  1. hello everybody

    i have gotten an RFE saying that the I-864 for the joint sponsor has a mistake the names in the page 1 and page 3 are not the same

    so i have a couple of questions

    it says that i must submit the form I-864 for my join sponsor with the supporting documents which is fine

    but the thing is i found that there might ( i am not sure if i am right) be another mistake which is in I-864 for my wife ( petitioner) in part 5 item 7

    and what i did is i put 2 and did not submit two I 864A,  i submitted only one between my wife and the joint sponsor which is her dad

    will i have another RFE and is what i did a mistake or could that not be a problem because my joint sponsor excedes the poverty guildline thingy and should i submit an I 864 for my wife which is my petitioner with my response even though on the RFE it says joint sponsor

  4. The mother does not have to fill out an I-864A, if the father makes enough for joint sponsorship on his own. However, if she is willing to fill out the I-864A to go with her husband's I-864, then she probably should. If the father sends an I-864 without his wife submitting an I-864A with it, then be sure he follows the I-864 instructions and sends a copy of his W-2 with the IRS transcript of their joint taxes to show his individual income from joint filing.

  5. hello, i am in a similar situation

    I brought my fiance on a k1 visa

    i am applying for the adjustment of status for my husband

    i filled the I 864 for myself even though i am a full time student and i do not have any income and i am relying on my father who i also filled an a I 864 for him and he ( my father ) has the 125% income requirement.

    i am confused do i need a i 864A for my mother or is what i have is enough

According to the State Department's website (https://travel.state.gov/content/visas/en/fees/reciprocity-by-country/SY.html), they recognize that police certificates might not be available to Syrian citizens who are residing outside Syria. So, you should be okay with that. I would write out the explanation, i.e., that he left Syria at the age of 17 (3+ years ago) and has not been back and has been unable to get the certificate fromm outside Syria.

    Have you tried getting the certificate from Lebanon? The State Department's site (https://travel.state.gov/content/visas/en/fees/reciprocity-by-country/LE.html) does not say anything about visitors being able to get them, but indicates the process for those living outside Lebanaon. But, since the application for those in Lebanon requires an identity card, a logical argument could be made that it wold also be needed for those otside Lebanon and that they would not be available to those who were only visiting. I would suggest you also write up your explanation on that as well -- that you can't get one as he was merely a long-term visitor -- and see what happens.

    The worst would be that they would 221g the application until you can demonstrate that you have exhausted all avenues of getting the documents or you get them and present them to the consulate.

    The age of the family record and birth certificate (assuming they are offical records and are still readable) should also not pose a problem. In fact, the age of the documents might actually be viewed positively as they might be viewed as more believeable -- it is unlikely that he got fraudulent documents years ago with the intention of using them years later to immigrate to the US.

  7. hello i am the petitioner for my k1 fiance who is from syria and living in turkey, My fiancee, omar's, interview is september the 21st but I'm worried about not being able to provide a couple of documents. obviously since syria is in war it is very hard to get anything from the government ie family extract, birth certificate, and police records. omar has his original family extract and birth certificate but they are old and not recently printed which I'm not sure is required in the Ankara embassy. me and omar are both 20 years old and omar left syria at 17 which makes him elligable for a police certificate. he also stayed in lebanon as a visitor for 8 months before moving to turkey, does this mean he needs a police certificate from lebanon as well even though there is no way for people who were just visitors in lebanon to get a police certificate (omar commited no crimes and has never been convicted). please give me advice, I'm afraid the consular will not understand his difficult circumstances! if there is any advice you guys could provide that would be great!
