Do they even have the right to deny based on an arrest? I would think Coffin v United States firmly established presumption of innocence. Now if the charges aren't dropped, this goes to trial, and he's convicted, all bets are off. But until then what legal right does USCIS have to deny having conditions removed based on merely an arrest*?
*This is a theory question. While it may be the case, please don't assume so without advising legal counsel. I'm just curious what members have to say on this.

Does anyone know if the European Union countries are ever going to move towards a common visa? It's a bear to apply for 5 or 6 visas if you want to visit multiple countries and require a visa for each.

Yes, your case number will be MSC-xxxxxxxxxx, and that number will be found on the back of your cashed check.

We just had our interview a little earlier today in the Charlotte USCIS office.
Got there 10 minutes early and waited in the interview holding room.
Interviewer called us promptly at 10:30.
Followed around the hall to her interview office and were sworn in before being seated.
First order of business:
Asked for her both our IDs (i.e. Driver's license), her birth certificate, passport, SS card, EAD card. After looking things over, realized she travelled on AP and asked for that too. She then removed her I-94 from the passport.
Began by questioning my wife if she had ever done any of the "No" questions, which fortunately she has never done and naturally answered "No." to all of them. She then asked how we met, and I said we met in a Bioengineering course we took together. She asked me a little about my work and then dropped what I perceived to be a major hint: "On your greencard, do you want your maiden name or to take your husband's name." At that moment any stress I had disappeared.
She then asked for supporting financial documents. We provided the joint lease, bank account, investment account, and income tax return. She looked them over briefly and had no further questions.
She then asked us for photographs, which we provided. She looked through each album attentively and asked questions occasionally about what was going on. We talked about how we had a civil ceremony here first, followed by a wedding in India according to Hindu customs and that we plan to have a Roman Catholic ceremony this summer. Asked if my family went too which I replied "Yes." Also asked if that was the first time meeting her parents to which I stated "No, we also went same time last year." and directed her to that particular album of photographs. She then asked a general question about the Taj Mahal and thanked us for letting her see the pictures.
Best part:
She then looked at us and plainly stated "You are approved..... (blanked out the rest of the sentence)." Lol. Asked if we have had any questions so I softballed her the "Conditions for removal" question.
Best best part:
Right in front of us she pulled out her stamp and inkpad and gave my wife the temporary LPR stamp in her passport and told us the permanent card should be received in about two weeks. All I could think was "Wow is this really happening?" with what I imagine was a huge stupid grin on my face.
At that point she asked us one last time if we have any questions and concluded the interview with a "Thank you", smile, and a handshake and sent us on our way.
I couldn't be any more pleased with the experience. They were prompt, efficient, and courteous to us. No challenging lines of questions or stances that would make us feel concerned. I don't know why we had it so easily but I'm thrilled and very fortunate. I also thought about everyone here at VJ stuck in the FBI name check and said a quick little prayer for all of you. We had a rough, rough 2006 but our love and faith allowed us to persevere. I hope everyone here stuck pending keeps the same amount of faith. Just to follow up on the enrollment stuff do realize that applying for AOS invalidates your F1 visa, as adjusting demonstrates intent to immigrate.
This matters to you most for re-entry into the US should you want to travel. Even if you stay enrolled, your F1 visa will no longer be a mechanism to enter the country. You'll need to apply for Advance Parole (I-131). Just a heads-up so you don't make that mistake.

Well we're back from India. Trip itself was great, amazing wedding according to her customs, and actually I'd say Immigration was great as well... it was the airlines that made me hateful, but that's a different story for a different day. Just wanted to post this since I saw a lot of disparity on peoples' experiences re-entering on parole.
In Frankfurt (last stop before POE) the agent was informed of what my wife's AP was. I asked her if she sees those often out of sheer curiosity and she replied "Oh sure, all the time." That's comforting to hear.
In Charlotte (POE) the Immigration official gave my wife no problems at all. Asked her a couple softball questions and gave her a card and took the AP and passport since he stated he couldn't himself stamp it. We sat for about 5 minutes in the Passport Waiting Room and they handed it over no additional questions asked, no comments made. They stamped on the form "Paroled until Feb 05, 2008" Thought that was interesting since the form is only valid through Jan 2008. After that it was Customs and that took forever, but mostly because we made a declaration they had to look into for more information. No gripes for that either.
My wife is home safe and sound. Our interview is in 6 days. I'm so relieved.

We filed at the end of October and received our interview appointment today.

We got a touch today on an approved EAD as well. At least you're not alone so you don't have to worry about being singled out too much.

I just received my AP today
They mailed it four days after approval. Funny, they sent me TWO identical documents, both valid for multiple entries...

That's interesting. The way our email read we were approved on the 6th and it was sent on the 6th but we didn't get that actual email until the 10th. My guess is that it wasn't really sent until the tenth and we'll get it today or tomorrow based on your results.

I just got the three emails. It was sent on the 6th so we should have it imminently. I'm overjoyed and speechless. This is a little 11th hour miracle. We won't be separated after our wedding in India (2nd one, in accordance with her religion).
Don't lose hope or faith, everyone! Those are two things no one can take away from you.

I can't answer that question but I can congratulate you. Hope they arrive soon, and don't forget to update your timeline.

My wife is the most important thing in my life and my biggest source of hope. She needs her AP desperately so we can get married in 20 short days according to her religious beliefs. There's not a price I would not pay to get this processed sooner because dammit, we're not skipping this even if it means we have to abandon our application. We didn't choose this date, it was chosen by a 'priest' so to speak based on our birth dates and time. We refuse to compromise our beliefs for beauracracy. It's tearing me apart thinking about the consequences. But there's what's the law........ and then what's right.

They definitely did her Biometrics and 10 prints for the 765 and 485. Since we were doing a same day InfoPass and ASC appointment (they told us to just go over with our NOAs for the respective documents) they stamped and wrote on those NOAs. So we do have a paper trail of sorts that showed we did show up, as well as the paper work you fill out when you reach ASC and the yellow card they have you place in the box.
So I guess ultimately my question is: Can we disregard the second Biometrics appointment or should we do something about it? And by doing something about it, would a call to Customer Service be enough or should we make an InfoPass appointment again and bring the NOAs the ASC stamped and wrote on as supporting evidence? I'm leaning towards the InfoPass appointment because I'd rather sacrafice an hour than sacrafice several weeks.

Well today we got some good news and some strange news. The good news is we're getting mail from USCIS. That beats getting emails that items sent were returned as undeliverable! The strange news is the letter was for a Biometrics appointment in Jan. As you can see from our siggy, we had an InfoPass appointment last week where they had my wife do her Biometrics on the same day at the Charlotte ASC.
Intuitively, I feel like this second letter was generated from the MSC because we got our address situation squared away at our InfoPass appointment and this is just a redundant and unnecessary duplicate of sorts. However since the consequences of missing a scheduled appointment can be extreme, I'm left wondering what we should do: Call Customer Service or schedule another InfoPass appointment. I searched the fora for another example of this happening, but didn't see one.
Any suggestions?
