Long overdue post, of course. My apologies. We were in the middle of a BIG move.
My wife's interview appointment was in Newark on 7/23 at 7:30am. Got there at 7:00am. Waited in line and was ushered in shortly after that. They split the line into three groups; each entering via a separate entrance. Got through security quickly and went up the elevator to the right floor at the top of the building. Outside the room the guard checked our paperwork. Then we were let in the room. We went straight to the window and turn in the interview letter. Then we sat down and waited. It was probably around 7:20am.
We waited. People started to get called into the private interview rooms via the three doors. We noticed people went in not necessarily in the order that they submitted their letters.
Around 9am she was called in. She came out 15-20 minutes later. There was initially some issue with her name change - she showed our marriage license but somehow that was not enough. She had taken my family name a few years back, and her 10-year green card already had this name. Odd. There was some discussion, but finally she was allowed to proceed with the interview. They asked a few questions, for how many years is a senator elected, branches of government, who takes charge if president and vice president cannot perform - I forgot the rest. She was asked to read a simple sentence and write a simple sentence. Then she asked for our latest 2011 tax return, which she showed (at the time of application we didn't file 2011 tax yet and we included only 2008-2010 tax returns; but we brought with us to the interview 2008-2010 IRS transcripts and 2011 tax return). She was asked when I became citizen. She had my naturalization certificate with her and the officer made a copy. She was approved, given the result paper and was told to wait outside. She was also told to later show my ID and our insurance ID with both our names on it at the window, but turns out they never asked for it. We waited until 11am or so and was called to the window to sign her certificate. Then we were directed to the ceremony room. Waited an hour there. They room was bright and cheery and had great views of New York City.
Shortly after 12 noon the ceremony took place. New citizens sit in the front rows; friends and families in the back. We were allowed to come up to the side and take pictures when they swore in. Then they handed out the certificates and that was it. All in all it was about 5 hours of waiting but it was all done with. From K1 to US citizenship it was truly a journey. Miscellaneous observations:
One woman we met went in and came out and said she passed but needed to submit a new photo. She went out to one of these instant photo place outside and came back and submitted it. We did not bring extra photos, but luckily was not asked for it.
I saw that another person did not pass maybe due to her English and was rescheduled roughly 3 months later.

Thanks a lot. No I never signed up for email notification, but I checked the status online everyday and the status changed 4 days before the letter was received.
Yes, the status was "in line for interview scheduling" for about 6 weeks, a long wait, but I expected it at this office in Newark NJ: long wait to be scheduled, but usually the oath ceremony is the same day (from what I have seen). So all together it is on par with other places.
Sealedkiss, congratulations! I remember you got the notice about in line to be scheduled like more than a month ago, right?
Oh, I saw your note there, yah from 5/7 OMG such a long wait. Did you receive any email informing they were sending you the interview letter before you got the it?

Ours has been "placed in line for interview scheduling" since May 7. Anybody knows roughly the time it takes from this state to getting the interview letter? Ours is out of Newark, NJ. Thanks.

So about how long after you've received your NOA did you get your Biometrics letter???
About 9 days.

My wife probably won't qualify for 319b, because my future employer is not an American firm (not majority anyway). But I was wondering if it is appropriate to request "discretionary expedite" as per USCIS web site (and quoted):

Thank you for your advice. Yes, having been through K1, AOS, I-751 we know better to be straightforward. Our fault for not applying last year. We had some travel plans and kept delaying it for fear we would get scheduled during our travel, plus I never expected to work abroad so we did not feel the rush. Should have known better I guess.
319b - it seems to help only if you haven't met 3-year residency requirement? Does it actually help speed up the process? Plus I am not sure what makes an organization qualified. It is a new company (no revenue yet) and has an office (with 1 person now) in the US. It does business globally for sure. And I will probably be working abroad for at least a year from the interview, but there is no guarantee (at will employment).
We'll be researching more, but definitely we'll send off our N-400 application. Regarding my question #1, can she travel to Europe on a visa first during N-400 process? I know she normally can for trips under 6 months, but given my job situation, does that somehow complicate the case?

