Hello,
Can anyone clarify this for me please? If someone is currently in the US and was previously given a 20 year bar but have spent 16 years of that bar outside of the US. However, they have had a name change and have returned to the US due to meeting an american citizen and have gotten married to the american citizen. Can you apply for a waiver while in the US?

Thank you, we submitted the I-130, I-485, I-765 and I-131 for my spouse who is here on a 6 month visa. Will we be ok in terms of the visa expiration now that we have submitted all the application in particularly the application to adjust status. Once the application has been received and they give us a case number we should be ok right? Currently we have until end of April 2017 on the visa.

I am new to this forum so please forgive my ignorance. Does anyone know how long it takes after your application has been delivered at the USCIS office that you get a file number or is contacted to confirm receipt?

After a 5 yr ban she seem to have tried crossing without a waiver, but she can apply with I 192 waiver at land border
its descretionay.. 20 yrs ?? she did not readiliy disclose the 5 yrs ban?,,,.Atty Cohen in Canada takes care of these
waivers speak to him..,what you stated says her ban ends in 2026

Thank you! would she be able to apply for work in US in the future? At present she works for a multi-national company and they are looking at promoting her and she would need to work in the US.

I forgot to mention, if she had a name change during the time she was banned and have not entered the US but would like to enter the US would that cause any problems?

what is a 212 d 3? If the bar is up next year then she does not need a waiver?

My sister was denied entry to the US in 1997 because she did not have a proper work visa. She was barred for 5 years and did not attempt to return to the US until 2006. She was denied entry in 2006 because she did not have a waiver. She was told she cannot enter for 20 years. can she try to get a waiver now?
