    However, you seem very worried about it. So, why don't you send the transcripts for your peace of mind? Write up a cover letter saying you applied for ROC mm/dd/yyyy and got a receipts number WACxxxx dated mm/dd/yyyy, it recently came to your attention you only provided last year's returns and it was not the official IRS transcript. Attach the IRS transcripts and ask them to include the new evidence to your file. Include the copies of your NOA and biometrics letter showing the two tracking numbers. Keep your fingers crossed they add these to your folder but they somehow screw up and fail to attach the new documents to your folder, your case would be evaluated with the current evidence anyways.

  2. Hi everyone. Thank you a lot for helping me out here.

     

    My USC spouse filed tax returns Married Jointly, for the last two years, but he used parents' address because he thinks it is a more permanent address. Now the address on our tax transcripts doesn't match our real address. Will that cause any problem (worried USCIS would think we don't live together) ?  Will it be better if I send them 2016 tax transcript too for which we will use our address, or anyway we need to write an explanation for it?

    I think I am having the same problem you had and I am excited to have found your post here about sending unsolicited documents to USCIS for I-751. I need to send them tax return transcripts. Can I know when did you send your additional documents to them? And does it help? No RFE and got approved soon right? You sure they have got what you have sent?

  4. Ya know, everyones situation is different- so most of the advice given is "general" in nature because small differences in situations can make things completely different...

    First you said you sent the tax return for just 2015, then you posted you didnt include the w2s, and now you are saying there are no w2s. Saying you didnt include them gives the impression you have them but didnt include them- (thats one situation) Whereas saying you dont have them so you didnt send them is a totally different situation.

    Im also not exactly sure what kind of tax return you submitted as a MfJ return with no w2s or 1099s? If you had no income then what did you submit a tax return for? Just to have one? (I understand you were students- but that doesnt answer the question).. Im just curious- you dont need to answer..

    Regardless- for the USCIS if you send paper copies of a tax return (1040 forms) then you need the supporting w2s and 1099s with it. A lot of the current do it yourself tax software nowadays has capabilities to upload your w2s and generate a copy of it with your return. Some dont. You have to actually LOOK at the papers you print out from your tax software program and see what you print out. If you print out something with your w2 info on it- whether it looks all boxy or not, its a copy of your w2 info and will probably be accepted as your 1040+w2 copy for USCIS. But srsly- what is the big deal to copy your w2s and attach them if you havent mailed in your packet just to be sure? (for people that already mailed it- well, they will just have to wait and see I suppose?)

    So- I dont know what your 2015 return was suppose to contain (if it needed w2s or 1099s attached or not). I do not know if your tax software program generated something that would count as a copy if it did. If it did and it wasnt included, they will want them. If it did and it was included, then its fine.

    For ROC they ask for proof of bonafides for the entire span of your marriage- not just from when you were issued the GC. If you get an RFE it will state to include things covering the span of your marriage. There are no "requirements'" for what needs to be submitted for ROC for proof of bonafides. They can suggest to you in the RFE what they want you to send back- but you are under no obligation to do so, just as they are under no obligation to approve you.

    If your current packet contains 1 year of tax returns (and is ok in terms of meeting w2 requirements because it didnt need one, or it was included in what the tax software generated) and they choose to approve you based on just that- well congrats. If your packet contains the 1 year and its missing w2 info and by some odd chance they feel they have enough evidence to approve you without considering the incomplete return- again, congrats.

    Anyway- obtaining your tax transcripts are free and not really that big of a hassle to do since you can do it from home. So I dont see why anyone who is concerned about what they sent as tax info wouldnt obtain them in advance and just stick them in a drawer. They dont expire, so if an RFE comes, its one less thing you have to wait on to be able to mail the RFE back asap. And honestly thats the main concern- getting the RFE back asap so the case can be finished already.

    I know I was pretty confident with the ROC packet I sent back when I sent it, but I still had a folder up till the notification that it was approved that I would stick 'additional new evidence' into just in case while we were waiting.

  5. I just submitted my i-751 and I submitted "Copies" from TurboTax.com for 2014 and 2015.

    I believe when I did my taxes, I uploaded my W2 online and turbotax did some magic to fill them out.

    The reason I did not request for tax transcript to file is because I only sent the copies of my taxes when filing for AOS.

    I guess I will need to request for Tax Transcript if you are correct on this.

    I found two options to obtain the tax transcript, Mail or Online. Which one is preferred over the other?

  6. Yeah H&R Block has software that can upload your w2 to the return or even download it from the IRS I believe to generate it into your tax form. I believe if you actually look at what was printed out when you "printed out your HR block return" youll see it had a computer generated image of the w2 somewhere in the packet. (maybe it doesnt look 'pretty' and all square like, but all the coding from the W2 stating the amounts and control numbers are there so it can be verified- making it an acceptable copy of a w2)

    but the year I submitted we were students and we didn't have w2. The other year we worked but I didn't submit. I thought I should submit 2015 and 2016 but actually Maybe I should submit the 2014 and 2015 which we filed jointly. Will I for sure get RFE and should I send them files without RFE notice.
  7. Who knows I've also seen people getting approved with one year tax return. Don't send anything until they ask for it. As I said earlier order tax transcripts meantime and if they issue RFE, send them the very next day. Good luck!

