  1. I finally received the Notice of Action for my I-131 and I-765 today! :D

In regards to that, does anyone know approximately how long it will take till I get my EAD card in the mail? I have read 7-10 days somewhere, is this correct to assume?

And is it safe for me to book my tickets back to Norway for Christmas now, since the applications were approved?

I also wonder if anyone know if it's safe for me to travel on the EAD, and that it's likely that they will let me back in? I don't have a job offer here in the US yet. Has anyone done this travel recently without any trouble?

    Thank you :)

  2. Hei!

My applications (I-485, I-765 and I-131) was accepted in the middle of August. I have my biometrics appointment next week.

My question is: is it safe for me to travel back to Norway for Christmas before my Advance Parole card has arrived? If so, can I receive it in my home country at the US embassy? Or should I stay in the US until I get the card? How do I know if I will even get the card at all? Do they let me know that I will get it or do I just wait and see? It makes it very hard for me to plan, and I would really love to go home to my family for Christmas.

Also, how do I do it in regards to passport and name change? I still have my old name in my passport, is this still valid? Do I have to bring my marriage certificate and/or other documents if I wanna re-enter the us?

    Thank you!:)

I'm glad you are almost ready to send your package in :):)

Yep, just one check, with one payment, total of $1225.00. No fee(s) for submitting I-765&I-131 along with I-485. Or after  - if you submitted just I-485, and later decided to file for I-765/I131.

P.S. I would write "I-485 filing & biomteric fees" in memo part of the check.

Thank you, this is great! I was a little afraid that I had to pay for each application.. phew 😅

Thank you, that was helpful :) I'm about to send in documents today or tomorrow, but how do we do it with payment?

Do I attach a check with the payment only for I-485 and the biometrics fee ($1140+$85) and not payment for I-131, I-864 and I-765 since these are all sent together?

I found this now: "place all the checks on the top application if multiple applications are filed". Does that mean that I make one check for I-485 ($1140) and one for the biometrics ($85) and put them only on the i-485?

The answer should be "no" since the K-1 and student aren't  immigrant visas, and you do not receive permanent resident status by getting a K-1  or student visa This is if you have NEVER filed for an immigrant visa before the K-1, that is. :)

  6. And in form I-765 (I might have asked this question to you before, I just don't understand it completely):

    • What is my "eligibility category" (Q.16)?

    I really don't understand this.

I though I was C9: adjustment applicant. But it's says they require a receipt that my I-485 is pending, but that I can also file the form with my I-485.

Then I started wondering if I'm A6: K1 filing within 90 days of entry.

    It's confusing!

    Part 5.

    1. - 1 (he is sponsoring just you and you are in Part.3, right? :)

    2. - 1 (himself)

    3. - nothing, You've been already mentioned in p.1, and this part clearly states to not count any body more than once.

    4. - nothing (no children, right?)

    5. - nothing, if hi has no dependent (parents or anybody else). Tax Return for 2016 could be helpful - it shows if there are any dependents there.

    6. - nothing

    7. - nothing

    8. - 2 (household size)

here is a good example, from VJ ;)

    http://www.visajourney.com/examples/INS-Form-I-864.pdf

Thank you, that was very helpful! :) Haha I know I ask a lot of questions, but I just want to make sure that everything is right.

    And here is another question:

    • On the PDF file for the I-485 form I'm trying to type in what is was admitted as at the border, which is K1 visa holder (part 1, Q. 22a). The same for my status on my I-94 (23c). But the PDF doesn't allow me to type in numbers, so therefore I'm not able to write K1. Does this mean that I'm supposed to write something else here than K1, or can I just write it in black inc by hand?

I believe the first time we see a word "petition" addressed to us - at ROC stage :) And I believe we are still recognized by USCIS as applicants, in most cases I-751 is a joint petition...

I spoke with IO few days ago, and I said I was a petitioner (I-751)... He corrected me, that I'm an applicant. Confusing,. right? : )

Btw, this is about the affidavit of support:

My husband makes well above the limit of what is required for being my sponsor. But that is just the past two years he started working and making that kind of money. They say that they need the last three years of tax returns, but in 2014 he didn't really work that much and made less than what they require.

till this be a problem in regards to what they require for him to be my sponsor? Do we need a joint sponsor? It was no problem in regards to our K1 petition.

Haha yes, very confusing 😅 But I guess that's just how the system is. I thought I was the one who petitioned to get my status adjusted, but I understand now that I'm applying to get it adjusted. I finally think I'm almost done with everything, but it's nice to get these things sorted out :) You really know a lot about this!

  10. 1 minute ago, Ksenia_O said:

    Yep : )
He is a petitioner of "everything" ;)   -  "Item Number 1.a. Select this box if you are the petitioner who is filing or who has already filed Form I-129F, Petition for Alien Fiancé(e), for a fiancé(e); Form I-130, Petition for Alien Relative, for a family member; Form I-600, Petition to Classify Orphan as an Immediate Relative, for an orphan; or Form I-800, Petition to Classify Convention Adoptee as an Immediate Relative, for a convention adoptee."

Thank you! That was great to get cleared up! :) I thought he would be the only joint sponsor, so that would have been wrong if he ticked off that box..

When you say everyone, do you mean that he also technically is the petitioner of all my other forms?

But I attached photos only with I-485. ..because  it was in  "one" package anyway....

