  1. Same happened to me. I sent them anyway and everything was fine. I did include a statement explaining that I was assured at the photo shop that took the photos in Lima, Peru that these were "passport photos" and I hoped everthing was ok with them.

    My fiance sent me passport photos, and they do not meet the 2x2 inch criteria, I resized the photos and they seem fine and meet the criteria now, except for the fact that the shoulders are now a little cut off .... Does that matter or does the photo need to show the upper chest and shoulders completely. Like everyone else, i dont want to have to wait for her to get another photo and send it, since it takes several weeks ... Any advice would be great.,, Thanks

    This is not my case. It's about my friend, but I was wondering why.

    My A friend sent back the documents needed for making an interview appointment on Oct 26. A week later, she was informed that her interview date is January 2 at 7.30am. Her NOA1 is dated on March 8, 2006 and NOA2 on Sep 25, 2006.

    My B friend sent back the documents on Nov 7. Today, she was informed that her interview date is Dec 20 at 7.00am. Her NOA1 is dated on June 9, 2006 and NOA2 on Sep 7, 2006.

    My A friend is supposed to have an interview before my B friend, is it correct? They both provided a reason for having an interview ASAP that they both planned to get married before the end of this year. But why my B friend got the interview date before my A friend????? Could anyone clarify this to me? Thanks.

    Ladies and Gentlemen,

    I filed a K-1 visa, but I do not want her to see my tax returns, and see my bank statements. Is there a process where I can send them ahead of time and immigration can take a look at them and decide. Call it being careful, but if by chance this does not work and she decides to stay on her own I do not want her using my money. I know in time she will find out , but I do not know her that well to leave financial records with her to take to the interview. Lennie

  4. I have the I-134 along with,

    1) Letter from my employer

    2) Letter from my bank

    3) Last three years of tax transcripts (not W2's)

    4) Last three months of pay stubs

    5) Form which shows my 401k balance

    6) Letter of continued support for Visa

    7) My birth certificate

    So my question is about this statement from the instructions sent with the I-134 packet as translated from Spanish:

    Declaration of Support the people in the United States that wishes to grant a guarantee to an applicant by means of a Declaration of Support will have to use the I-134 form. The guarantor also can do a Declaration Sworn before the Public Notary public showing his desire and financial standing or to contrribuir the support of the applicant and its reasons to do it.

    As I understand this, (if I am reading it right) this is a option in addition to the I-134 if desired but is not necessary. Write or wrong? What have you done?

  5. Congratz to you and Luis. Do you have any idea if the consulate in Lima looks at current earnings or only 2005 tax return. This year (2006) has been much better then 2005. :blush:

    Yes. all K Visas go through the Immigrant Visa section at the Embassy. We had instructions to download DS-156 from the internet, as it is not included in the Packet 3/4, and take it to the interview. Also, we had nothing to submit prior to the interview, but we filed for a K-3, so I´m not sure if that made any difference. Others that have filed recently for the K-1 were told to submit the I-179 (Datos Biograficos) before the interview.

  6. In our case the consulate provided a web address to fill out and print the form. It is not "savable" and must be filled and printed. The barcode appears on this form. Print two copies and then photocopy one of the originals for your records. My fiancee if from Peru and the on her form on the web the questions were in Spanish. So I would wait for her to receive packet 3 and go from there. Hope this helps. :thumbs:

    Hi all,

    Is it okay to download Packet3 from my beneficiary's consulate(Mumbai) and use those forms to send it to consulate? Or should my SO/Beneficiary have to submit the ones consulate send her in packet3?

    My 129f was approved about a month ago and my beneficiary's embassy had already received the case to further process K3 however, we're still awaiting on a Packet3 that was mailed by Embassy on Oct.19th,2006!!!! I sent 5 requests to Embassy asking them if its okay to download packet3 and use downloaded forms and apply for K3?still haven't received any replies. Some one please advise what should we do? Embassy is about 10 hours away from our residence and i m not certain if the embassy would hand her packet3 at the consulate's Visa unit?

