Hi everybody!
We are desperate for some advice and would appreciate your comments.
My fiance received the following information:
- USCIS received the I-129F on the 23rd of March 2015 and forwarded it to the National Visa Center Texas
- Did not receive our NOA 1 until 2nd of January 2016 !!
- Phone inquiry on the 25th of February 2016 reveals that our case has been sent back to USCIS for review on the 3rd of February 2016
As he could not get any information via the NVC hotline, he made a congressional inquiry on the 26th of February 2016.
Our case status online remains unchanged for many months and says that "On February 22, 2016 the Department of State sent us your case for review. We are reviewing it, and will notify you by mail when we are done."
In the meantime, he received the result from the congressional inquiry via phone: our case supposedly expired in May 2016!!!
We did not even know that a case can expire, when we are the ones who are waiting for them to proceed with the next step. Also, we don't have any written notification from USCIS or the NVC about our expired case and when checking the case status online, it still shows the information from above.
We are thinking about starting it all over again, this time with an attorney. Or should we get married in Germany and file for a K-3 visa instead?
What are your thoughts?
