My wife (greencard holder) and I (us citizen) have been living abroad for the past 21 months due to my work. Before leaving I filed paperwork for a re-entry permit. Unfortunately that request was denied because it was received 3 days after we had left the USA.
I believe there are two options:
1. Apply for SB1 return visa at the consulate...her reason for being outside would be my work abroad. It takes a lot of time and resources (medical check again, etc..) to go through
2. Travel to USA and explain the situation to the immigration officer. We have a home still in the USA, as well as bank accounts, etc. We also have a US citizen 5 yr old son.
I am hoping to get any comments here on the effort it takes for getting a SB1 return visa. I would also love to hear the cons for option 2: would they send her back given her situation or give us a court date to explain the situation to a judge?
Any wisdom/advice is appreciated.

Hello,
I am a US citizen and my wife has her green card (all conditions removed). We are moving to Korea where I will take on a new job. Do we still need to file for a re-entry permit. We are keeping a home here in the USA and we do intend to come back after 3 years.
Would appreciate your insights.

We went in to local office (San Jose) on 5/26 to request expedited processing of our AP. Officer sent a request to the processing center. They e-mailed us instructions just one business days later along with a fax number. On 6/7 the status was updated to "AP Document Was Produced".
As we were waiting for our appointment on 5/26, I asked if they could squeeze us in for Biometrics (scheduled for 5/31). No problem.

On 5/19 we received Biometrics appointment for 5/31...22days from NOA1

Check was cashed this morning. Status on USCIS site now says: "Fingerprint Fee Was Received"....

Hello All,
AOS/AP/EAD package received in Chicago on 5/3...
Just this evening, 5/9, I received text message/e-mail with case numbers. Check hasn't been cashed even.
My first submission was rejected because of wrong amount on the check as I had forgotten to include the biometrics fee.
Anyway, happy it's moving forward.

I understand you worrying, it's been a bit of time and a few other people who sent theirs after yours have gotten notifications, but I would say you are still within the normal timeframe. It can take three or four weeks to get a response. I would call them after the third week.

Mystery resolved...rejected...had forgotten to include the biometrics fee...uughhh...sending it in again first thing tomorrow. Included G-1125 this time around too...

AOS Package was received on 4/14...still nothing...cheque not cashed either. Getting worried. Any advice or guidance would be appreciated.
