    I saw in the guide of visajourney that we can ask to bring the marriage certificate ourself to the recorder's office so maybe we can get our copies right away, that would be great. maybe we should try that.

    We tried this when we got married there in July. The minister actually wouldn't let us do it, despite our rather strong protestations about it. We were most annoyed by the fact that the minister didn't drop off the paperwork until the day after our ceremony. Plus, there is also processing time involved (our min said 5 days). Even if you bring it in yourself, they won't just drop everything and process it immediately. We had to leave the cash with a friend who lives & works nearby, and he was able to pick it up a few days later. By the time he shipped it back to us, we had the rest of the AOS package ready to go... all in all, it was 2 weeks after our marriage that we had all the info and were ready to submit it, when we'd planned to get it out the day after we returned from Vegas. Please note that this is still faster than it would have been had we ordered the certificate copies by mail (30+ days, according to the Clark County website).

    Sorry to burst your bubble... you absolutely should try to do this, and I'd be really, really happy for you if it works out for you :) But I strongly recommend that you formulate a contingency plan in advance just in case it doesn't. At the very least, I'd contact the chapel or the minister to see if they are willing to go along with it, and get their opinion on the processing time involved.

    Just wondering how many of you have made real travel arrangements before you've actually got the visa in hand? I'm going to wait until I get home after my interview (just in case...) but will be booking it before I actualy get the visa. Has anyone every heard of one getting lost?? I'm almost tempted to buy a ticket now, those cheap flights had better still be there next monday...

    We did this. Jan scheduled his departing flight from Copenhagen for 2 weeks after his embassy interview. He listed his travel plans on the paperwork he brought to the interview, and made it clear that he had a ticket in hand already. The agent at the embassy raised her eyebrows at this and referred to it as "gambling" and "presumptuous." She wasn't very nice, but in general he didn't have any problems. Despite a small glitch in his paperwork (i.e., our lawyer had instructed us to do something incorrectly), he passed the interview, picked up his passport/visa at the embassy a few days later, and was on his way shortly after that!

    I'd book the ticket but make sure to allow enough time. Don't plan to depart the day after the interview or anything like that. Check on the receipt times, add a couple of days to be certain, and go from there.

    We have the same worries, only that I had a job offer in Germany :( . Though we attended a meeting of the local Germans here (lots of companies from Germany are located here) and there were also their American spouses. I explained to them what kind of MA I have (from LMU Munich) and my worries about finding a job - since my education is not the problem, it is acknowledged, but I was worried about some posts I read that "foreigners" are treated not that well. But they assured me it will be fine. So your hubbie shouldn't worry. And when it comes to EAD: he's lucky that he has the interim EAD at least!!! We are waiting for ours impatiently. Though I have work experience with an international company in Germany (Infineon) and did a traineeship in New York we are still a little bit insecure... Try temp agencies, Spherion or if there are meetings from Europeans in your area. They usually help a lot to find employment with European companies which has the advantage of European benifits ;)

    I think we're limited to Scandinavian engineering firms here, as Pgh is rather industrial... else that or Ikea, but I don't think he savors the idea of stacking furniture, even if it means he gets to drive a forklift :) European benefits would be great, though :)

    Temp agencies are also a good idea, although he really wants to get away from temping and into something more permanent. I'd like it also, since I've agreed to spend a 3rd year in my current job so he can have some stability in his, whatever it ends up being :) I don't think there are any scandinavian associations here, but I'll have to check. We are just keeping our fingers crossed and hoping for the best, I guess... as long as he can get his foot in the door, so to speak, we should be okay.

    Anna, you sound very qualified. I doubt you will have any trouble finding a job with your work history, despite the gap in your cv!

    So he filed taxes illegally then?!?! I thought students were required to file 1040NR! ;)

    He met the substantial presence test. Did it for 4 years and didn't seem to bother anybody at the IRS...<shrug>

  6. He should not lose hope, just keep trying and take another job in the meantime for example H&R tax preparartion (they train you and then they give you a job.)

    That's a great idea -- I'll have to mention this to him. Accounting wasn't his favorite class but he did okay in it. We have a H&R Block within 2 blocks of our house in Squirrel Hill (Pittsburgh neighborhood), so that would be really easy for us.

He speaks English very well and has mastered the midwestern US accent. Most people he encounters in casual situations don't pick up on the fact that he's not a native speaker. Squirrel Hill is rather international, so I'd be surprised if his nationality was a big issue for local clients.

  7. We received an RFE in the mail today. :angry: I have the online account with the USCIS and received an email notification a few days ago about it. We thought it was for the official vaccine supplement (we'd sent in the DS-whatever form with our AOS/EAD packet, not the I-693A), so we hurried up and made an appointment with a civil surgeon for early next week, thinking that we'd be able to turn the RFE around very quickly. As it turns out, it was for a translated copy of my hubby's birth certificate and not the vaccine supplement. :angry:

    When we send in the requested RFE doc in a few days, should we also send in the proper vaccination supplement form simultaneously, even though they didn't request it? It might save us another delay due to another RFE, perhaps?

