication with your (ex?) fiancé. If you sincerely believed that this was the love of your life, than you owe it to yourself not to give up so easily.

    To give up after one week and one major argument, after all the time, money, and effort was spent in getting him over here, especially when it is common (and expected) that there is going to be an adjustment period for the new immigrant (which usually lasts a lot longer than a week), well let’s just say, it seems like a “heat of passion and the moment” decision on both of your parts.

    Everyone has their own expectations of their partner, and what is deemed appropriate vs. inappropriate behavior, but basically from what I read, you got extremely upset about him “surfing the net” while you were at work. Obviously, I don’t know the details, but I can imagine that there is not a whole lot for him to do, 3 days after arriving into a whole new life for him, and if during the extreme boredom that he may have been feeling, all he did was look at some inappropriate websites, it doesn’t sound like the type of thing to throw the entire relationship away on, IMHO.

    There is no way to have him come back over on that K1 Visa, so you will have to start the process all over again. Maybe, this will give you both a chance to openly discuss your differences and expectations of one another, and maybe be better prepared for the next round. Or not. At least, if it doesn’t succeed, you’ll know that you’ve given it your best effort, which I don’t think you can truly say that now.

  9. My wife’s AOS interview was successful, and her petition was approved by the interviewing officer on Wednesday. :dance::dance:

    Here is our interview experience.

    We arrived at the Los Angeles USCIS office around 10:45am for our scheduled 11:05am appointment. The guard asked us if we had a cell phone, but I told him I had left it in the car. I remember reading somewhere that they didn’t allow cell phones, but I can’t remember now where I read that. Anyway, many people brought their cell phones in with them, one guy even had his on his belt in plain site. But the guard was very strict, as while we were waiting, he approached several people who were using their phones, and very sternly (and loudly) told them that they could not use their phones inside the waiting area, and if they needed to do so they would have to step out. He was a little annoyed when talking to these people, because earlier he had made several public announcements about not using the cell phone, and these people must have thought his announcements applied to everyone else but them. :whistle:

    Anyway, we watched everyone who had come in before us (and what seemed like a few people who came in after us :angry: ), get their names called and follow their interviewer into the interview office area in the back. About 12:15pm, my wife’s name was called and we followed our interviewer into his office.

    Before we sat down, he swore us in. Then he opened up the paperwork, and started asking Shiela questions, silently and unmistakably making me aware that the questions were to be answered by Shiela and not me.

    The questions were very basic:

    - What is your address?

    - What date did you enter the US?

    - What date did you get married?

    - Where and how did you meet your husband?

    - Are you a terrorist? (and several, but not all, of the other “NO” questions in the I485 application.)

    Some of the questions he checked off without asking because he knew the answer. For example, he asked Shiela if she remembered Ferdinand and Imelda Marcos, and then joked about it with us, because he knew that she was too young to even remember when they were exiled.

    He was very disarming, chatty, and made us feel very comfortable. Then he asked to see:

    - Shiela’s birth certificate,

    - My birth certificate

    - Shiela’s social security card,

    - our marriage certificate.

    - Shiela’s EAD and AP documents

    - Shiela’s I-94

    - (I don’t remember everything he asked for, but nothing unexpected. Everything he asked for was included on the

    interview letter.)

    He was very pleased that I had made copies of everything that he needed, and that he did not have to make copies himself. Then he said to me, “OK, show me your proof of valid marriage documents”.

    I thought I was a little light with that, but he had no problems with what I showed him. I gave him:

    - old bank statements and voided/canceled checks with both our names,

    - credit cards in both our names,

    - my company health plan insurance cards for Shiela and I,

    - my beneficiary designation forms for my 401K, life insurance, and pension plans

    - Airline boarding passes for trips we took within the US to visit family and friends.

    Once again he was very pleased that I had copies of everything. He took copies of everything I gave him and put them in our file.

    Then he asked to see our wedding photos, and thumbed through our photo album which we brought with us. He made little jokes about some of the pictures, and asked questions about some of the people in the photos.

    After that he spent time just reviewing the file, writing a bunch of stuff down, all the while, making light conversation with us.

