just so i understand this,

I would agree with most of that.
On the tax/EX thing, with your included divorce decree, it would be intuitive that you were eligible to file together with your ex, if you were still married more than 6 months in that particular tax year.
They say the I-134 should be as recent as possible, 'cus of it being notarized, but I guess 3 to 4 months is reasonable.
What the consulate will ask will depend on your consular officer and the consulate you're going through. Most will required the last year's tax returns.
About the former wife you can write a statement explaining the situation.
thanks everyone for replies.. all great information as usual
good luck to all of you ...ill keep fingers crossed

one more question:
i heard that my fiance can apply for or is automatic when she
arrives in new york or new jersey to get a work permit
that is valid for 90 days... so possibly she work for 90 days
then when it runs out she"ll have to quit job until she gets valid

she has no mortgage, but her father is still alive and not in great health.... she has a bank account that will not be closed. other than that i guess she would have none.....
Is her father going to be okay?
i think so...(she just lost her mother june 20th)....so she is sad there and just wants
to leave....
She's sad, but the reality is that you and her will have a lifetime together... she may not have much time left with her father. Once she arrives in the States on her K-1 and you two get married, you would be able to apply for advanced parole in with the AOS packet. She can't leave the USA without her AP because she wouldn't be allowed back in. I believe it's possible to get AP faster in an emergency situation like a relative dying, but I'm not sure about that, I'm sure someone here knows more about that than I do. If she moves here and her father's health crashes even more, she may or may not be able to get back to the UK in time to spend time with him before he passes. So... this time before she moves to the States MAY be the last chance she gets to spend quality time with him.
I also don't think a bank account is enough of a tie to her home country to convince the border control officer that she won't stay here. I don't have any other ideas of ties to suggest, though. Does she have a job that she'll be returning to?
Do you have a co-sponsor? If so, is it an option for you to go to the UK for a while? If you don't have a co-sponsor that idea might not work as you have to prove that you'll be able to support her financially, so...
they love her at her job, they may write her a letter or possibly hire her back, if she has to go back
before we are approved.
we heard that she wouldnt be able to go back without proper paper work. we've discussed it
well thanks for information... what to do what to do !!!!

Hi there Rod,
The first thing that your fiancee will see is Packet 3, which is sent to her at her UK address by the Consulate. You do NOT receive a copy of this letter.
Packet 3 contains a checklist and a few forms. The forms that she will need to fill out are:
DS-230 Part I, DS-156, and DS-156K. The DS-156 must be filled out using an on-line form. You can do this at this web page. Note that the web page does not save what you type, so you have to print the document or save it as a pdf when you are finished. So, before closing the web page, print out the form and triple check every detail. Note that this electronic version creates a 3rd page that has a complex barcode. This page must be submitted to the London Consulate along with the 2 text pages. The other 2 forms can be downloaded from this web page.
Your fiancee can fill out all 3 forms any time she likes. Just don't sign or date them until Packet 3 has been received and it is time to return them to the Consulate.
The only thing that you send to your fiancee for the interview is the I-134 and its supporting documents. You can get the latest version from the USCIS web page.
Once Packet 3 is received, the checklist says to return the DS-230 Part 1, the DS-156, and the DS-156K as soon as they are complete. Only the forms get sent back, the supporting documents for each form get taken to the interview. The checklist also mentions a DS-157, but this only applies to males, so you can ignore it.
The checklist also needs to be returned once your fiancee has all of the items that it mentions, that apply to her. The checklist lists the following: passport, valid for at least 6 months, birth certificate, adoption certificate, deed poll, marriage certificate(s), divorce decree(s), court records, military records, 3 color photographs (same style as was used for the G-325A), and a police certificate.
She should apply for the police certificate right now. It takes about 6 weeks to arrive. She needs to go to her local police office to request this. I don't recall the exact form title, but if you search for "police certificate" on VJ you're sure to find the details.
Can she do all of this while in the USA? Pretty much, so long as she has the details needed to fill out the forms. When she arrives, her name will already show up on the immigration computers, so she has to have proof of adequate ties to the UK. A letter from her employer would be good. Since she lives with her parents, she doesn't have a mortgage or lease.
Best of luck,
G
thanks g
that was so helpful...i cant wait to talk to her now.....

Hmm. My thought at the moment... If she came for 3 months before you mailed the petition, all would be well. But the process has already started. At the border she will have to show strong ties to her home country... as the fiancee of a US citizen she will be assumed to have immigrant intent, and will have to prove that she has reasons to go home. Normally, these ties are mortgage/lease... a letter from an employer stating the date she will return to work... the date of her interview in the UK... etc. If she's coming for 3 months I assume she has no mortgage/lease to pay while she's gone? I also assume she has no job to return to? Since you just got your NOA1 there's no interview date set yet. What ties to her home country could she use? Does anyone who knows more about that stuff than I do have suggestions?

This may have been answered before:
noa-1 received 7/27/06
My fiance would like to come here on her (tourist visa).
she can stay up to 90 days, if they allow it. my question's are
what or when should she start receiving things to do!
what's actually in packet 3?... is it information that i have to
send her?... then she sends it to her consulate... or does she
just save it and take it to her interview.
as long as she flies back home in time for interview ?
her dad will watch mail... he will let us know if something comes
from immigration.. he can overnight it does us...and we can
send it back...etc.....
will i receive the letter telling when the interview is or will she get it via the mail??

Also the imbra... if you didn't have one does the process go faster
any opinion is greatly appreciated

He has a copy but no - they say thats not good enough!! Is this correct ? Its their error not to mention
slightly concerning to think his medical record is 'floating' about somewhere! Can anyone pls advise?