    2 - The RFE states that we have 87 days to get the documentation back to them. It also states that it will be another 90 days AFTER the doc is received before he is eligible to get interim employment authorization.

    We're worried about how long Jan will be out of work. He quit his job in Denmark in mid June, came here in July 18 (received a 90-day EAD at JFK on his way in, which expires on Oct 18), our NOA date for the AOS/EAD was in mid-August (received August 11, Notice on August 17), and he had his biometrics on August 31.

    The EAD he received at JFK in July expires in about 5 weeks, and we'd expected his 1-year EAD (or at least another 90-day interim EAD due to delayed processing) on or around November 17. Say we get the translated doc in the mail ASAP, and they receive and process it on September 15... this means that our 90 day waiting period starts over again, right? So instead of having 3 months from August 11/17, we have 3 months from September 15 (meaning he's eligible for an interim EAD on December 15 instead of November 17)?

    Has anyone found this process to go faster than they say that it should? Is there any chance that he could still get his EAD sooner than December 15?

    3 - There is another thread on herefrom a few days ago (http://www.visajourney.com/forums/index.php?showtopic=29790). Apparently a lot of applicants have received these (not sure whether this is just recently, or whether this is pretty standard for a RFE), and some people have been able to make an infopass and get the interim EAD anyway once the 90 days after the AOS/EAD NOA date. But they've recommended NOT telling the USCIS official at the infopass appointment about the RFE. Is this REALLY a good idea?

    4 - Most importantly, how do people explain this type of massive gap when they apply for real jobs once the real EAD arrives? Jan is starting to feel very stressed about this, in no small part because it's another long period of time in which he hasn't been gainfully employed in his field. He's starting to get really worried that he'll never be able to get a good job in business because he's turning 29 in a few months and has never had one.

    We actually started the fiance visa process a year earlier than we'd originally planned, in no small part because he couldn't get a real job in his field in Denmark. He did his bachelors degree in the US while I did my masters & Ph.D. The plan was for him to go home and get experience while I stayed here for two-year duration of my postdoctoral fellowship. We didn't plan to work on getting his visa until I had finished my (temporary by nature) postdoc and I had signed a permanent job contract.

    But once he got home, he found that employers didn't fully recognize his B.S. in Business Administration. Apparently the "entry level degree" in Denmark is the "Kandidat" (Candidate degree -- not a masters but another year or two of training past the bachelor's degree). He temped for the year he ended up spending at home, which hasn't particularly enhanced his already somewhat anemic resume (i.e., some part-time jobs after high school, then 2 years in the army, 6 months in an internship in Iceland, 6 months of temping, 4 years of work study at a US university, another year of temping, and then up to 6 months of unemployment).

    Now that we know about this additional delay, we're both more stressed and discouraged than we were before... this whole process seems very different on paper than we've experienced in person. The money is one thing, but the boredom and frustration are another. He doesn't even feel like he can look for a job until his has the promise of continuity in employment authorization. He hasn't taken advantage of the EAD he received at JFK because we'd 1) perhaps naively hoped that he would get his 1-year EAD around the same time his JFK one expired, and 2) hoped that this would be in his field instead of behind a starbucks counter.

    Could anybody tell us what to do or expect during this time, or how we should deal with the long-term ramifications of this RFE?

  8. Well this kind of stinks. We were hoping to go to the social security office right after he gets here because we can't apply for a marriage license until he has a SSN #. :(

    Ah, but isn't the joy of this process learning how to be truly flexible? I find it's mostly been an exercise in learning how to relinquish control to massive external forces :)

    Somebody else will probably shoot me down instantly on this one, but back when he was just my boyfriend, my now-hubby Jan studied here for 4 years (worked on campus as a work-study), returned to Denmark for 6 months, then applied to come back permanently through the K-1 program. While on his visa interview at the US Embassy in COpenhagen, they asked him if he wanted his same SSN from the time he spent here as a student (apparently it mysteriously "went away" when his student visa expired). He said yes, and as a result we didn't have to go through the SSN mess when he arrived and were able to get married in Vegas a few days later (poor guy had TERRIBLE jetlag, way worse than normal!) I don't know for certain -- don't get your hopes up because I'm quite possibly wrong and somebody else probably knows better.... but maybe the process of getting a SSN can be initiated on the embassy interview?

    Also, I don't get why a US SSN is needed to get married. International couples get hitched in Las Vegas all the time without getting a US SSN and they certainly don't have US SSNs in order to do so. They can't get one if they're only here for a few days, plus they have no grounds to get one if they don't intend to be residents. Sure, there is a blank for SSN on the Clark County marriage license application, but the instructions don't specify that it must be a US SSN.

