Since the DOS recommends your waiver application you can apply for the H1b. To apply for the visa in your embassy you will need a H1b petition approved. The embassy may be able to check that DOS recommended your waiver during the process/interview. However, I think you should contact your embassy just to be sure.
Thanks. You mention speaking to your embassy.. are you currently in the US and say that you need to contact your home embassy or are you outside of the US and is working on the H1B visa through the US embassy in your home country?

If you are changing your status you may not need to wait for the USCIS I-612 (waiver) form. Once your new visa is processed you can make you appointment in your embassy and they will be able to check that DOS recommended your waiver.
How do you know this? Did it work for you? Which visa did you apply for?

Yes, page was just updated. matter of fact thay dont have any application between oct 10 and 24 so they just used this date for showing that they are doing their work.
they processed all application till dec 12th now they need to work on dec 13th (appx 25 cases received on 13th dec). which ar pending from feb 17th.
did not process single application from feb 17th.

Haha, that's so bad. Do you know those dates based on the info you pull from the app? There seems to be a million applications that were put into the system on Feb 23rd?
I just called and was told they're processing Oct 24 cases and they can't say how long it will take. Pretty generic answer.

They are now processing cases submitted before Oct 24th 2016. Yesterday was before Oct 10th 2016. Will track the rate that they are working with.
They cannot say how long it will take them total from the date you receive your I797C.

Just got my receipt and case number in the mail. Fav rec sent Feb 15th, case received by Vermont center on Feb 23rd.

I did ask them what they usually decide before I applied for the waiver. I was a guest researcher on a J1.

Ah, no I'm still waiting for DOS (hopefully) favorable recommendation, so I'm still behind you in the process. I guess you can take away two weeks of Christmas break from that processing time.

I contacted my senator last week to expedite the final decision as I applied to AOS and I don't want my application to be delayed pending waiver decision; no updates so far.

Hi,
I am here on a J1 that expires mid-April. I got married to my US husband and will be applying for a green card as soon as I receive the final J1 waiver. I would like to continue working, but I've read that they don't give you work authorization until 90 days after you apply for the gc.
Someone mentioned to me that if you're in the US on a work visa, you apply for the green card and your visa expires while your gc application is still pending, then they are required to give you the word authorization when your work visa expires. Can someone confirm this? It sounds somewhat too good to be true.