    Also, I noticed DS-156 form also has a section for 'BARCODE'? where do we get the barcode from...confused**

  7. Have they already set an interview date in the packets you received?

    Maybe you should download Forms DS-156 and DS-156K and bring them with you to interview.

    Stange but they sent a second paket with the DS-156 and 156k, etc.... and the interview date is still December 1st. :D

  8. All consulates treat K visas as immigrant visas and use immigrant forms such as DS-230. The K visas are technically non-immigrant visas but ultimately they are coming to the USA with immigration intent so will do immigration paperwork, and the visa is handled by the immigration unit at the consulate.

    Because a fiancé(e) visa permits the holder to immigrate to the U.S. and marry an American citizen shortly after arrival in the United States, the fiancé(e) must meet some of the requirements of an immigrant visa.

    Correct but why have others recieved a different paket for the K visa? Any clue?

    And Lima sends Packet 3 and 4 together :unsure:

  9. My amor received her paperwork (packet 3 & 4) and I am very confussed. It seams she received paperwork for the "IMMIGRANT" visa and not the K fiance(e) "NONIMMIGRANT" visa. They send to her;

    1. Instructions

    2. DS-230 (2)

    3. Medical

    The instructions say the fee is $380 for each applicant (her and her daughter). It should be $100 each applicant. A K visa is concidered nonimmigrant. I am very confussed. They did not send form DS-156 and DS-156k as I was expecting! They also say the $380 fee can be paid the day of interview and they do not indicate anything that needs to be submitted before the interview. I am sorry to carry on but from what I have read this is completely WRONG! Please help. I am very confussed.

  10. I have read the guides and the instructions for the i-134 affidavit and I thought it said the I-134 needs to be notarized. Yet I read posts that say have he bank letter, tax transcripts, letter from employer notarized also. So.........which is it? I think some people have all notarized just to be on the safe side. Please help, interview December 1st.

  11. I am so happy for you!!!!!!!!!!!!!!! :dance::dance: My fiancee and I are going to be going through the consulate in Lima too. Congratz :dance::dance:

    Well, yesterday Oct 3rd i was soo nervous. I was there at 6.30 with my fiance, then around 8am a very nice woman called me to window 13 to ask for my passport, pictures,etc.15 minutes later, other woman called me to the same window and she asked me for my certificates, evidence, pictures, emails, everything, my fiance was always next to me. :P they only asked him do you speak spanish? he said a little bit. they asked me everything in spanish. she started to ask me about how we met, how many times he was in Peru, nada mas. 2 or 3 questions. There were 2 couples more waiting for the interview. The first couple got the visa( they went to room 15) the woman is peruvian and her fiance from Miami, USA, she was crying and she was very happy. Then, a man called me to window 9, he was very nice. he asked me how we met, how often we talk by phone, i said everyday :P then i saw a pink card in my passport, i thought: oh oh, the other girl had the same card when she got the visa. I was more nervous!!! Then the man told me you have 90 days to marry him in the USA. Do you have any problem? I said of course not. and then he gave me the pink card. I was so excited!!!!

    I GOT THE VISA!!!!!!!!!!!!!

    I cried a lot, the other girl were waiting for us, and we waited for the other couple. they got the visa too. We were so happy and we went to Starbucks to celebrate.

    Now i feel so relaxed and very very happy. Wow! i have the visa! I cant believe it!

    I wanted to share this with you.

    It was just about 1 month after my congressman's office contacted VSC about my case that Maylene and I were approved. They said that my case was with a adjudicating officer and I should hear something in a couple of weeks. USCIS talk for 4 weeks I guess. So, any day now, hang in there man!

    Well seeing as I never got an NOA1 this email from VSC came as a little bit of a surprise.

    APPROVED! "this case has been approved on September 28, 2006, an approval notice was mailled....

    (also kind of odd it was mailed at 8:30pm)

    Like I said in one of my previous posts I don't care if I get my NOA1 as long as I get NOA2. Hope everyone else gets theirs just as fast. On to the next phase.