    Then, he told us he was approving the petition, and then he gave what sounded like a standard speech... “Pursuant to Article…yada, yada, yada… I approve your petition for Lawful Permanent Residence, etc., etc.. “

    Then he printed a letter describing the conditional permanent residence, and made us sign it to state that we understood we’d have to lift conditions 90 days before it expires. Next he printed off a “Welcome” letter, went over the contents of the letter with us, verified our mailing address, explained that he was keeping the EAD and AP documents, and sent us on our way.

    To be honest, we were VERY nervous before the interview, sitting in the waiting area, but afterwards we both thought that the inerview went by very fast. The total time we spent in the interviewer’s office was about 35 minutes.

    I guess we were lucky to get such a nice interviewing officer, I’ve heard that others weren’t so lucky. It’s completely luck of the draw.

    Yesterday morning, I received several emails from CRIS saying “Card Production Ordered” and "Notice mailed welcoming the new permanent resident".

    I just want to shout out a “Big Thanks!” to all of you VJers for your help answering questions and sharing your experiences in navigating this process.

  10. I'm going to be there around 8 weeks before I actuallt get married.

    When Shiela came into the US, I had the same issue. I found a international travel medical insurance website (I'm sure there are several of them if you look around). The insurance was a major-medical policy, and not too expensive.

    we only needed the insurance until our marriage, when my company health plan took over. If you only need it for a few weeks, and hopefully just for peace of mind, you should take a look at it.

    If this one doesn't suit your needs, you should look around on the internet. There are several options out there.

  12. what valid reason can i put for AP? i need to apply bec i came here on a tourist visa and i dont have my personal legal documents which i might need for my AOS interview and i am thinking the AP will help me with my problem. i need to go back to my home country and get the original copies of these documents.

    also when filing for AP it says i need to print a one page letter explaining why i need to travel. do i have to have that document notarized as well? or do i just sign and date it?

    Just tell them what you just told us. That sounds like a perfectly valid reason.

    No the document does not need to be notarized, simply signed and dated.

A student who has been entirely self-supporting and actually present in California for more than one year immediately preceding the residence determination date, with the intention of acquiring a residence therein, shall be entitled to resident classification until he or she has resided in the state the minimum time necessary to become a resident.

    Then what Sarah and Hicham (sp?) is saying would be in line with that ... green card application date would be the date you show intent to reside in CA. Not sure if you could find a way around it, it just makes what Sarah and Hicham is saying make sense.

    It has nothing to do with the immigration status of your wife. It has to do with how long she has been a resident of California.

    My wife came into the country in May, and lives with me in my house in California. She is attending Junior college as a non-resident, because she has been in the country less than a year. The residency requirements as they pertain to schools are that she has to be a resident for one full year and one day, prior to the school term that she is applying for. So, when she applies for the Summer 2008 semester, she will be a California resident.

    If your wife can prove residency/domicile for one year prior to the residence determination date of the school she is applying (which should be the same across academic institutions), then she will pay CA resident tuition rates.

  14. Hi, we got married last October 26 and went to the local Social Security office last November 6 to get a number. I used my married name in the application form and showed our marriage certificate but the officer said immigration website is not yet updated so they can only issue me a card under my maiden name. I thought it was the usual "delay" in the immigration process so we didn't complain. Two weeks later i got the SS card with my maiden name.

    We went back again yesterday hoping to finally have it changed to my married name but the male officer said the same thing. He said that the immigration website bears only my maiden name and they can only issue me a card under my married name if the website updates it. He said that to do this, i have to file AOS and get a green card. That's the only time they can change my name.

    I'm confused. My I-94 will expire this January and we're hoping to send the AOS package by next week. How come it was so easy for other people to secure their SS numbers using their married name? Some even applied for SSN a day after they got married and never had a problem. In my case, they will only issue me a number under my married name IF and only IF i get a green card.

    So i guess the VJ guide for securing SSN is not applicable to all, huh?

    Hi Tigbok. You should have been able to get the SSN in your married name, but now it is too late. Unfortunately, you got caught in the US government bureaucracy where not every employee is knowledgeable about the rules they are supposed to be enforcing.

    I understand the desire to have your SSN card in your married name. It is one of the first documents that you can use to begin your new married life, and as such, is very important to some people.

