  1. Thanks everyone! My husband doesn't want me to keep his last name after the divorce. So can i change my last name back to my maiden name after the divorce (after May this year)? because if I change my last name on driver's license and SSN card, I will have to change last name on the green card as well, I don't want to complicate things if not necessary. Or should I wait until I become a citizen? I'm very confused right now.

  2. My citizen husband filed for a divorce in January of 2017; he's dating another woman. We're not officially divorced yet (we live in PA). I just got news from the attorney who helped with my case that my application for 10-year green card has been approved and i should get the physical card in the mail within 60 days. Couple weeks ago, I found a new attorney who was going to help me with the waiver and we've been gathering evident to give to uscis that my marriage was legit. And she told me that she's very confident that my case would be approvable. But now that i got my 10-year green card, she said we don't have to file for waiver anymore. However, I think she should still help me notify uscis that my husband and I are getting a divorce so it'll be easier for me for when i apply for citizenship in couple of years but she told me to wait until i apply for citizenship. I don't get it. What should I do now? I still think I need to notify uscis after my divorce is finalized in May 2017. I don't want to get into trouble with uscis when I apply for citizenship or have my green card revoked because my marriage is legit.

    I have different answers from my immigration attorney and an USCIS representative. My ex husband and I applied to remove my conditional residency status jointly in March 2016. We entered into this marriage in good faith and real. But he wanted a divorce in September 2016. We've been separated since September 2016. I think the reason he wants a divorce is because he met another woman and my neighbor has met her. Anyway, my attorney told me that as long as the divorce is not finalized before approval, i don't have to do anything. If it's finalized before approval then I can apply again as myself. But the USCIS representative told me that it's not when the divorce is finalized, it's when he files it. Please help.

  4. Hello, my husband and I have been together for more than 5 years and been married for almost 3 years. He is a US citizen and we just jointly filed for me to remove my conditional permanent resident status in March 2016. I have not received my 10-year GC yet, i think it could take until May 2017 to receive the results. My question is, he now wants a divorce but hasn't filed the divorce papers. My divorce lawyer told me that in order to avoid him removing me from his health insurance and for me to get financial support for him, he or I need to file the divorce soon. Will it affect my status or the chance of getting GC or citizenship if I'm the one who files the divorce papers even though I don't want the divorce, it is him who wants it. We have been separated for 3 weeks now and it's been very stressful for me. Before we got separated we went to see a marital therapist, I was the one who initiated it. Thanks!

  5. Hi everyone,

    I got married to a US citizen and got my 2-year green card on May 29, 2014. I filed and got biometrics to remove the conditions and to get my 10-year green card on April 3, 2016. A week ago my husband told me that he wants a divorce. So here is my problem: I have not received my 10-year green card yet and USCIS told me that I would receive it in February or March 2017. I told my husband that he could have the house and all assets (all under both of our names) if he waits until I become a citizen in May 2017 but he disagreed. He talked to his divorce lawyer and they are drafting an MSA and post-nuptial agreement so that the assets division agreement and all the divorce papers will be signed now but won't be filed until the end of February 2017. He wants to have an uncontested divorce which will probably take only 90 days until the divorce is finalized. I'm just afraid if they file the divorce where all the agreements and everything have been signed then it will only take 90 days for the divorce to be finalized. I'm afraid the divorce will be finalized before I could become a citizen on May 29, 2017.

    I have some questions want to ask everyone since I just lost my job and can't afford a lawyer.

    1) Does he have to sign the naturalization application for/with me and be physically present at the interview for me to become a citizen?

    2) If the divorce is finalized before I become a citizen in May, can I reapply in 2 years to become a citizen? What do I need to do if I can't become a citizen in May 2017 but still want to become one?

    3) This may not be related to immigration, but i took a big student loan for my grad school after we got married. If we have a contested divorce, does he have to be responsible for half of my student loan?

    I feel like if I receive my 10-year green card in February/March and don't need him to sign the naturalization application and be at the interview and could reapply in 2 years without any conditions, then I should not let him have all the assets and all.

    Please help.
