    Just need a little help, please.

    For those who filed their I-751 after divorce, I'd like to ask if it is required to have the ex-spouse sign the signature page on the I-751. I'm filing for a waiver due to divorce and my assumption is that the ex-spouse is not required to sign, but i'd like to be sure. Divorce is already difficult by itself; and having to contact the ex after months of not talking...well, you get the picture.

    I have my greencard and came home to Manila for a short visit. My question is: is there anything I need to present at the airport in Manila (besides my passport and green card) to be allowed to leave? Although I now work in the States, by virtue of my permanent resident card, I was never an OFW/OCW so i suppose I don't need an exit permit from POEA, is this correct? Medyo nalilito lang po ng konti. :)

  3. My EAD was also touched the day after I received the card. Hopefully you will get your interview letter soon. I was starting to think mine was lost in the mail (because Boston is processing applications in 3-4 months and I applied 3 months ago), but I did get it today. :) My AOS application still hasn't been touched since January.

  4. It's just depressing because this'll be the third job offer I turn down. I applied for an EAD and received it less than a week before my interview but it was taken by the adjudicator so I didn't even get the chance to use it. Sigh.

    Wow, that's really f***ing annoying. However you should tell the employer that you are work authorised (as your GC was approved), and according to the I-9, you have 90 days to present them with the evidence from date of hire. You should get your Green Card within that 90 days, fulfilling the employers I-9 legal obligations.

    Still it would be simpler if they just gave you the damn stamp eh? I had to wait 2 months between my interview and GC arriving, but luckily they "forgot" to take my EAD at the interview (I was approved at interview, no namecheck), which was useful as I was asked for proof of employment authorization about a month after my interview.

    You had to wait 2 months??? Wow! Now I'm getting even more paranoid!

    Yeah, it is sort of annoying. I don't even have any proof of status, right now. It's like, being undefined. When I had my I-94 and/or EAD, at least I could prove to anyone that I'm a legal alien. Now, I can't. Oh well. I just pray that it'll come soon.

    I tried to get a stamp through an Infopass because I have a very good job offer and the only thing the company needed to hire me was proof of employment eligibility. However, the officer didn't give me one and said that since they manufacture cards rather quickly now, they have ceased to give out the I-551 stamp.

    But, at least I'm done with the interview and namecheck so I'm counting my blessings.

    The topic has come up here in VJ in the past that I thought I'd research on it; thinking that it might clear things up for all of us.

    Forgive me if I'm wrong, but from my understanding, receipt of any form of medicare or medicaid WILL not automatically identify the recipient as a public charge in relation to the Affidavit of Support.

    Emergency medicaid for short term rehabilitation is a benefit that can be claimed without adverse results on the sponsor of the affidavit of support. Receipt of medicare assistance to pay for long term assistance like nursing homes payments, etc, is quite a different thing.

    I have to look into that, thanks for that information. This wouldnt be medicare medicaid for long-term assistance. But rather emergency medicaid for short term rehabiliation. So there might be hope... thanks again

  8. Let's say at the AOS interview, one is informed that the adjustment applicant's FBI namecheck hasn't been completed yet (i.e. approved pending completion of the FBI namecheck), will the adjudicator still keep the EAD or will it be handed back to the applicant? How about the AP?

    I would assume they'd return the EAD and/or AP until the namecheck is completed but has anyone had any experience on this?

  10. no, I haven't received an interview notice yet. I haven't seen an update on my 485 in almost a month. I think my interview might be delayed because of my rfe. you should see some movement on 765 soon-maybe next week since you are about 1 week behind me. good luck

  12. would it be okay to ask for the contact information (i.e. phone #, email) of the adjudicating officer so the beneficiary/petitioner can follow up?

    Has anyone successfully obtain this information before? If my memory serves me right, I've read of someone who mentioned getting the AOs contact info so she was able to follow up on her case after several months of waiting. Was it just my imagination or can you really do this?

  13. It depends on what the RFE is asking for. If it's for an initial evidence, then it restarts. But if the RFE is only for additional information, then the 90 days does not restart but is just tolled until NBC receives your response, after which, the 90-day time period resumes from the point of interruption.

    I found this document to be helpful in explaining the process. Scroll down to page 4, specifically, where it explains the processing of EADs, with or without RFEs (i.e. like supposedly making sweeps at Day 60 to identify pending EADs which have yet to be adjudicated.)
