Our interview is planned for April 27 and after approval my Elena plans to come to visit me in America. She is planning to leave her daughter Anastasia ( who is 3 years old) at home with her mother for about a month . Elena has heard so many horror stories on Russian T.V. about women being abused, forced into prostitution, or made to be prisoners in their own home, etc. She wants to insure that she will not be subjecting her daughter to any undesirable environment. She insures me that she cares for me deeply but she also needs to protect her daughter. I have a couple questions. 1. After Elena arrives and finds out that everything is OK. How can we get Anastasia here ? From what I understand Elena will not be able to return to Russia for quite some time and airline will not allow a child her age to travel alone. 2. Is it possible for me to go to Russia and bring her back with me and if it is, what type of paperwork/documentation is required.
As a K1, her daughter should have been included on the paperwork as children have derivative status for a K2. Perhaps you need to work fast to amend your petition or consult a lawyer on how to get the daughter added, fast. Then check into what documentation the Russian airline requires to allow you to take her out of the country without her parents present. Many countries require a notarized letter from the parents indicating their approval.

Children Have Derivative Status
The child of a fiancé(e) may receive a derivative K-2 visa from his/her parent’s fiancé(e) petition. You, the American citizen petitioner, must make sure that you name the child in the I-129F petition. After the marriage of the child’s parent and the American citizen, the child will need a separate form I-485 Application to Register Permanent Residence or to Adjust Status. The child may travel with (accompany) the K-1 parent/fiancé(e) or travel later (follow-to-join) within one year from the date of issuance of the K-1 visa to his/her parent. A separate petition is not required if the children accompany or follow the alien fiancé(e) within one year from the date of issuance of the K-1 visa. If it is long than one year from the date of visa issuance, a separate immigrant visa petition is required.
Remember that in immigration law a child must be unmarried. The stepparent/stepchild relationship must be created before the child reaches the age of 18.

I was just typing an email to my Elena, Telling her it has been 152 days since USCIS notified us they had received our I-129 Petition and I felt we would be approved soon. While typing, Windows started going nuts with email notifications from USCIS. 5 in all!!!!! Well guys it finally happened!!!

I just received my RFE that I have paiently been waiting on (June filer minus IMBRA questions on I-129 form). All Questions will be answered No except for Marriage Broker ( Question #1). How does answering yes to Marriage Broker affect my petition. Has anyone been denied for answering yes and/or has it delayed approval. Were do I answer NO on form provided for Questions 2&3.

Elena and I have been waiting for for exactly 100 days since our NOA-1 and have been expecting a RFE pertaining to IMBRA B/S since I used old I-129F. I wonder I someone at CSC night mess up, our not feel like going thru the hassle of sending me a RFE (LAZY PERSON) And go ahead and approve our petition. I know I dreaming. Congratulations to all the approvals!!!!! I hope will be able to be with their soul-mates soon. P.S. WAR EAGLE!!!!!!!

It's been 88 days for me. I feel like a dented can in a grocery store " I keep getting passed up". I think I will move to the North East coast and start over again ( Maybe Vermont).

It's been 80 days for me. No touches and no RFE. Have been expecting RFE since I filed before I-129F was updated to reflect new IMBRA questions. I am concerned too.

The change-over back to the NOA1 date must be scheduled for 01Sep06, or a later date, because it appears they still approving petitions with ink that hasn't dried yet. In other words, freshly submitted petitions.
Good point! I just think now that everyone has sent in their IMBRAS and that is no longer an issue and they are now going by noa1 date again instead of RFE return date, that we are all in the same boat. The USCIS and other officisals can no longer use IMBRA as an excuse and VJ memebers can no longer be upset about going by RFE.
I guarentee if we ALL were to be creative and as you say RESPECTIFULLY and aggrssivly pursue this to our representitives, particularly before election time, it could make a big difference.

Whoa!!! There are still folks out there that filed petitions in June that filed old petition, that have yet to receive a RFE!!!!! So hold your horses....

You will recieve an RFE in the mail... They are a little backlogged now at CSC so when they get to your petition, they will send it.

You are right!!! I-129F, I have seen numerous folks that have filed after me, that have received RFEs. and was afraid they might be using mine as a door stop or something.

After reading discussions concerning processing dates of I-129s. I am becoming concerned!! I live in TN so I sent mine to TX for processing on the 8th of June 06. Received NOA with a Receipt Number starting with WAC ( I guess California) on 28 June showing received date of June 13 and Notice Date June 26. I of course filed the old I-129 form since new one was not available at that time. I have been expecting a RFE asking for more information ( IMBRA) My concern is I have not received any emails or touches. Should I continue waiting patiently or contact my Congressman?? Please advise!!!!!
