  1. Hello, can you clarify, no timeline to file AOS meaning some people can choose to take their sweet time to file for AOS after marriage right?

    But at the same time will also be out of status? How long is the validity of the I 94? Wouldn't "out of status" be the same as being in the US illegally and thus, at risk of deportation/prosecution?

    I hope experienced VJers can help clarify. Thanks!

  2. Also one more thing I want to add, what do you mean by him being your financial sponsor for a tourist visa? I don't really remember coz it's been a while but if I'm not mistaken for a tourist visa and to gain entry you have to show that YOU are bringing enough money to travel around the US for the length of stay you intend to be in. I remember in my planning for my visit to the US, I made sure I had enough money (80-100 / day) and also a few credit cards for emergency purposes etc. I definitely don't remember involving my fiance in the application for the tourist visa.

    I think what's important for B1/B2 was to show you have strong ties to Malaysia and will definitely come back before your visa is up. In my case, when I applied for tourist visa back in the days, I showed that I had a stable job and family ties here, and I also showed return ticket at POE.

    I'm not sure how to help you since you already got denied once. My suggestion is that he can come to Malaysia, the flight cost is the same, and in fact the cost of him staying in Malaysia may be cheaper than you staying in the States for however long you want that visit to be. That way, you don't have to worry about getting a tourist visa, you'll get to meet your boyfriend and get to know him better, and if you do decide to get engaged, the requirement under K1 would have been met.

    Just my view from my limited experience. Hopefully more experienced VJers can help give more information.

  4. Hi, I'm new in this forum and not very knowledgeable but I hope OP gets her answer as to her question about her AOS status and possible divorce. The thread seems more skewed towards asking about her relationship and giving her relationship advice instead of answering her technical question, although it's good to see OP is getting support and good opinions about this.

    My 2 cents (relationship-wise, sorry OP!):-

    Previously, I was in a relationship for 8 years (local relationship, not related to anything cross borders), we both were young when the relationship started so yes, it comes as a shock when one day, 8 years later, it seems like you wake up and realize ####### am I doing with this person. It took me a while but I realize my significant other at that time had no plans, weak ambitions with no real actions taken, likes to blame the circumstances instead of working out ways to improve things. I tried to work it out too, because lord knows everybody has their down moments right? But after a while I realize this person is not going to change. What's worse, when I try to make plans to improve my life (get an advanced degree, change jobs etc) I would always be blamed for "trying to leave". So it was hard, but you gotta realize when the lump has turned into cancer (figuratively) and you gotta cut it off.

    I hope you get support and love, it's going to be tough especially in light of your AOS and other matters. Good luck!

  5. Congrats! You can start filling out your DS-160, book the medical appointment and book your interview! Your embassy will send you instructions on what to do once they receive your petition.

    Hello, can I get clarification on this? Because I've read where people say each Embassy is different, so shouldn't we wait until we get the instruction from them first?

    Or does it mean that by having your case number, you can go ahead and do your medical checkup by yourself? How do we book interview with the Embassy if the Embassy themselves haven't received our petition?

  6. Question about POE and visa expiration dates:

    My fiance and I are hoping to have a POE date of June 1st (ish). The process is going pretty fast compared to what I was reading while putting the packet together. (We have a couple of international trips planned and our wedding date is June 24th)

    From what I read, I thought the visa expired 6 months after it was issued (around the time of the interview). I was reading on another thread that the Visa expires 6 months after the medical appointment.

    Does anyone here know the details on when/how the visa expires specifically (so we can strategize our timeline). We want to try to make June timeline work, if possible :) . Thanks in advance! :)

    I'm facing the same thing as well. Even though we are happy the approval came in fast, but the planning now has to be adjusted.

    For work, I actually initially planned to stick around until March to help close a few matters, but from the way things are going, it would seem like the interview will be around Dec or Jan?

    I hope somebody can share their knowledge or experience on the validity issue.

  7. Yes we received our noa1 almost at the same time. I check your timelines guys ahahaha. Eversince my fiance filed my petition i became super agitated my fiance always tell me to chill ahahaha!!!

    Ha, same here. We are in a position where our status quo isn't so bad (just continue working, business as usual, just wait and do the process step by step), but ever since filing my mind has been racing with 1001 thoughts of what if this, and what if that, and my fiance keeps telling me to chill. XD
