  1. Hi Everyone,

    I moved to the US from Canada July 2017 on a K-1 visa, got married, applied for AOS August 2017 and am currently waiting to be scheduled for an interview in Memphis.  We now have to move internationally for my husband's work and it's going to be long term (minimum 4 years). We do not know when we will be moving back to the US. Due to this I would like to abandon my application for a AOS/GC at this point instead of trying to maintain it for many years overseas. Our plan would be to re-apply for a IR-1 spouse visa closer to the time when we wanted to move back.

     

    I am a Canadian citizen and so on the usual tourist visa (B2) I can stay in the US for up to 6 months and I've never had any trouble entering. My question is - If I abandon the AOS process formally before the interview, will I have trouble re-entering the US for visits on a B2 visa? I assume that I would need proof that I am no longer planning to live in the US  (return tickets etc.)?

     

    Any information would be helpful! We need to move but also want to make sure we're not creating significant problems for ourselves in the future.

    Once at the NVC, they will send your application to the US Embassy in Montreal.  You can call the NVC about 2-3 weeks after your NOA2 is received, and get your NVC # starting with the letters "MTL".  Once you have your NVC #, you can use the link above and download Packet 3.  In Packet 3, you'll find information on the 3 items you will return via the email provided.  Once emailed to the US/Canadian Embassy, you will receive a return email called Packet 4. 

    Thanks for posting such detailed info, it's so helpful! I was wondering, did you wait to get Packet 3 in the mail/email? Or did you just go ahead and submit the information for Packet 3 before getting a request for it? We got our MTL number and the notification from the NVC that they are sending our petition to Montreal but I havn't heard anything from the consulate yet. I have everything ready to go and am trying to figure out if I can just go ahead and send it or whether I have to wait to be asked first!

    I am wondering if police certificates need to be in a sealed envelope for the interview? I have one from Bahrain and I'm not sure whether it has an English translation, but I'm afraid to open the packet in case police certificates need to be sealed! If anyone knows what the protocol is for international police certificate that would be very helpful, or if anyone knows the best number to call to find out!

    We just received our NOA2 today (YAY!!) and looking ahead at the estimated processing times it looks like sometime June-July for my interview in Montreal. We have tentative travel plans around that time so what I'm wondering is whether I will be able to select my own interview date (maybe within a given range) or are the interview date and time assigned? From what I've read it sounds like you can pick and choose a bit, but if someone could confirm that it would be super!
