  1. So like 4 months ago I sent in my I-751 and had my biometrics appointment 3 months ago.

    Yesterday I got a letter from them saying that the evidence submitted with my I-751 is insufficient.

    Seriously, I dont know what else to send them. I sent them our joint leases from 2008-2010 (I dont have the lease contract from 2007 - 2008 because we moved), sent joint tax return, pictures of us, copies of plane tickets for trips we took together, joint automobile insurance. There is nothing else to send. We have seperated bank accounts, which we do on purpose so there will be no fighting over money, I still have my maiden name. I mean really?!? What else do they want!?!

    Did that happen to anybody else?!? All I read in the forum is people getting approved..

  2. Im going through the same thing...it is so annoying..anyways, I did sign part 8 only. Also, I explained on a separate sheet several reasons why I would like to have permission to travel outside the US, until my AOS application is finished.

    First, a wedding this year. Second, in case of emergency I would like to have the opportunity to leave, e.g. death of a close family member - just in case

  3. Im ready to file my AP and again Im confused. Ok, they transferred my AOS case to the California Service Center. But I originally filed the AOS with the USCIS Chicago. On the instruction sheet for form I 131 they say to file the AP application to the same address as I used to file my AOS application. So what now? Where do I file it? Thanks a bunch for your help.

  4. I do not know how long/if/what/when they cancel or anything.

    But I had the request for extra evidence of support at the embassy also. However, I got my fiance to fed ex it to me and I had it in to them about 4 days later and had the visa and passport back within the week. The visa wasn't actually issued untill they mailed it, the date of issurance was once they had the paperwork they wanted, so technically you don't actually even have a valid visa yet.

    I would just advise getting to them whatever it is they want ASAP.

    your fiance income wasn't enough? did it fall under the poverty guide line?

    well, no, his dad filled it out and he´s a doctor. so we thought thats ok. they told me, my fiancee had to fill out one too, but he´s a student, what I told them....so...I dont know why the actually need it, cause he will be definitly under poverty line. but the officer told me the visa is approved though.

The question is, will they cancel the visa automatically after a certain time?!

    did they give you a dead line?

    No, they just said, send it in, they probably thought we would do it within the next week or so

  7. One week ago, I visited my boyfriend in the US. It was not easy to get in. They asked me all kind of questions, like how much money I have right now, so they could send me back right away and they even called the Escort. So they checked my records, like how often was I in the States, how long, etc. Finally, after one hour of questioning I could enter. The thing is I came from South America and I would have had a connection flight to germany anyways. So I decided to visit my boyfriend for 1 week. So, I think the fact that I came from South America helped a lot. If I would have come directly from Germany, Im not sure if they let me in. It can cost a lot of money if they dont let you in, cause you have to book another flight and fly back the same day. I think I had luck.

    A Request For Evidence (RFE) is a form USCIS sends to to you.

    You should check with your Fiance if unsure of the specific I-129F version you filled out or if an RFE was received.

    From your last comment, I am surmising that you are not the U.S. Citizen?

    Clarify these points with your Fiance and reply back.

  9. Oh man, Im even more confused now. I know we sent a seperate sheet together with the I-129 F and explained where and how we met- is this the RFE?!? I have to ask dave if they asked him about this IMBRA and Criminal background-I dont rembember being asked. I know they sent the whole package back one time cause there was a mistake and then we just sent it back and got the Noa 1 in June....

    IMBRA is the International Marriage Brokers Act. The act became effective on 06 March 2006.

    On the I-129F you filled out, did it ask questions about Marriage Brokers and Criminal background?

    You may get a separate Request for Evidence (RFE), which is a form that asks those questions, despite the fact that your I-129F already asked.

    That is the wonder of the USCIS, always doing things right!!! :lol:

    Be sure to go to the USCIS website and establish an account. You will need the A# from your NOA-1 document, an e-mail address and some other information. This will allow you to track progress and get automatic e-mail notification of changes to your account status.

    Hey thanks for the reply. I dont excactly understand what you mean with with IMBRA, RFE ( Im new to this forum :blush: ) etc. We already got our NOA 1 on 6/12 its all filled out etc. Im waiting for this NOA2 thing..and this might take forever.

    That will not be a problem, with the following exception:

    Even if you use the "new and improved" I-129F with the IMBRA issue included, you may still receive a Request for Information (RFE) with the IMBRA questions.

    If you are the USC, can someone forward that mail to you in South America? You will want to fill that out and return it ASAP, or your process will halt. They also impose a time limit to respond to the RFE.

    With that said, be sure to establish a way to get that mail forwarded to you.

    Ok, will they send it to my address or to dave´s address in the us?!? and have we both have to fill it out?!.

    What William said is right - since you filed with the "old" I-129F (the new one wasn't available when you filed so I'm making this assumption) they will send you a supplement request for evidence (RFE) so that you can answer 3 questions in order to comply with the law. Other than making sure this form is filed out and returned, it doesn't matter where you are physically located while they take their time to process. Make sure you have set up an online account and have access to your email as well as having someone get your mail at home. You may also want to start gathering the items for packet 3, post approval, so it's not a mad dash when you get home. But it's fine to travel - go and be free!