    For 751 one year turbotax ? Why do you also think I should not send them anything without being asked? I thought sending them anyway could avoid RFE even it is just a possibility to be added to my package?

  8. Huh, well I understand the NOA says you can send in stuff, however I would not recommend anyone does that. (if you do, keep a copy of the packet you send unsolicited).

    USCIS does not like unsolicited mail. It takes forever to get matched up to the file it belongs to- if it ever gets matched up. You also get no confirmation back of its receipt, so if an RFE comes you have no idea if it takes into account what you sent originally or is referring to the supplement info. Personally I think it just makes it more complicated...

    Anyway- tax returns are the number 1 biggest thing for USCIS. They just love them. Number one thing they ask for. If you sent just the turbotax 1040 forms and no w2s then you ARE going to get an RFE. The return you sent was incomplete with out the w2s. I dont care what else you sent with your ROC packet- you are going to get an RFE for the taxes the way you sent it. I dont often say things with 100% certainty but this I am sure of.

    They are most likely going to word the RFE and ask for ALL your tax returns covering the entire marriage. Depending on when the RFE comes (Apr 2017) this may or may not include 2016 taxes.

    So unless you are self employed and use schedule C - its easiest to just obtain tax transcripts from the IRS for the previous years. Request them now so you will have them when the RFE comes. If you dont want to do that- then you need to make sure you include copies of every w2 and 1099misc or interest form that was declared on your taxes. (the transcripts are easier because they have this info included, so you just send the transcript).

    Since you will be getting an RFE, you can take advantage of it and continue to gather additional evidence to include back with the RFE. This is the only time when you can send unsolicited info and be assured it will be attached to your file properly because the RFE causes the packet you mail to be directed back to the officer directly rather then going through various mail rooms trying to figure out where it is.

And 2014 we did have a job but since I got my conditional green card in January 2015 so I thought I should submit 2015 and 2016 but yeah maybe I should submit 2014 and 2015. So will I still get RFE?

    The extension letter you will receive when they accept your case states that if you want to send more supporting documents you can do so. Just add a copy of your NOA1 when you receive it and send the documents, this may avoid that you get a RFE. I have attached a copy of the letter, read paragraph 4.

    Thank you so much. This is what I have been looking for. Though I know it might be impossible for them really insert the additional documents into the original package.

    If you have submitted plenty of other evidences of financial co-mingling, this won't be an issue and you may not get an RFE. Not too many applicants get RFEs anyway. In case you do get an RFE, you should have your 2014, 2015 and eventually 2016 tax transcripts in your possession to be submitted.

  9. no big deal, worse come to worse, theywill RFE you for the transcript for both years

    I'm paranoid very worried they send a RFE and I won't receive and they deny the case. Will they really update online in time about RFE? They won't RFE for submitting only one year of tax return? Am I supposed to send 2014 and 2015 tax returns since I married August 2014. Though got green card in January 2015. Will sending them documents with a copy of NOA work?

  10. I also used HR Block tax returns myself. As long as your other evidences are sufficient they may not pick on this issue. Meantime after you file your 2016 taxes order the tax transcripts for 2015 and 2016. If they ever send you RFE, use those right away. If they don't, you will need those anyways if you ever apply for naturalization.

    Thank you. So they won't RFE just because of Turbotax or HR Block. I didn't send a copy of W2 with the turbotax either. Just printed all forms from Turbotax. And actually I should have sent 2014 and 2015, not 2015 and 2016? Will sending them documents now with copy of NOA work ?

    Go ahead and file your 2016 return as soon as possible in the new year, so that you can get your 2016 transcript as soon as possible. CSC won't be looking at your file for at least another 4-5 months. That way, if you DO get an RFE, you will have both 2015 and 2016 in your hands, and can ship them off right away.

    Thank you a lot for the reply. But I should have sent 2014 and 2015, not supposed to be 2015 and 2016? Is submitting only one year tax return an issue? Sending them documents now with copy of NOA will work?

    I wish I have known here earlier. I submitted tax return from Turbotax, print out of all the forms, but I didn't submit tax return transcripts from IRS, and I only submitted tax return of 2015. Will all these cause a big problem? Can I submit additional documents now to CSC? I just mailed my I-751 package this week.

    I got my conditional green card at the end of January 2015, which will expire in January 2017, so I thought they want the tax returns of 2015 and 2016. I can not file tax return for 2016 yet so I only submitted tax return of 2015. Now I realized I might should have submitted tax return of 2014 too, which we filed at the beginning of 2015.

    Please help! Thank you everyone.
