  1. My wife cleared the interview for K3 visa on Nov 3rd, and got her passport back with the visa stamped on the 23rd. She's expected to arrive in the US no later than the 3rd week of January 2007 :D

    The I-130 application is still pending with VSC.

    I have three questions:

    1) Is there any problem in entering US on K3 when that person has an approved I-130? I know it sounds far-fetched and I think the answer is NO but I just want to put my mind to ease by asking for input from the forum

    2) Once here - do we have to wait for her I-130 to be approved before we can apply for AOS (I-485??)?

    3) Does she need EAD before applying for SSN? If yes - how long would the whole process take?

    Here's my timeline:

    Applied for I-130 on June 26th (NOA-1 states rec'v date June 28th)

    Applied for I-129F on July 7th and got approval on August 17th

    Packet 3 rec'd at my wife's home on Sept 9th, interview date scheduled for Nov 3rd

    Cleared interview on Nov 3rd and was told to expect a passport in ONE week

    Rec'd passport w/ K3 visa stamped on Nov 23rd

  2. Seems like Q. 22C is a bit poorly worded/formatted. I just read the part:

    "Complete the section below if your relative is in US and will apply for adjustment of status.

    Your relative is in the United States and will apply for adjustment of status to that of a lawful permanent resident at USCIS office in:..."

    Didn't realize there was a follow-up

    "If your relative is not eligible for adjustment of status, he or she will apply for a visa abroad at the American consular post in .."

    So I left them both blank :(

    What would happen now?

    My wife got K3 and should be coming over sometime in January. We would actually prefer for her to do AOS here rather than having to fly back for this #######. Her I130 is still stuck in VSC which seems to have slowed down to a crawl.

    Thoughts... ?

  3. My Fiance received package 3.5 from islamabad embassey and the check list says to get the medical done along with other papers and send it back to them to get the interview date. When she called the clinic metioned in the list from embassey she was told to do the medical once an interview dates is received. Can someone who has gone through this procedure in Pakistan let me know what to do. I appreciate your input.

    I guess things are a bit different for K1 (fiance) visa. My wife got 3.5 packet for K3 visa which listed all the documents she's supposed to bring in for the interview at the US embassy -- the interview date is already given on this letter.

    So basically we have little less than two months to gather all the paperwork and show up for the interview. No need to send in any documentation before then.

  4. Just checked the status online and found out that the case has been approved (used post IMBRA form). Until yesterday, I was unable to check the status - used to get the error message that the receipt can not be found in the system.

    Receipt date: 07/07

    Approval date: 08/17

    40-days!! :dance: woohoo

    Question:

    I am out of the country at the moment. What are the next few steps betweenNOA2 and the time the case gets transferred to the US embassy of the country where my spouse lives? Is the NVC going to send me some forms/info that requires action on my part? :help:

  5. Ok for all thoes who had to send the 129 f to the chicago lock box and got a receipt number that begins with MSC....... how long did it take for it to actually work only online? I have had mine for about 10 days or so and every time I try to look it up on USCIS I keep getting this

    Validation Error(s)

    You must correct the following error(s) before proceeding:

    Status for this Receipt Number cannot be found at this time in this automated system.

    I know others have had this issue....I just want to see if any ones number is working yet and how long did it take from the time you recived the receipt NOA1 to the time that the number started working.

    wait about 8-10 days

    My receipt date is 7/7 .... cheque cashed a few days thereafter but still can't find the receipt no. online.

    Anyone has such a long wait before their case status showed up online? :huh:

  6. Regarding question #1, A# stays with you for the rest of your life even after you become a natz citizen. It's on your certificate. So just enter that.

    Regarding your question #2, 'Have you obtained a certificate of citizenship in your name?' ... it applies to you only if you aquired your citizenship through your parents (see the checkbox parent next to it?). Since it's not essential for minors to aquire their own natz cert if they got citizenship thru their parents, hence this question. In your cae (if you aquired citizenship yourself), leave this blank.

    For #11, they are asking if you have applied for a K3 before (or so I understood this question to be) and I'm pretty darn certain about it :lol:

    For part B 17, do not replace fiancee with spouse literally. Just put down N/A as it's mentioned in the instructions for the form.

    Dude - my advice, get someone else to review your entire form just in case since you seem to be having a problem with a rather simple form :P

    I filed I-129F just a couple of weeks ago and since then I've started reading this useful forum. I have learnt quickly about IMBRA and RFEs, and also called USCIS to discuss this issue.

    Basically, they confirmed my hunch that anyone who's used the old I-129F forms which didn't include the IMBRA question is receiving RFEs. They said they've even pulled back approved applications from embassies. Since the form I filed had IMBRA question in it - he said the chances I'll get an RFE regarding IMBRA are very slim. However, of course it's quite possible to receive an RFE for something else.

    Ok - so after all this rambling - I wanted to ask if someone can post what exactly is required from an IMBRA RFE.

    I've seen some member posting an affadavit template which one can get notarized and send in to certify that one hasn't been convicted of any violence against women/spouse/date/etc. Is this what's required to answer IMBRA RFE?

    In addition, I'd appreciate if forum members can share what's the nature of their RFEs other than IMBRA.
