  1. I am in a bit of a sticky financial situation- stuck between short-term and long-term disability, and am wondering how long before the interview will I receive the notice of the date and time of the interview? It's critical for me as there will be three months with no paychecks.

    (My husband is English, we got married in November, filed for the AOS on Dec. 20, got Notice of Receipt sent Dec. 28th. On Jan. 10th we found out that our case was transferred to the CSC.)

  2. I am wondering if anyone else here has experienced this, or if anyone has any information on how this would be handled...

    We were married in November, filed on December 20th, and just heard that our case was transferred to the California service center.

    I was working throughout the K1 process and when we filed for the AOS making enough to meet requirements, but a week later was put on short term disability, and now may be going onto long term disability. With my company's longterm disability policy, I will be making $26,000 per year on disability, and will still be considered an employee, but I am wondering if this should have any bearing on our financial assessment since I am disabled. Has anyone experienced anything similar or can anyone offer advice?

  3. Hi Everybody,

    Question here: I am filing the I-864 affidavit of support for my fiance's AOS, and have only two past years of tax returns: 2005 and 2006. I did not work in 2004 as I was still in school. Will this be a problem? Also, I am easily making enough now to meet the requirements, and met them last year as well (21,000) but only made $4900 in 2005 as I was working part time. Has anyone else run into this? How are you dealing with it?

  4. We sent everything off yesterday morning by courier- my tax returns and W2s from last year along with my fiance's passport- so now we will wait until we hear from the embassy again. James (my fiance) called the embassy yesterday and they indicated that we should hear something in about 3 weeks, so I will update this thread when we hear what their decision is. In the meantime we will keep planning the wedding and hope everything will work out!

    Did you provide supporting documentation for the $40,000 - letter from employer and recent pay statements - and a new I-129f showing your current income?

    Might be helpful if you did, shouldn't be fatal if you did not.

    Basically, my income last year was 21,000 from 3 jobs, but I filed the I-129F in April and had received a raise to $29000 by then so that is the income I put down in that filing. Now I am making $40,000, so all three amounts are different. I explained that in the letter, I just hope they understand, accept it, and (Please Please Please) grant us the visa.

    Yes, I included all this (and more!) in the packet that my fiance took to the interview: copies of all my paystubs, a letter from my employer stating my employment status, my job offer letter from the company, and all my employee benefit information (ie he is my beneficiary for my $200,000 life insurance, so if something happens to me he is covered.) And Of course, I included an I-134 showing my new income. But they wanted the tax return as well I guess...

    I hope that will be all they want! We will of course be sleepless and worried until we know for sure.

  6. Hi everyone, and thank you SO much for your posts, advice, and encouragement. I faxed James (my fiance) my 1040EZ from last year, along with my W2s, which he will send off by courier tomorrow, along with his passport, a letter explaining the discrepancy in income, and a LOT of prayers.

  7. HELP! My English fiance got to the interview in London, UK today, and they suspended our petition pending that they receive my tax return from last year. They had never asked for it, and we did not know we had to give it to them.

    1) Has this happened to anyone else?

    2) Is this just procedural or a major problem?

    3) How long do they take then to issue the visa, if they choose to grant it?

    We have a wedding planned over here in the states for November 24th, so we are very worried about how this is going to unfold! Any help, suggestions, advice, or comments from anyone who dealt with something similar would be very appreciated!!

    I don't know the procedure for the K1 so apologies. For the IR1/CR1, last year's tax return must be attached to the Affidavit of Support even if you are using assets to prove finance requirements. We filed late returns in London at the Embassy earlier this year before our interview and it could not have been easier.

    I'm sure someone else on the forum will be able to give you a K1 specific answer, but Good Luck. :thumbs: I am sure it will be sorted out quickly.

    I forgot to add that I have changed jobs since filing the I-129F, and that this doubled my income over last year, from 21,000 to 40,000. So my current job is not reflected on the return. should this make any additional difference?