But you know, since EAD (I-765/I131) approval now takes much longer than when I filed... I would probably attach pictures to each application.. So, total of 6.. Just to avoid a possible RFE - it all depends on a person who will review your case and i really don't want any delays for you. It takes long enough anyway...

Ok, yes that sounds like a good idea. I just hope they stored my pictures at CVS so they easily can copy of an extra set of two.

I also see many places that they request a receipt from pending I-485 if applying for I-131. I also think this is one of the questions in the application form. This doesn't apply for me since I'm applying all at once, right?

and also, my husband is going to be the sponsor for the affidavit of support. Is he then the "petitioner" or the "only joint sponsor"?

You know, I sent only 2 and everything was fine. The same - for my son's AOS (he arrived 3 months later than me and his was filed separately). Anyway they use pictures, taken at your ASC (biometric) appointment.

But i see most people her, on VJ,  usually send 6 - 2 photos for each form...

Ah Ok, I thought I'd only need 2, but got an extra set for free just in case.

Do you know if they process all the applications together if I send them in one package, so I can just put the booklet with the 4 passport pics In with the first page?

No, you don't have to make three copies of each :)

the main application, I-485 - yes, there is a list :) but for I-765 you just need  2 passport photos  (attached with a paper clip to Form I-765 and signed), copy of your passport (ID page, K-1 Visa) and I-94.  We included a copy of Marriage Licence, but it's not really required.

For  I-131 Application - copy of your  passport (ID page, K-1 Visa), I-94, 2 passport photos y (attached with a paper clip to Form I-131 and signed).

I would take new passport style pictures..

you mean  pictures of your passport pages?...

Ive now fixed everything from passport style photos to copies, but I only got 4 passport style photos I see now that I got home.. damn, it looks like I'll be needing 6?

    Yeahhh It's been :)

It would've been so-so alright, that long wait, if I didn't have to make numerous visits to DMV for my Driver License renewal.(S).. trying to prove every time 'i'm legal enough" to drive :)

    But - done ;)

It can really take up to a year to adjust your status from K1. Often a Potential Interview Waiver can be recieved - it means no interview, but wait is gonna be longer ; ) At the same time my friend (also K1) just got her AOS approved, and it took 5 months. So, hopefully, things started moving a little faster for I-485 filers.

I'm in Missouri :) Where are you? ;)

Haha oh no that sucks that your license expired all the time, I wonder when I can apply for one. I haven't really looked into that yet. I live in San Diego :) I met a woman just now at the library who just got hers approved in 8 months, and the Work authorization was super fast for her, so I'm going to cross my fingers!

I just went to take copies of the documents I need for my application, first of all:

    • Do you know how many copies of each document I need? Do I need triple of everything since I'm applying for three different forms?

    • The quality on the prints didn't turn out so well on the pictures, do you think this is a problem as long as I submit the original photo with the forms? I'm planning on taking new photos for the passport sized pictures they ask for, but I still have copies of the old that is used in most of my documents.

I applied in June, 2014. Approved - September, 2015. It took 15 months.. , long wait :) Thank you for asking.. Probably it was a "pay back " for our fast I-129F approval - took only 3 weeks from submission til NOA2 :)

It' was around 60-90 days, when i filed, but now, according to USCIS processing time and VJ folks experiences - yes, it takes what it takes, around 90-120. Sometimes, not often :) l people still get it about 60-90 days, but most - longer..

you are right - if you file I-765 & I-131 along with your I-485, those two are fee waived. Just I-485 filing fee + biometric fee ;)

Wow yes that is a long wait, but at least you got approved! Yay :D  Haha our NOA2 I-129F approval was also fast, but not as fast as yours, two months I think. In general I think it was a total of 5 months from applying to I had the K1 visa in my passport. May I ask where in the US you live?

I had "multiple" in my I-131 as well.  It doesn't really matter for the processing of I-131, so no worries - it won't effect a "wait time" or approval :)

Currently it takes around 90-120 days to have a combo EAD card (Employment Authorization+Advance Parole). If no RFE for your I-485. I-765 & I-131 depend on your I-485. If RFE is issued, when issuance of those two can be stopped until you respond to RFE. Sometimes it can be two separate documents - Employment Authorization card (I-765) and I-131/Travel Document Notice, a "paper" :)  .

First time, when I just filed for I-485, I received a combo card. But the second time (I had to renew both due to long AOS pending time) I got two different documents. But yes, in most case it should be a combo card.

I'm sure - nothing needs ti be notarized :) Just regular photocopies and certified copy of your marriage license is recommended :)

Aii that was longer then I expected.. I hoped it would be a month or two for the work authorization. If I file everything together in the same package, will that save me money? I feel like I've read about something like that :)  When did you apply? And what was the total waiting time for the AOS?

Sometimes people believe they won't travel until a green card in hands and don't apply for I-131.. But  I-485 can take up to a year, sometimes even longer...

:) I-131 wasn't mentioned yesterday,.. Just started worry, sorry :)

No problem :) I actually had a few questions regarding the I-131 too actually. If I check of that I need to use it for "multiple trips", would they be less likely to approve it or would it take longer you think? And approximately how long do you think he i-765 and I-131 processing will take? :) and last question, are you sure they don't need to be notarized or stamped or anything? Just regular photocopies?