    We had a similar problem, We went to one SSN office, and the clerk told us the same story. I KNEW that was not true, and asked to speak to the supervisor, who said the same thing. Then the supervisor printed me off the 1st page of the SS policy page and gave it to me as if that should shut me up. I also had read the policy, and the rules are very clear that there is no problem for a K1 to get the SSN in their married name, but the wording for that is like on page 3. And unfortunately that day, I left my highlighted copy of the the complete policy AT HOME! So, all I could do was tell the SS Office staff how incompetent they were, and leave. Before I left, I got the address of next closest SS Office, and we went there the next day. The clerk there gave me another BS story about how he could not give my wife the SSN in her married name, but this time when I spoke to the supervisor, he explained everything to the clerk, and then we were issued the card in my wife's married name. The VJ guide does explain that you may run into problems, and it also suggests that you take the policy with you when you go to the SS Office.

    The problem you have now is that your I-94 expires in less than 30 days, and the computer actually locks out any entries into their system, when the I-94 is due to expire soon. But I would imagine that your SSN has wording similar to "Not Authorized to work without DHS authorization". This means, you will have to wait until you get the EAD before you can apply for another card. The new card will have your married name, and not have any restrictions on it. Just make sure you apply for the GC and EAD IN YOUR MARRIED NAME[

    The good news is, the SSN you have will never change, so you can use it just as if it is in your married name. Bank accounts, insurance, credit cards, you can apply for all of these using your new SSN, so not having the actual card in your married name yet, is not that important, except for your own piece of mind.

  15. I don't know that leaving out the "U.S." was such a big deal. So, I don't think there is anything obvious about why the application packet was returned.

    Nervously Waiting, I have no helpful suggestions as to why your packet has been returned (and divided) but I hope you get an answer soon. And now I have something else to be nervous about. :crying:

    No, you don't know. And I admit, I don't know for sure either. I do know that the instructions are awfully explicit on how to file the package, and how to set up the payee. The I-485 instructions also explicitly state the following...

    NOTE: Please spell out U.S. Department of Homeland Security; do not use the initials "USDHS" or "DHS."

    If you could put it down any old way, they would not have been so explicit on how to set up the payee. And why take the chance? How hard is it to follow the directions as they have stated them? Then, situations like this don't arise where you have no idea which of the instructions you got wrong.

    Everyone makes mistakes. Even the folks at USCIS. But the OP has a lot of anger about the incompetence of the USCIS, when he/she themselves have made a few blunders too.

    My "suggestion" is to follow the instructions to the letter and you'll be fine. If you do that, you will have very little to be nervous about.

  16. The check amount is incorrect or has not been provided. The correct filing fee is $340.00. Please resubmit the application/petition with the appropriate fees to the address listedo on the bottom of this notice. There was no check on this packet. We sent one check for all of it.

    Could it be that I did not put "U.S." Department of Homeland Security Citizenship and Immigration Service. I swear the directions said to put "Department of Homeland Security." And the brainiacs at USCIS said I could write one check with $1010.00 on it.

    This reads as if you sent two separate packets, one for EAD, and one for AOS. If that is the case, than it is fairly obvious why the packet was returned. When filing the AOS/EAD, they need to be filed in one big package, so that it is clear that they are together.

    The other question I have is, Why did you leave off the "U.S" on the check? The directions are QUITE clear on who to make the check payable to, even going so far as to put the payee in bold type. There really was not much room there for misinterpretation.

    Even if you did include the AOS/EAD in one package, which it doesn't appear clear that you did, By not writing the check correctly, it seems obvious why your package was denied and returned to you.

    You should just re-file the packages, and this time follow the directions exactly.

  17. the rej. notice on the 485: "Your application package was submitted with a single remittance and one or more of the applications/petitions were unacceptable in the package for the reason(s) specified on the related Notice(s) of action(Form I-797). Please correct the flawed application(s)/petition(s), and resubmit the application package with the appropriate fees ans supporting documents to the address listed on the bottom of this notice." The rejection notice does not state that the check was wrong. I'm not sure what is means.

    It does not specify that the fee was wrong, just that I need to correct something and resubmit.

