  1. My husband and I are ready to file for a CR-1. He is from Kenya. I am headed back there next month to meet him next month. We have a co-sponsor from his family member living in the US. When I return to Kenya I am considering staying for some months. Is it possible to file DCF if I file the CR 1 before I go to Kenya? Would that affect the process? Is it possible to file for a tourist visa after filing the CR-1?

    Thanks to everyone very much for all of the help and assistance. I will go to visit my father alone for short stints and we will apply for the CR-1 so we can freely travel and live between both countries as we choose.

    K3 is obsolete and are rarely approved. Out of the tens of thousands of immigrant visa USCIS approves per year there are only a few hundred K3's that get approved. K3's usually get denied and converted to CRi/IR1.

     

    The reason your husband is a high risk is because he can adjust status through you in the US. Many people do that because it is kind of a way to skip the line, so to speak. It is because people don't want to be separated for long periods of time which is something you already admitted to in an earlier post (not insinuated that you are going to do it).

    Basically I just want to be able to go to my home country with my husband, I don't know how long I will need to be home. It could be 2 months it could be 6 months. If we have a C1 does he then have to stay in the country? This is quite confusing.

  5. Thank you so much for the replies. We rent a house in Kenya and I am applying for my Kenyan residency. Do you think this would help? We don't want to live in the US at this time, however I just don't want to be seperated from him for an indefinite amount of time. 

     

    Also I thought he couldn't adjust status within the US. Any suggestions on what we should do instead? the K3 seems impossible and K1 seems confusing because we are already married in Kenya. Should I go home and work on it from there? 

  6. I have recently married a Kenyan man and we are currently traveling in Asia. I want to visit my parents in the U.S. because my father is having a maor surgery. I need to be there for his recovery so it could take some months. We want to ge the 5 yr kenyan tourist visa now, not a K3 or K1. Only a visa that will allow him to visit. Has anyone gotten this visa or had any experience with it? 

  7. We don't want to commit any fraud that will stop us from being able to live in the U.S. in the future. If we do get married on a tourist visa while he is here (we plan to have two ceremonies anyway) then he will return to his country afterwards so it won't matter and won't be fraudulent. We just really want to be together through all of this and not have to spend years apart trying to be together. Luckily although we are from different cultures his family is quite untraditional so there's not many issues with that. I really lucked out. My family doesn't support me in any way financially and therefore I'd never want them to on this. It's just our personal boundaries. I now know thanks to the link someone inboxed to me that I don't need them to.

    Our next step is seeing how long I can stay there as his wife while we await some processing in U.S. I appreciate all of the positive responses and the helpful replies.

  8. I'm desperate to marry my boyfriend from Sri Lanka and don't know how to go about it. I just left the country so we can't get married there now unless I go back. Everything is actually really fine with his family, there is no drama there. My family however would not be helpful with finances or visa sponsorship. He is going to apply for a tourist visa but we might be tempted to marry when he comes over. Would this be a big problem? Fiancee visas seem to take a long time, I don't make much money and have no family to help sponsor him. If I go back to Sri Lanaka to marry him can I stay there with him while his visa is processed for the US? Or do we both need to physically be in the US for his to get a visa. Confused....
