Congrats! Can you please tell us the date on the NOA1 itself? That's the date we use on the list.

Hmm .. I just filed ours today but, I wont start to get worried yet seems it can take a while, maybe due to the fact TSC and NSC are not processing and VSC and CSC have an overload of petitions ??
To be on the safe side you should make an info pass appointment, last time i got a delay like that was because they sent an RFE that never got to my house and the case got on stand by. Only resumed after I sent the documents they wanted. Not to get you worried but, better safe than sorry Hang in there.

How do the spouse of a K-1 immigrant file taxes? Married? Single?
The problem is that my husband arrived here in 2005, and due to many problems we could only start the AOS process in September, 2007. They asked for last 3 years of taxes, and we sent those of 2005, 2006 and 2007. However, for 2006 and 2007, I filled taxes as single, which was the option that was given, since my husband does not have a SSN or EAD yet. Did I do wrong? Should we have filled jointly? If so, how? Will that create issues for his pending AOS?

Some good news for a change. Thanks for the quick reply. Our case has been going back and forth since Oct last year. We didnt receive EAD for like six months because of the lost RFE and we didnt know how it would affect the AOS process

Now What?
Hi everyone got an CRIS announcement today stating that our case was transfered to CSC and to await notification for instructions. Anyone has an idea why they transfered the case? Is it standard procedure?
Im worried here any answers will be apppreciated

Hello everyone this is what happened. My husbands case was going well after Oct 24 . We waited for EAD response from USCIS for around 120 days(to give extra time because of the processing delays) and the online status said "case received and pending) It still does to this day ,no Touched updatesor RFE sent or e mails ..nothing I called the National Benefits Center and and the representative told me to wait another 45 days for case to be revised or something. So thanks to Kezzie' s and Bora Bora's advice I didn't wait and scheduled an infopass appointment the same night. We went the next day and inquired about the case and the lady told us that an RFE was sent and they didn't receive response in the service center (MSC). Apparently it got lost in the mail or the mailman didn't deliver So she made a request for them to re mail it.
Today the copy of the RFE arrived.. they want some paperwork and i can get it. What worries me is that the paper states the case will be processed only if you sent the documents within 90 days from receipt of original RFE's date which was Oct 25 ( one days after my husbands biometrics) for EAD and 84 days for AOS. I could send the papers as soon as tomorrow next day delivery but.. will they even look at them since it was from Oct 25? Has anyone gone through the same? Is there a way to ask for an extension since the paper they sent me it says in no way extends the processing period.
I fear the whole process will be denied and it won't be easy to come up with another 1010.00 for everything to be done again, not to mention the wait.
We're lost here if anyone can shed some light we'll be forever grateful.

Update: I called the National Benefits Center and explained the case to the agent and she told me to get an infopass appointment to get additional information on how to get an extension. Apparently they consider the fact that the RFE was lost in the mail but you need to make a written statement. I have the appointment tomorrow at 11.00 am we'll see how it goes. I hope we can continue the process

Today I called USCIS customer service a very friendly representative told us that indeed we were off processing time by a lot and that we need to wait 45 days for the case to be revised on March or so.. She gave my husband a number and said to call back if we don't hear any news after those 45 days.
If anyone has been through this, does it usually take that long ? Or the 45 days period its estimated and they actually work on the case before that. The only RFE we received stated I sent extra money and they sent me the money order back ( made 1 for 1010 and another for 340.00) the NOA said no additional action was to be taken at the moment and that was on Oct 1 st
Any Insight will be greatly appreciated

You are wasting your time calling the USCIS helpline (mis-info line).... they can only see the same info you can see when you check your status online.... what you need to do is make an infopass appointment at your local office and ask them to request the service center that is dealing with your EAD make a desiccion on your case or issue a interem EAD card as you are well beyond the normal processing time....

Oh no! I had an infopass appointment for tomorrow at 1 pm but since I called the cust service today I cancelled I didnt know I had more options ( I thought they would tell me the same and it would look bad if i pry too much Im going to try to get my appointment back

Update
We went to the local office apparently they had sent an RFE from MSC but we never got it. According to the officer the EAD process was on hold until they get the RFE answer but they couldn't tell us exactly what they were requesting. The officer was nice and she sent a message to the service center to ask for the RFE to be mailed again. So we'll have to wait until they contact us in about two weeks or so.
It sure beats waiting 45 days more . At least we know now what was wrong . Thanks Kezzie and bora bora for their advice

OK I managed to reschedule the appointment for 1:20 pm tomorrow can you tell me more about the interim EAD what is it how does it work ? I've never heard of that before. Also I'm concerned the request for rushing the decision may result in denial from the Service center. We filed with Chicago Lockbox but I believe now its in Missouri (MSC) is the code in the receipt number.

I noticed that too when my husband did the fingerprinting the girl wiped everything with an alcohol or something and then gave my husband some lotion apparently is to clean the fingers so the fingerprinting goes well, she also wiped the screen where they do the fingerprinting in case theres any mark from a previous applicant> I believe its standard procedure nothing to be offended about. (Detail she cleaned her hands as well and then put on a pair of rubber gloves before the process )

We filed on Oct 2 had biometrics on Oct 24 and still nothing no RFE or any news are we the only ones??

Congratulations to all who have been approved from CSC and VSC !! I'm glad to see those blank spaces on the lists get filled up!!
For those who have not been approved yet , its only a matter of time :thumbs:Hang in there it will come soon!
On a side note, hubby got the GC in the mail and its really _ green_ this time!
