    Copies of documents submitted are exact photocopies of unaltered documents and I understand that I may be required to submit original documents to an Immigration or Consular officer at a later date.

    Are you arriving in the United States on a K1 fiancé visa? The affidavit for the fiancé visa requires a full year of tax return income over the limit. If you haven't applied for that, you will need a sponsor, or will need to wait for 2017 tax info.

     

    As for the residency affidavit(AOS), Her 2016 tax returns could be a problem not being over the limit. I do think they take the most recent tax year into account. Does she own property? You can make up for lacking funds if the value of property (real estate or stocks or bonds) is 5x that of the amount short of the poverty line.

     

    Technically, I do think it's the current year that matters, but she will need evidence of her income since 2016 is lacking. Definitely at the very least, send an explanation of the situation. Consider talking to a lawyer for something as complex as working overseas for a period of time. 

     

    Its very confusing and I don't quite understand either.

     

    After high school she moved to Europe to study here. After this she worked in Poland for 3 years and then decided to move back to US. While being here she has never report any income to US institution.

     

    During K1 process we used her as my only sponsor and there weren't any problems. But to be honest they didn't check affidavit of support very closely. When I wanted to give them employment contract or 2016 tax return they said it is not necessary.

     

    She doesn't own any property, nor any valuable things.

     

    We have every pay stamp from December 2016 to present moment.

     

    Do any of you also think that it is current year that matters the most and that we should be approved (during AOS) even with her short US tax history?

  3. My fiancee started working in Boston on 1st December 2016. Earlier she has been working here, in Poland. Her 2016 US tax return shows only few thousand. She has a permanent job in a big international corporation. She is earning a lot more then poverty limits. She doesn't have any debt. She has some small savings. Basically her financial situation is very good, it is her short stay in US which makes me worried. Do you think it will be enough if she will be my only sponsor? Do you guys have or heard about similar situation?

    Technically the DS-3025 shouldn't even be needed to send with your AOS as USCIS already have your full medical report that you handed in at POE, but unfortunately they often don't manage to figure out how to connect the K-1 envelope with your AOS application, that's why you send an extra copy of the DS-3025 with the AOS package. The DS-3025 should be marked "complete" btw.

     

    And yes, an early RFE will usually result in a pause on both the EAD and greencard process. If it's an RFIE it can even reset the wait time, meaning you start over from scratch time-wise. But often the wait isn't that much longer than without RFE, just send in what they ask for asap after you receive the RFE hardcopy.

    Today I got my copy. Only after I returned home I realized that this document should have 2 pages. I got only first one. However from what I can see (http://photos.state.gov/libraries/thailand/591452/iv/ds3025.pdf) on page 2 there are only some additional informations (contraindiction to vaccination, remarks). Do you think I should go there one more time and request additional copy with both pages? When you guys applied for AOS did you send both pages or only first one?

    I am uploading my DS-3025, it is marked completed and it is signed.

  5. Ohh I didn't get it during medical examination. I will go back to them and ask for a copy.

    If I can't get it, I will politely ask officer in US if I can take a photo of this page while crossing the border (I found some posts saying that DS-3025 can be found in sealed envelope).

    If none of this work, I will try to explain in AOS package that my DS-3025 should be included in the sealed envelope and that I didn't get a copy.

    What do you think about this plan?

     

    If I get RFE because of that, is it going to hold off both EAD and Green Card?

  6. Hi All, in 3 weeks I am going to Boston (using my K1 Visa). I just wanted to ask you what documents should I take with me to US. I am scared that I will find out that I am missing sth while I will be there! I know that I need original Birth Certificate. I will also take all documents relating my education and employment + medical documents. 

    Are there any official documents (apart from birth certificate) which I may need to provide during AOS

    In few weeks I will be attending medical examination in Krakow, Poland. I would like to prepare myself for that - I am thinking of getting some vaccinations before going there in order not to waste any time later. Did any of you lately attend medical examination in Krakow or Warsaw? Which vaccinations will doctor probably prescribe? I am 25 years old. I don't think I had any vaccination in last 8-10 years. 

     

    On the ambassy webiste I found this information: Panel physicians who conduct medical examinations on behalf of visa applicants are required to verify that visa applicants meet the vaccination requirement, or that it is medically inappropriate for the visa applicant to receive one or more of the listed vaccinations: mumps, measles, rubella, polio, tetanus and diphtheria toxoids, pertussis, influenza, haemofilus influenzae type B (HIB), hepatitis A, hepatitis B, varicella, pneumococcal, rotavirus, meningococcal. 

  8. Not the same. They are different.

    Bottom line is the time it will take to get there is no more with priority mail than with express. You will pay more with express though.

    The only real difference is if it does not get there in specified time the USPS will allow you to request a refund of your charges.

    If you feel more comfortable with Express that will be just fine with USCIS either way

    Ok thanks for that, but can I use adress dedicated for USPS Express Mail and courier deliveries while sending normal USPS Priority Mail? From what I understand I should then send it to P.O. Box.

  9. The best way to send it is USPS Priority Mail with FREE delivery confirmation. Signature cards mean nothing in this case.

    All you need to know is that it made it to final destination.

    Don't forget your form to allow them to text/email you the NOA 1 notice of case receipt.

    Also make a copy of the ENTIRE package you send in the event the post office or USCIS manages to Lose your file it does happen.

    Just to be sure, USPS Priority Mail (as Jim mentioned) is the same thing as USPS Express Mail?

  10. I am filling out the g325 form and I have a question regarding the field pertaining to mother's family/maiden name and first name. My mother was born in Poland where she changed her surname (maiden name) after getting married. She was then naturalized in the US and she changed both her name and surname. As her name after naturalization is different from both her maiden and husband's surname I will fill the form with her maiden name, however should I include an attachment with an explaination (she was naturalized from a different last name than her maiden name)? I just want to make sure that if someone does a background check, they will know the reason for the different names.

  11. We have an appartment lease signed by the both of us, as well as numerous photos taken throughout the years. Apart from that we thought about attaching our college diplomas or work contracts to prove we finished the same college (where we met) and that we live in the same city.

    What about the fact that she will not have a US documented work history or tax return? Should we consider asking someone to be the joint sponsor?

  12. Hello everyone,

    This forum is wonderful and is a great source of information. In a few weeks my fiancé will begin the process of obtaining the K1 visa for me, therefore I have two questions and I would be grateful if someone would share their knowledge. We met in college in Poland and have been together for 4,5 years. Kate has dual (Polish and American) citizenship and she is moving to Boston late November to start her new job on December 1st.

    After college we have both began our careers in Poland therefore Kate will not have a US documented work history or tax returns. Will it be sufficient to provide her work contract and proof of salary? We checked the Poverty Guidelines for Affidavit of Support and will have no problem meeting them, however she will not be able to evidence this through tax returns as she will not be working in the US long enough. Will the contract and bank account extracts with salary be enough or should she have a joint sponsor?

    Additionally, I already booked a flight to visit her late January for four weeks (I already have a tourist visa issued for 10 years which I have used once when visiting her parents during summer 2015). If obtaining the K1 visa takes longer than 6 months she will also visit me in Poland. Do you think it would be wise to share these plans with the USCIS? We want to be transparent, however we would not want to share these plans if they were to somehow negatively impact us. We think this would be beneficial as it shows we have a ongoing relationship, it would also give us some time to arrange our wedding.
