  1. Hello--a question for the group: We are filling out the I-131 advance parole. The instructions ask for the following: A copy of any document issued to you by USCIS showing your present status, if any, in the United States;

     

    Would an I-94 arrival/departure record be adequate? If not, can you recommend something else? My wife's K-1 visa has expired and we are currently waiting on AOS processing so I don't think sending a copy of the expired visa stamped by USCIS at the port of entry would be ok.

  2. Hello all--the AOS is taking a little longer than we expected so we are submitting (did not submit the advance parole with the AOS) the AP now. My wife would like to assist taking care of her father following his knee surgery. Do they typically grant these for the time you think you will be out of the country or is it for several months? Just wondering as she'd like to travel but not until February--at which time we may have the AOS done anyways.

    Thanks everyone. I did enter A6 so that is likely the issue. Irritating that a code can cause this issue. Based on your experience, is a resubmission of the form needed thereby restarting the review period from the date they receive the corrected form? If it is indeed the most often cause of RFEs, perhaps listing 2 codes in the same section for a K-1 is causing confusion. 

    Thanks again for the clarification. Looks like another 3 month wait and we will likely be close to having our status adjusted by that time...

  4. Today we received an email notification of a pending RFE (initial) for an I-765 work permit that was submitted along with our I-485 in June of this year. Since the EAD is a simple form, I cannot imagine what additional evidence they would need. So I took another look at the instructions and noted the following:

     

    6. Family-Based Nonimmigrant Categories A. K-1 Nonimmigrant Fiance(e) of U.S. Citizen or K-2 Dependent--(a)(6). File Form I-765 if you are filing within 90 days from the date of entry. This EAD cannot be renewed. Any EAD application other than for a replacement must be based on your pending application for adjustment under (c)(9).

     

    I may be misreading but i am concerned that because we filed our I-485 and EAD (I-765) on June 13th (receipt date) and my wife's arrival to the US was March 2nd, the 90 day date has passed and we will have to wait until the AOS is cleared before she can work. Any thoughts or experience?

    We sent in the I-485 last week and included the filing fee and biometric fee in a single check. I made the check out for $15 over the correct amount in error. I understand this will be rejected but my question is this: will the entire packet be returned, will it be discarded there or will we just need to submit a new check in the correct amount once the NOA/rejection is received?

  6. Thanks. I remember this now and just checked. It seems up to date. Thanks. Under admin review as she had to send it one more NBI clearance but that was done on Thursday. Did you call the US number 703 520 2235 for assistance? I would like to confirm they have the correct document delivery address.

    That's the site used by the consulars but not always updated.

    Never used that page. Don't like third party websites. I use the CEAC website. Her appt was 13th of Jan and I was with her so I know she passed and that's when the status started. Was told on the embassy helpline is was last reviewed on Feb 8th and watch for 2go email but STILL not on issued.

    Thanks. I believe the CEAC website redirected me to that one so we maybe talking about the same one? Can you forward me the website you use to check?

    I remember busting this K1 application into FEDEX (Kinkos 24 hour) 10:00pm on a Sunday night back in October....    Then the waiting... and waiting... and fretting... and irritating SAGOT   LOL

     

     

     

    Fiance's Interview was yesterday Feb 8th in Manila ... CEAC status says "ISSUED" as of this morning.

     

    Word of note:   The interviewer was a PHALLUS (trying to be polite)

     

    He grilled her and accused her of just wanting a green card. 

     

    He told her "You do know you are number 3 - are you ok with that?    You are ok that he was arrested for Domestic Violence?   No woman wants that - it seems to me you are in it just for the visa"

     

    She had a copy of the court transcripts/official records from 1999 and says - "No - the charges were dropped.  He was not convicted of Domestic Violence" as she pointed to the checkbox where it shows Counts 1 and 2 were dismissed.   Kept grilling her over stupid things.     :o

     

    Now we just waiting for the courier to deliver to the mall.    And then that stupid CFR or whatever that is. :jest:

     

     

    Congrats on the interview. We had ours on the 8th also and are now waiting for the courier. I am having an issue with the ceac website. None of the clickable boxes work (I've used Chrome/IE/Safari) and the document delivery instructions box is not populated. Her appointment history shows "scheduled". Her appointment confirmation did have the document delivery information correct with her home address. Anyone have similar issues? I was able to send an email to the contractor that manages the website but that might be a gamble at best. I imagine the best thing to do would be to call the Embassy on Monday to confirm they have the correct information.

    Are you monitoring the progress on the embassy website here: https://cgifederal.secure.force.com/ApplicantHome? I've noticed none of the clickable boxes work (I've tried all browsers except IE). I also noticed the document delivery is not populated but her appointment information is correctly listed in the appointment history section. Document delivery is correct on the appointment confirmation letter but it is concerning to me that it is not showing up here. Is yours populated correctly and do all the boxes link properly and work when you click them? Interview completed on 2/8 and just waiting for delivery. A bit frustrating that the webpage does not seem to be working correctly. Any ideas? I did send an email to the contractor who manages the website.

  10. funny how our times and values change. not long ago, it was common practice here. it's not our business to judge

    Well, given what we know about the emotional maturity and development of most 15-16 year olds (male or female) we should not throw our hands up in the air and say "it is not for me to judge"...it is perfectly ok to make a judgement in this case. Whatever our past practices were, it is clear they are not applicable today. If you want to move to the U.S. then you need to adopt our customs and laws and give up antiquated practices such as child marriage.
