  1. Hi,

I was just wondering if this is something we should be concerned about. When my wife got her K1 visa, the alien ID number started with A98...., but at the POE the wrote A99..... When we filed the AOS we called this to their attention, and things seemed to be moving well. She received her work permit, permission to travel, and hopefully soon the green card interview. I just now noticed that all the paper documents she received referecing the case have the A98 number, but her work card and travel permit have the A99... number. Is this an error, or is it a notation that they use to indicate that something has been completed? Should we be concerned? According to the schedule of the CA service center, she should have been up already for her interview, but I am assuming because we got a RFE in October that the delay is for that reason. Should we just wait a little longer, or should we try calling about this issue? How easy is it to call about these issues, or even to find out if we are on track to have the interview?

    Thanks

  2. Hi,

We filed last August for the AOS, and in October received an RFI. We sent the requested information back, and never received confirmation of reception of it, but in November our case was then transfered to the California Service Center for processing, so I assumed everything was good. The timeline of processing on the CA Service Center shows applications from mid September being processed. Will we have lost 2 months in our wait because of the RFI? I'm just wondering if I should be concerned or not.

    Thanks!

  3. Hi,

My wife currently has a pending AOS, and we moved about 2 months ago. We filed the AR-11, but I now notice I forgot to file the I-865 (change of address of sponsor). This was required within 30 days of moving. Because they know the date of the move from the AR-11, I'm worried they will know I didn't file in time. They ask for the date of the move on the I-865, and I'm not sure if I should say Oct. 1 to look like I got it in time, or say the actual date, and risk any penalties of being late.

Also, my dad was a cosponsor for her, and I am not living with him anymore. Will me moving affect my afadivit of support? I now am above the salary requirements, but wasn't at the time of filing. We currently have an RFE for more information on my dad's job, so I am sending info on mine also. Should I send in a new I-864 also?

    Thanks

  4. Hi,

When my fiance and I filled out the AOS package, we were living with my parents, and at the time I didn't have a job, so I used my dad as a cosponsor on the avadavit of support. Since then, we have moved, and I have a job. I am wondering about submitting my change of address. Will they call into question my dad as my cosponsor if I change my address? Is it even necessary to change my address, since I still get mail at their house, or would this generate problems later?

    Thanks

  5. Hi,

I am filling out the I-485, and noticed that the immigration officer in the port of entry accidently marked my fiances I-94 with the wrong alien ID number (one digit is wrong). Does this matter? Is it possible that he would have entered this wrong number into the computer in a place that would cause problems? Should I call this to attention in the cover letter of the I-485 packet?

    Thanks,

    JGL

  6. Hi,

I am living in Chile, and my parents are co-sponsoring me on the I134 since I have not been working full time this year. I already received their notarized documents, but was wondering if I also need to fill out the forms as well, despite the fact that I don't meet the requirements. If so, can I get it notarized at the cosulate the same day as the interview (the embassy is far away from me, so we would only like to make one trip). If not, is there anywhere else it can be notarized?

    Thanks,

    JGL

  7. The K1 is actually almost through, we are just waiting for the interveiw, so at this point, the K3 is not an option. The main reason we want to have a ceremony here is because we don't want her family to miss out on the wedding. Could a non-binding ceremony really cause problems? How would anybody know? Anybody have any experience with this?

  8. Hi,

My fiance and I are going through the K1 process, and we are both going to be in Chile until we leave for the US after the Visa is issued. We would like to have some sort of wedding celebration here for her family before the real wedding in the US. Has anybody done anything like this? The problem we are running into is that she wants it to be in the Catholic church, but they will not perform the ceremony if we do not have the official civil wedding/paperwork. From my understanding we cannot have an official wedding here with the K1. Do they really know in the US if you do? Either way if there is any risk I would not want to take it. Has anyone had such a ceremonial wedding, scecifically in the Catholic or any other Christian denomanational church?

    Thanks

  9. I guess my question is different now that I am filling out the forms. I am working here, but for a company in the US, not a Chilean company. I am doing freelance work through the internet. I am not here on a visa, just my passport. And my checks for my work are being sent to my parents house.

I don't want to do the K3 because we want the wedding to be right before we leave, so we can have a celebration both here and there.

My inclination is to put all the addresses in the US, and just say I am temperarily living here.

  10. Hi,

I am currently living in Chile (for 1 year), and am filling out the K1. I plan on using my parents house as my residence in the US. My question is, should I list my address here as my current address, or list theirs, despite the fact that I'm not living there right now. My fear of using my address here is that I will not have a permanent address shown for the US. Would it look funny if I say I'm living with my parents, despite the fact that I will also be saying I have been living in Chile?

    Thanks,

    JL

  11. Hi,

I am currently living in Chile, and will be sending in the K1 appication. My plan is to send it to my parents first, because I need some documents that they have there (in the US). Is it a problem if the forms are sent from a different address than I am currently living at? Should I even list my Chile address in the forms, being that it is not permanent (1 year more or less)?

    Thanks,

    Josh

  12. The 125% is current assets, or amount earned in previous tax year?

I see you are applying through the Nebraska office, that is the one I will be using as well. Hopefully they are fast.

You'll end up applying through Nebraska and then being transferred to California - the world's slowest service center. That's why it's a good idea for you to plan on 6 months for processing time in the US. You'll also want to check into the average wait time for an interview in Chile.

BTW, you're fine on income, assets, etc. if you are 125% (I think) about the poverty line - something like $16,000 US. If not, you need a sponsor. I'm thinking you'll be ok.

  13. Alex,

I see you are applying through the Nebraska office, that is the one I will be using as well. Hopefully they are fast. You are going to live in Minnesota? I am from Wisconsin, which is on the border of Minnesota, and have friends there. It is a beautiful state.

Never mind, I read that wrong, obviously you are the one in minnesota.

  14. Thanks for the fast reply. We could get married here, but we would like the marriage to be near the date of the trip, in order to have a celebration both here and there. Additionally, we don't want the marriage to be so soon.

Would a parents house count as a US domicile? The could forward any mail for me if necessary.

Another question, I can't seem to find a straight answer on: what info is needed to prove financial stability? I have tax info from 3 years past with substantial income, several thousands in savings, but no current stable job (only freelance work that isn't that often). I plan on finding a job once I go back. Is this sufficient? Or will I need a cosponsor?

    Thanks

    Congrats on your engagement!

You will have 6 months after the interview. If you want to leave in May...you should start now anyway.

I am not going to answer your main question because someone else who knows more will have to do that. But I can say that my guess is that the most important thing is that you have a U.S. domicile. Then it is considered ok.

Have you considered marrying in Chile, and applying that way? I believe it COULD actually work better for you.

Ok now I will step aside and let the more knowledgeable folk answer. :)

  15. Hi,

I just found this forum while investigating the K1 Visa. I have a few questions. I am living in Chile, and have a Chilean girlfriend. We are going to file the K1 to get married in the US, and would like to come next May. Based on what seems to be the general waiting period, I would like to start the paperwork ASAP. My question is, can I do everything from Chile and mail it to the office in my state? Going back to the US before May is not an option.

My second question is how long after receiving the Visa she has till we have to leave. I am seeing both 4 and 6 months on this one. If we have 6 months, I can start the paperwork now, but if it is only 4 months I think I would have to wait a few more months.

My third question is whether the interview is in English or Spanish.

Thanks for your help. Anybody else from Chile in this forum?

    JL