Dear all,
My wife is ready to file her N-400. She has had her green card for 4 years, and is applying based on marriage to me (US citizen). In 2-3 months I will take up a job in Europe and intend to work there for a couple of years then move back to the US. We both want to be together as much as possible during this move and my new venture in Europe.
I have a number of concerns:
1. For the time being she can apply for a visa and travel with me to Europe using her non-US passport, live there a few months and come back for interview and oath. She will have completed biometrics before we travel. That is the ideal scenario because it allows us to be together. Any chance that may make her case more difficult?
2. What address to use? We are in NJ in a rental house. My parents are in TX. I heard the process is much quicker in TX. If we use TX as mailing address, would biometrics appointment, interview, and oath be held in TX? Or is that only the case if we use TX as our home address (are we allowed to?) If we use NJ as home address but then later terminate the lease, would that be a problem with USCIS? (receiving mail is not a problem - our landlord can still check and scan our mail for us).
Thank you for your advice. It is a very good opportunity in Europe, but we don't want to be apart for 3-6 months while waiting for N-400.

You are allowed to return packet 3 in person. It is faster and there's less risk of it getting lost.
Quick question, better to mail or return packet 3 in person?My fiancee called the consulate and we found out they had mailed the packet 3 way back on November 7, but she never received it. A whole month wasted!...oh well, water under the bridge I suppose...
Anyway, she is going to pick it up at the information booth tomorrow...I'm thinking its faster to return it in person, is that allowed?

You should soon receive a letter from NVC stating they have receive your file on such and such and will be forwarding it to the USCG in HCMC. In my case, after this point I did not check with NVC or the consulate, and packet 3 just arrived 1.5 months after NOA2. You may choose to call NVC and the consulate for a status update, and definitely should do so if you don't hear from them in 1.5-2 months.

I would be very careful when filing for I-129F because of the following:
1. You haven't known each other that long.
2. You have met in person only once.
3. You don't have any evidence.
4. He has a son. This should not be an obstacle, but it complicates things a bit having to deal with the divorce paperwork the ex-wife's information.
5. (My speculation) USCG in HCMC sees more male US citizen applications than female ones. You case would definitely stand out. This should not discourage you. The truth will win. But be conscious about it and prepare well.
Re your questions:
Parents birth certificates: usually not needed. But at the interview if they suspect kinship, they may check your parents' and his parents' birth certificates. Does he have any other paperwork that show his parents' names, birthplaces, grandparents' names, etc. I would be good to bring that to the interview, just in case.
Telling your story: you should never lie. How much you include in your statement (how you met) is up to you, but include enough that tells your story. Again, if asked, never lie. It's difficult to prove a lie, and may lead to serious consequences.
2nd trip boarding pass: I don't know how this would support your case. You two never met during this trip anyway.
Engagement party: you should have one, especially in your case because you lack several things. However, that is not a substitute for MORE communication, MORE visits, LONGER time to know each other.
Your income: should be okay for a family of 3 (let's count his son). Saving account: not required. As long as you have a decent steady balance for at least 6 months before the interview, and you have other things (employer's letter, e.g.). Get a statement from your bank to prove that.
You need to strengthen your case, and your relationship, and that will only come with time. Ask yourself: is NOW a good time to file for I-129F? What do I have? What do I lack? Make the judgement yourself.

You need to make an appointment to be married by a judge at a local court. You two would bring ID's for each of you, some cash for the fee, and that UNEXPIRED marriage license. The judge will ask you "Do you take this woman...?", "Do you take this man...?". You both say "I do" and he/she will "pronounce you husband and wife." He/she will put/print/stamp his/her name on your marriage license, and a couple of your guests will sign on it as witnesses. Your permanent marriage certificate (not license) will arrive in the mail in 2-3 weeks.
That's how it is in Texas. I'm not sure how it varies state to state, but I don't imagine it being too different.

Truly I find traveling in Vietnam is great. So I was going to recommend visiting places like Da Lat, Nha Trang, Hue, Da Nang, Ha Long, Ha Noi, Sa Pa, Ha Tien, Phu Quoc, Can Tho, etc. But... you said otherwise.
If you want to hang out in Sai Gon. Well, does she have college-age friends? If so they can recommend places. Youth music, singing contests among high schools, colleges, groups are truly fun to watch. The atmosphere, the audience are amazing. But can you find such an event coincidental with your trip. I doubt it. On the other hand I'm sure there are plenty of concerts anytime of year, ranging from classical guitar, piano to traditional instruments to Vietnamese pop music if you look / ask hard enough.
I'm not a fan of bars and dancing clubs so I can't speak for it.
If you know Vietnamese, maybe try some live music/comedy. I don't know where, maybe google "nha van hoa thanh nien", "nha hat Hoa Binh", ...
Karaoke is a fun and popular pastime for the youth.
Bowling: Super Bowl right by Tan Son Nhat, or Diamond Plaza.
You didn't mention riding motor scooter around Sai Gon. If you get bored, just ride your motor scooter everywhere and immerse yourself in the chaotic Sai Gon. Sometimes it's truly amazing. Be concerned about safety, though. Not all areas are safe and don't stay out late!
Food scavenger hunt: ask for and seek out the well-known local eateries. Food vendors/restaurants are everywhere, but there are truly outstanding places that everybody knows by word-of-mouth. Your dining experience will be enhanced.

