Hi.... we finally have all our documents correct and ready to be sent off for further processing, however the lawyer seems to be delaying. He has told me he will complete it by the end of the week and does not fulfill his promise . I have emailed him multiple times and in facted logged into nvc myself and completed the form. I guess my issue is i feel like doing away with the lawyer. He is no longer helpful after repeatedly informing him about my husbands job status. Its causing him great stress. I am at a loss of what to do.
Advice would be helpful. Thank you

Sigh.... the dark cloud is upon us again.... my husband was laid off from his job today. His current residency is in Qatar and we were hoping to have his interview there as well. My question is what would happen if my husband moved to a different country for job purposes.... he can't go back to his home country (eritrea) never has lived there and the country is not safe for him. What will happen to his file? He's working on getting another job to secure him in Qatar until the interview. And we have run into problems obtaining the police report.......

Hes not from the Philippines... hes Eritrean and yes i think too thats why he is giving him a hard time.

That's weird. I don't understand why he can't get it. Probably just because he is pinoy that they are giving him carp about it.
Its not that he cant get it. Its he said he was cleared but they are taking a long time to give him the report and constantly sending him away with varies excuses. Its like playing with our lives. Wave it in front of us and pull it away. I was so worried about the uscis stage that it went so well i should have been worried about the police clearance. if anyone has ideas otherwise im just venting my frustrations.....

Hi....
I am still waiting for my husbands police clearance. The clerk officer has been refusing to give him (makes excuses each time) and its been three months. We don't know what else to do.

Hello,
Still waiting for information on my hubbies side to come however our lawyer has said its ok to send financial docs to be processed (and im not sure that he even did since hes not answering my emails and i got not tracking of the package) BUT i read on nvc site sending them separately can cause significant delays. Now like i said im not sure that he did send them and perhaps i am being a nuances that he just prefers not to answer so my question is if he did send them (and i feel like he should know better since hes done this so many times and i specifically asked sending them separately will be an issue? ) can we have financial docs and police clearance resent again? Everything will be together this time.

For a number of reasons: for example, if your NVC stage is 6 months or more (I hope it's not), you will need to get another for the interview. Some consulates require an updated police clearance for the interview; there is a PDF document for each consulate's requirements for the interview: https://travel.state.gov/content/visas/en/immigrate/immigrant-process/interview/prepare.html
After our interview was scheduled, we received an email from the consulate with a list of documents to bring in. There was no mention of an updated police clearance but it is in the list of documents in the instructions for our consulate (link above). At the interview itself, we were asked for the updated police clearance, and the CR-1 visa expiration date was the date that the (updated) police clearance expired (just over 5 months from interview date).
Oh my thank you. I did not know this. Make a note.

I know in some countries, it takes about 1-2 months to get a police certificate. I assume you are at the NVC stage. Looking ahead, you may have to get an updated police certificate for the interview. Hang in there.
But they last for 6 months why would he need one for the interview if they will have it and other info that we have sent in?

Is your fiancé in Qatar currently or is he applying from another country? If he is there it shouldn't be that long. Mine only took 7 days. If he is in Qatar, he needs to go in himself with the waiting card they give up him, they will not call. That is what I had to do.
Yes he is in Qatar. He has been back and forth several times. They same the same thing it is in process. Once they said check online. And when he did it told him nothing. We don't understand what the reason it is taking so long. When first turned it in they said 2 weeks. Its been a month. This is ridiculous.

Is he currently a Saudi citizen or have legal residence there? If so, a couple searches I did indicates that he would need to return to SA to process the request (ugh, sorry). If not, then he may be exempt. I suggest checking with the nearest SA embassy to see about his options. Saudi Arabia is a tricky one with the police certificates...my fiance will be needing to get one from there (hopefully) very soon. But she's a current resident there so it's different from your case.
As for India, it looks like you can just request it at the nearest embassy (assuming he is not there now and does not hold an Indian passport).
Yes he was born there and lived the majority of his life there. He's a refugee but was not given citizenship only residency and thats that's long expired. I think i will speak with nvc Monday as I was reading for India and Saudi that if he doesn't have residency any longer it is not attainable for him

Thanks. The Qatar police clearance isn't the issue. My husband was born in Saudi and moved to India for his studies. Saudi and India are the two concerns for us as it would be a hardship expense on him to take time off work and travel to these countries.

Hi all,
So, we have reached the processing of docs for nvc. (Yay) however I am confused as the lawyer said the interview will probably be taken place in Saudi Arabia but my husband is living and working in Qatar for several years. Does Qatar not do immigration interviews? Second, police reports from every country he has lived in for more than 1 yr. Does he have to go to these countries and obtain them? Are their companies that are within Qatar that can assist with the police report without having to travel to each country. That's a huge expense.
Thanks for your assistance.

Hello again!
My husband and I have been discussing whether or not it is a good idea to book a wedding venue as a proof for our marriage. We wanted to do another ceromony with family and friends anyway if he does get approved but my concern is that it won't really hold barrings to our case and he be denied regardless thus leaving me with the disappointment of having to cancel the venue. My question is would booking a venue for the wedding be a proof of a bonefide marriage? Thanks!

Hi,
Strange question but can a possible reason to deny cr1 visa be based off the fact that the couple comes from different culture and different race? I'm greek american and he's Eritrean grown up in saudi arabia both of us are same religion. Although, our families accept each other just wasn't sure if this would pose as suspicion from the interview officer.
Thanks!

What interview?
The immigration visa interview he will have some time next year
-
Ok i understand. Why they question him on this on his interview?
Thank you all for your helpful assistance we have been beating our brains out on the possibilities of what will happen.

So....even though the immigration officer said for us to file and my husband has been to the US twice never over staying and has been compliant those two times. I feel if we were trying to do wrong he could have done it before but we made the error n now we are following as they said why should we be punished for this? What could happen for us?
I mean they may never accept him?
-
he got a non immigrant visa and when he arrived he told the officer he was planning to immigrate. in short he got the wrong visa for what you guys wanted to do. if this will be an issue later on will be determined by if the IO thinks you guys intentionally tried to skirt immigration law or accidentally tried to. this should be able to be determined by what if any refusal code they gave your husband. good luck
You mean a refusal code given to my husband or the refusal code they add in their system?
Thanks!
Why would it be looked at as trying to outskirt the law when we would be doing the same process but at least be together

Hi,
My husband obtained a visit visa to come see me however later we decide to just file his green card when he would arrive. Unfortunately, his visa was canceled and was denied entry since my husband told them he was going to file his green card. The immigration officer explained that we can not do it this way and must file for spousal visa. Which here we are. Devastated.... but making it through. Our concern is that because his visa was canceled (no deportation) that they might deny his immigrant visa because of this mistake. We wanted our life to begin and start our family but i hate to think our error has screwed us over in our chances. Please sny advise of peoples experiences would be helpful. We have sent in everything and just waiting in agony.
