  1. Hi everyone,

     

    Quick question for you. I was living in France when I applied for the CR1 visa following my mariage with my American wife. In the meantime, my employer transferred me to the US under a E2 visa. In order to continue the process (I had received the i797 notice of action before i moved to the US), I understand I have to request an adjustment of status (form I485), correct?

     

    - Does it mean the whole process will start over ? (I originally applied for the CR1 in November 2016..)

    - Do I have to pay the new fees (over 1,000$) ?

    - More importantly, given that I'm already working in the US (via the E2) and my salary is above the threshold requested by the administration, do I still need an affidavit of support ? If so, can my wife, who is still a student with no revenue, can complete the affidavit while combining both our revenues (basically mine) ?

    Quick update and a question to be sure I'm going through the right process.

     

    As explained previously, end of last year we applied for a CR1 visa (Spouse) as my wife is American and I was living in France. In the meantime, I received a work visa (E2) from my employee and I am now living in the US under this visa.

    Last week, I received the notice of action I-797 telling us that the petition was approved and sent to the USCIS. The next step being to make appointments to continue the process. As I'm not living in France anymore but in the US, what should be my next step ?

     

    From what I understand, i should contact the NVC in France that I won't continue the process and, in the mean time, apply for an adjustment of status (I-485), is that correct ? If so, will I end up with the spouse visa or directly with a green card ? And do you know how long is the process usually ?

     

    I just want to be sure that I'm not messing up somewhere and lose the 9 months we have been waiting for the first approval of the CR1.

  3. Hi everyone, 

     

    Quick question. End of last year, my wife and I applied for a CR 1 visa following our marriage in the US. As of today, the process is still ongoing (still on Phase 1, no news) and in the mean time, I received a job offer from my current company (french company with offices in the US). My question is: is there any problem to accept the offer and get a work visa (not like normal work visa, because it's considered as an internal transfer within the Company), while waiting for the husband visa in the same time ?

    Quick update on this topic. I'm still waiting for the feedback from the USCIS, feels like it takes so long !

     

    In the mean time, my job (I work for a french company with offices in Europe and US) offered me a job in the US. Is it a problem to accept a job in the US (and getting the visa for internal transfert) while waiting for the husband visa which request was sent end of last year ?

    Adil: I got married in the US so I don't need a translation.

    Regarding the documents, if I'm not mistaken, it is specifically said that USCIS does not request originals of documents and that photocopies are good enough a this stage so it's a bit weird. You have to provide originals at a later stage or if they make the specific request.

  6. Hi everyone,

    I know this topic has been discussed in the past but it seems that rules change from time to time and I would like your confirmation and opinion.

    My wife (us citizen) and me (french citizen) are currently preparing our package for I130 - CR1 visa and I have a few questions:

    1. It seems that they don't request any legal paper from the foreigner at this stage of the process (no birth certificate, passport, ID, etc,) like they used to in the past, do you confirm ? Should I send a photocpo of my birth certificate just in case ?

    2. My wife and I are young adults (27 and 25 years old) and we have no strong evidence of a bonafide marriage (i.e no joint property, no shared bank account, and no kid yet, etc.. you see the picture of young people). I understand that in that case, my only option is to provide information such as photos of our engagement, of our different trips, plane tickets, conversations etc.. Do you know how much information should be provided (I could put all our photos from vacations, and our skype logs for the last 2 years but i don't think they would appreciate having too much pages of raw data like that) ? So basically, How much info is clearly not enough and how much is way too much ?

    3. Apart from photos, tickets, etc, they say we can provide affidavits from third parties. Can any third party be elected for that ? (family members ? friends ?etc). Are they worth something ? And most importantly, do the letters have to be notarized or a signed document is enough ?

    Thanks in advance for your help and sorry if the question has already been asked. I just want to be really sure of what i'm doing.

  7. I’ve been reading a lot about visas and I remain quite puzzled by my situation. I would like your help to identify which road I should take going forward.



    A few words to explain: my girlfriend (US citizen) and I (French citizen) just got engaged and we are planning to apply for a Fiancé Visa K1 in order to allow me to move to the US eventually. I know that, once I move there, I have 90 days to get married and I’m okay with that. What’s bothering me is what comes next.



    I know I’m supposed to apply directly after getting married for AOS + EAD + AP however it seems that EAD and AP take several weeks/months to get. First of all, how do people manage that ? How are you supposed to stay in a country without being able to work for months there?



    As I’m currently working in Banking in France, I don’t plan quitting my job before I’m sure I found a similar one in the US (but obviously, US banks won’t hire me if they need to sponsor me). Therefore, once married, I won’t have enough time in the US to get the EAD and AP as I will have to come back to France for work (and taking 3-month vacations is obviously out of the picture).



    I understand that Consular Processing (CP) could enable me to launch the green card process while still being able to work for my company in France, right ? My questions are the following:



    * How does it work? Should I leave the country once married and apply for CP from the Paris embassy ?


    * While CP is launched, is it possible to apply for EAD ? The idea would be to come back to France and work there while waiting for EAD and then apply to American companies when I received it without a need for sponsorship. Is it possible ?


    * If I find a job in the US while on CP, can I switch from CP to AOS and move to the US ?



    So basically, my wonder is: how do people who currently work abroad manage this Green Card/fiancé process without having to quit their current job ? (especially when you can’t secure another one in the meantime)