Welcome to the forum. Almost 5 months since your NOA1 - that is kind of long. Your speculation is a good point. Maybe they are a little short-handed from dealing with the AOS rush filing. You seem very thorough with paperwork and writing - I'm sure that will help you in this process. You shared a lot of good information too. Keep it up.
Regarding the loose VN visa, make sure you make a photocopy of it (front and back) WHILE you are in VN. Otherwise customs collects it when you exit the country. If you happened not to save the boarding passes, don't lose sleep over it. A single piece of evidence won't make or break your case. Think of other items that could subtitute - your credit card statement showing the ticket purchase, your itinerary, receipts from hotels, purchases, tailor, bus/tour/airplane (VN domestic) tickets that you might have kept from your VN trips. And of course, photos!
What I realized was, if you make the CO believe the genuineness in your relationship, then a little bit of imperfection here and there won't matter. How to do that? A lot of it depends on your whole story: how you met, your life status (education, career, past and current relationships), your effort and commitment (visits, communication, engagement ceremony, length of relationship), etc. Evidence will help build your story, block by block. Writing (filling out forms, explanation, etc.) will help build your story. Presentation (how you put together your package) will also help build your story.

No, if you have a green card, that means you don't have US citizenship - you are still a Vietnamese citizen. You can enter Vietnam with your valid, unexpired Vietnamese passport, and return to the US with your green card. My sister has done just that, without any problems. If your Vietnamese passport expires, then you would renew it at VN embassy in Washington DC (although it could take a while), I think.

An update on my situation: my fiancee and I spent the last 2 weeks of August together in Japan (where I had stayed since June for a temporary job assignment) and together flew to US on September 1, entering the country via Chicago O'Hare International Airport. Immigration and customs were smooth and simple. They did not open our luggage.
On September 5 I took her to the social security office but was told to wait at least 10 days for her I-94 information to be entered into their system (I should've known better!). I understand K1 visa holders can have a SSN and can legally work until the date on I-94, correct? Also, the AOS fees include making an EAD, right?
Yet another immigration journey that I have to educate myself how to do..., but I'm glad we are now together...

I would try to verify whether or not packet 3 was received as soon as possible. Call the consulate one more time or two. If the answers are all "packet 3 not received," then she needs to pick up a blank packet 3 from the consulate and resubmit it (in person this time) asap.
I had a question relating to packet3 as well. My wife (stupidly) mailed the packet instead of actually turning it into the consulate. She did this on June 10 and yesterday I called to inquire about why packet 4 hasn't been sent yet, and they told me that they didn't receive the packet3 yet.I know there's a backlog problem with tons of paperwork, but June 10 was quite a while ago and they have not gotten around to it yet. Should I be concerned about the mail? I'm not sure whether I should tell her to do the paper again or just wait longer.
Any advice I can get would be great. Thanks in advance..

From my experience, it takes about 1.5 months from NOA2 to packet 3 received. Then packet 3 submission to interview date used to be 3-4 months, but recently it's been more like 2.5 months. Looking at your timeline, I would expect an interview in December, more likely late December rather than early, and maybe even January.

I got my letter from the NVC last week saying they were sending the petition to HCMC with in a week. About how long will it take for packet 3? I heard about 3 weeks? Will Tram be able to just pick the packet up to save time?Can someone point me to a post or guide about what is in the VIETNAM packet 3? I have my financial evidence stuff almost done and i will be sending it to Tram this weekend. Is there anything else i will need to send her ASAP?
I will be going back late in OCT and i will be putting together the evidences and etc that she will take to the interview at that time.
Assuming that HCMC gets my App this week when could i expect an interview date? Would it be looking like Nov or Dec time frame or pushing into Jan, Feb? My NOA2 date was 8/3 so end of december would be just under 5 months. Any chance of her getting the interview early Dec?
