  1. Hi Everyone,

    I am applying for my mother sponsership.I am us citizen.

    My mother do not have birth certi because she did not register it.

    what is alternative to get birth certi .or other document in place of birth certi to put with file.Do i need birth certi and passport while i file for I-130.

    my mother have passport and school leaving certificate from primary school(1-7th std and high school)Also she has no record certi from civil authority.

    Your help is higly appreciated.

  2. I googled 212(a)(5)(A) and it comes up as a labor certification and qualifications program. This is not the usual statute that is used to reject family-based immigration applications. The fact that you were rejected for a CR1 visa under this statute is, I think, an incorrect application of the immigration law.

    Lawyer told he will put file i130 on our old marriage(green card-2005) and filgt case if question arises. while i told co that i didnot have hindu marriage at time of interview-2008, so i doubt that this is conflict.

    also she told not married at time of citizenship-2006.so we took another certificate of different marriage date-2006 and used as base of I130(which is denied).

    Or I can marry again properly(hindu & Civil)and put new file DCF.

    I called CIS at New delhi,india .They told me that I don't need to cancel this file(as it is denied).You can Marry again by proper procedure and PUT New I130 by DCF(wife has to stay 3 month in india) or in USA.I think this would be right choice as K1 are getting same time line and there r doubtful getting k1visa.

    I am waiting answer from Lawyer from US,to confirm this.

  5. yes In india DCF is quicker to get visa date (5-6month).but she has to stay here for 3month to file I130.do i need to cancel current petation to file new I130?or i can call my wife here and file new one.if i file from US then it would be 10-11 month.

    The K-1 route may not always be faster. For example, in Canada-the wait time for a CR1 visa interview was roughly equivalent to the wait time for a K-3 visa interview. The K1's were waiting about the same length of time. Yes, the K1 visa route does involve less time at the NVC and that may affect the total wait time by about a month.

    Another consideration is visa cost. The cost for adjusting status has tripled in the past year.

    If you were to marry legally and have it recognized by the Indian government, then your spouse would be eligible for a CR1 visa-which is an immigrant visa. So, no adjustment of status would be necessary. Your spouse would have their green card so they can work and travel immediately. And if the wait time is equivalent-why not?

    Have you looked at the India subforum here at VJ to see what the approximate wait time for interview at your embassy is? That may help guide your decision.

  6. My visa was denied(DSL-851A)212(a)(5)(A) on 6th may2008 becuase we didnt followed proper marriage procedure:

    -I showed him that I did indian court marriage only.(But we did't given 1 month notice to court so this is not valid marriage as per indiancourt marriage law)

    -We did hindu marriage previously while she was having GC.but at time of Citizenship she didn't showed that she is married .that is why we preffered to say that I did only court marriage,no hindu marriage after or before this ;also given in writing to CO this.

    so as per hindu(as we didn't mensioned) or court marrige(1month notice not given) our marrige is not valid and CO denied visa.

    CO suggested to re-marry and file I-130 again.or apply for K1.

    Anyone have idea what to DO in this case now.

    To refile I130 we first need to cancel current denied petation.How much time it takes to cancel this?and what is procedure.

    Any suggestion Higly appreciated.

Hi..I hv diff story.My case CR1 approved from NVC and got interview in May2008.I paid Only 365rs courier fees,No single document even photocopy at vfs Mumbai.I had list of document received by nvc(NVC latter mensioned doc they received) and i displayed to him.then they agreed to take only courier fees.pasted barcode sticker on passport and given white copy.

    They suggested to bring all photo copy of document at the time of interview.I think ahmedabad vfs is causing trouble.

    I recommend to take NVC lateer+photocopy of all Doc u submitted with NVC+2 photograph(2*2") while visiting VFS.

    With the change in procedure in December 2007 for most Indian consulates (and probably for most visa categories) NVC now collects all original birth, marriage, police / RPO clearance, photos, etc. However, it seems that not all helpline employees of Mumbai consulate and VFS employees in Ahmedabad are aware of this change. Both consulate and VFS helpline personnel are asking the applicants to submit these documents again and pay VFS fee!

    Has anyone experienced this? Has anyone experienced otherwise (meaning these people knowing the change)?

    Also, why is there a need for VFS fee when we are not sending any documents to consulate using their service? Is it because consulate is goign to send passports back by VFS courier? Shouldn't the fee be reduced if VFS is doing half the work? Is there anyone who paid the VFS fee in full (Rs 365 per applicant) at VFS but did not have to provide all docs to them?

    Also, does anyone know why an adult child (qualifying under CSPA) get a phone response from this ignorant support staff that his name is not listed for interview, when NVC appointment letter for interview lists the adult child and his mother? Does anyone know if providing derivative beneficiary's name produce similar response, as the system they might track only primary beneficiary?

    Please share your experience or suggestions. This is mostly applicable to applicants interviewing March 2008 and later who have submitted all docs to NVC. Thanks in advance.

  11. On friday,25th I went to Mumbai CO(Information window 9am) and collected Interview latter,also submitted courier fees 365 rs at vfs.I called appolo hospital for medical appointment on 2nd.

    I will then go for Int on 5th

    You may call Mumbai at 022-23637407(Between 2pm to 4pm) ,you will definetly get attendant. Or Email at :Mumbaiiv@state.gov

  13. NVC received 2 photograph on 13th march & My case completed on 19th march then I called NVC on 31th March.NVC told me that my interview date is 5th may.

    I got interview on 5th may at newdelhi,case completed on 19thmarch

    Hey those who have their interview in February and March let us share our thoughts. Also after we finish our interviews, we will get back to this thread to put in our inputs so that the others can benefit.

    To begin with, I haven't filled in my DS and other forms yet. Today I received my I-134 and it looks good. I guess I need to make a copy of them.

    It all depends on when you get the green-card issued, that is the date you enter the USA using the immigrant visa.

    If interview happens before 2nd wedding anniversary, the visa will show CR-1 Code, HOWEVER, if you delay and enter the USA after 2nd wedding anniversary, show marriage cert to POE officer, the card will be coded for 10 years. (A couple of posts have shown the POE made a mistake and code for the CR-Green-card, but all that was needed is to schedule an appointment to USCIS field office and get it corrected)

    If visa interview happens after 2nd wedding anniversary, then the visa should be coded IR-1.

    If you wait until after 2nd wedding anniversary to use the visa, and then enter the USA, the POE officer should code the green-card as the 10 year Un-conditional one, it is recommended to have and show your marriage cert to the POE officer.

    Most posts that I have seen about this tell that is what they will do. I have read one time about someone getting coded CR-Green-Card, and they had to do a info pass, and USCIS corrected the card.

    Someone else posted about asking the POE officer and they said the this is policy.

    Lastly, if you are unsure, you can always call the consulate and get interview postponed for a month or so to ensure that you will be interviewed after 2nd wedding anniversary.