    The rejection notice on the 131 was self explanitory. They wouldn't reject the 485 just because the 131 had an error, would they?

    rej. notice on the 765...repeated what the 485 rej. notice said - then something about the fees which just seems to agree with what I know about the filing fee - if doing 485, 131, and 765 concurrently there is not extra fee - just does not tell me what the problem is. I think for the 765 and 131, one problem is that the check was not cashed so they couldn't be paid for...or they won't file these if the 485 is rejected. Which brings me back to the 485 rej. notice.

    The "submitted with a single remittance" paragraph, sounds like a cut and paste. Is it the "single remittance" (one check for aos and biometrics, $1010) that is the problem, or is it just a statment indicating they saw the check and it's all because of the 131?

    No rejection notice on the 864, which seems like good news to me.

    Another curiousity (to me) is the extra passport style pic. I only sent two. Now there are three.

    Do I have to print out all the complete forms again, or do they accept the forms I sent the first time, with the stuff printed up the side?

    Will the receipt numbers stay the same when they do accept the package, or do those change when they send approval?

    It's too late to call. I will call them tomorrow, assuming someone hasn't answered here.

    Wow! A lot of questions, and also a little confusing... But let me answer what I can, based on my understanding of your problem...

    1. One check is fine. You do not need two separate checks. That is not the problem.

    2. Why did you only send 2 photos? That is definitely a problem. You need to send 2 for the I485, 2 for the I131, and 2 for the I765.

    3. You say that the problem on the I131 is self-explanatory. I couldn't figure out what that means, but if you are filing all three applications together, and there is a big enough error on one of the applications that makes it unacceptable to process, then they would most likely not process any of the package, which looks like what they did.

    4. Remember that these forms are probably processed via computer. I don't know what stuff you printed up the side, but that might also cause the forms to be unacceptable.

    Good luck. I would resubmit each application and ALL supporting documents together again, correcting the mistakes of course, and include the I-797 forms that you were sent as a reference. It sounded like they did not return the check also, so the I797s will give them the reference number to tie to the check.

    I think we all understand that SHE is the USC. What we are saying is that she can go ahead and start using her married name at any time. The AOS is for you, not her. Therefore, the changing of the USC's name will not cause any problems at all.

    As long as the marriage certificate is included in your AOS package, USCIS will understand quite clearly the use of the two names on any documentation she needs to provide.

    This is of course if her name change is to use your surname. If she wants to change her name to something completely different, that is a different story.

  20. Looks good, but I have a suggestion. Why don't you include the I-131 Application for Advanced Parole? It's cost is included in the $1010 fee, so it won't cost you any more money. Your wife may feel that she has no intentions to leave the USA before she gets her GC, but "sh*t happens" and you never really know how long it will take for her GC to arrive.

    I would recommend also completing an I-131 application and sending in the required documentation for that along with your I-485 application and I-765 application. And of course, including that extra information on your cover letter. :thumbs:

    Of course, but is it ok to buy round trip if I don't intend to use the first leg of the trip and only the return flight?

    If you buy a round trip ticket and do not use the first leg, the airlines cancel the reservation and do not allow you to use the second leg.

    If you want to pursue this option, better to buy a roundtrip ticket from MNL -> USA -> MNL, for your honeyko and then not use the SECOND leg of the ticket. Better yet, save the second leg, until your honeyko wants to return to the PI (if it is within one year of the original flight), and pay the airline change fee.

  22. We just came from there. Very interesting. Lots of Filipinos. and my wife got a little homesick when she saw all of the various Filipino foods being sold at the outside food court.

    Not much of an opportunity to actually network, and meet other Filipinos, if that's what you are looking for. But plenty of Filipinos there of course, with their friends and family, and plenty of booths to see, learn about, and/or buy some Fil-Am products and services.

    All in all, a very good way to pass the time on a lazy summer afternoon.

We met in December of 2004 and I can honestly state that she is my soulmate and I have never been so in love b4.     But I have to agree with you. I had given up on the thought of my getting married.

    Did she get the vaccination shots in Japan? If so, does she have a copy of her DS-3025 vaccination form? If so, she only has to go to a civil surgeon to get the information from the DS-3025 transferred to the I-693A vaccination supplement. Check out the EWOK pinned thread at the top of this forum for more information on that.

    Yes, you need to fill out the I-864 form. You filled out the I-134 form for the K1 visa. That document is not binding, the I-864 document is! That's the one they want for the AOS.