    I'm still using my SSN card from 14 years ago, and nobody ever told me I would need to get it "renewed". Once a SSN is issued its issued "for life" I thought, although the "Valid for work only with INS Authorization" does mean you need an EAD or similar to actually use it for work.

    Strangely enough, yes. I think it only applies if your visa expires and you leave the country (he left for a year after completing college). So if you haven't left for a long period of time, then there's probably nothing to worry about.

    I don't think they would have given the number to anybody else, which is comforting (considering all the uses of the SSN). Maybe a better way of thinking about it is "deactivating" and "reactivating."

    Yes, he has a SSN already. He was here on a student visa for 4 years, left for a year, and then came back again. We didn't know that he "lost" his SSN once he returned home until they told him that he needed to reapply for his old number at his K-1 embassy interview. They took care of this for him then. The only card we have, however, is his old one, which is stamped "Valid only with INS (or DHS) Authorization." I just read on the I-9 website that this is apparently not good enough to satisfy the I-9 requirements. Does this mean we also need to get a new card issued at some point in the future? Or it is not good enough in and of itself... i presume that it needs to be supported by the EAD and other identification.

  11. I've spent free moments in the last few days trying to distill how the EAD process really works for K-1 recipients before my hubby moves forward with submitting job applications. This shouldn't be so hard to figure out, and it seems that there is a lot of misinformation in this forum. I really wish somebody would add a procedural description on how the initial and renewal EAD application process proceeds AFTER submitting the packet.

    My hubby's recent history: He was fortunate to arrive through JFK on July 18, and he received a temporary (90-day) EAD there. We were married on July 21, submitted our AOS/EAD paperwork 2 weeks later, and our NOA date is August 17. He goes for his biometrics this Thursday (Aug 31). In the meantime, he's getting really bored at home and would like to have something to do. Also, who knows how long the rest of the process will take? My salary is almost enough to cover all of our expenses, and he has some savings, but naturally we'd like to use that as carefully as possible since we don't know when he'll get his EAD.

    My questions:

    1 - I read somewhere on here that it's the employer's responsibility to ensure that he's legal to work, not his responsibility to disclose when his temporary EAD expires. Is this true in the case of the temp ones received at JFK?

    2 - If he's going to work, is it better that he take a lame job (e.g., anything that will pay him even if it doesn't have anything to do with his degree/experience) or a real job (i.e., something that will actually help build his resume)? Alternately, for other college grads in business out there, is it better to have "dead time" on his resume versus a 2-month stint at McDonalds?

    3 - If it takes more than 90 days to receive the EAD from the NOA date, can he apply for another 90-day temp at our local office? (Meaning, if it lapses and he has to stop working, if he still hasn't received it a month later he could potentially get this and start working again?)

    Thanks for help clarifying a rather convoluted issue.

    I've been confused by the instructions, however... it keeps mentioning the form I-130, which is the Petition for Alien Relative.

    I brought my husband over on a fiance visa (K-1). The I-129F is the initial petition completed for K-1 applications.The I-130 is completed for a K-3, as I understand it. Should I just substitute I-129F in my mind every time I read I-130 in the instructions?

    I presume these are equivalent forms but the USCIS was just too lazy to make dashed versions or a key to equivalent abbreviations. I'd hope that Iw ouldn't have to turn aorund and file an I-130 on top of everything else we've had to do...

    The pronunciation depends upon who you ask... and which part of "the mitten" they call home (sorry, Yoopers)...

    Lansing also has some "alternative" (read: lower fare) airlines. We've also had good luck with the bigger carriers through there, however, Delta in particular. Another option is Flint (gotta love the airports with fewer than a dozen gates), although it's an hour further east of Lansing. ATA goes in there, for example. Car rentals might also be cheaper through Lansing or Flint, and the traffic is a piece of cake at either location.

    Detroit's not so bad once you've done it once or twice. Consider flying southwest if you can. I think some other low fare airlines go in there. The traffic around the new NWA terminal can be a bear but just pay attention to the signs and other cars and you'll be fine. Time of day really matters -- late at night is usually okay but during the day it can be awful. In terms of safety, just be smart and you shouldn't have any problems. The airport is actually in the 'burbs, not in the city proper.

    Chicago's a good idea too. If you don't want to drive from the windy city, there's always Amtrak to Grand Rapids or someplace nearby. The train is less pleasant but if it's only for a few hours, bearable, and Amtrak is surprisingly affordable.

    I had mine notarized... in May? I think that's when I did it for my fiance's embassy interview.

    I kept an extra notarized copy when I did it before. Do I need to update it for the AOS documentation, or can I just reuse the old one? Nothing's changed, except my savings account balance is smaller...<sigh>

Hello I´m new here but my fiancee has been around for a while though (She has filled out our timeline so I will not be doing that, read somewhere that if both did it would be a bad thing for the site). Since our NOA2 has been approved the time of the interview is closing in. According to how long things take NVC and how long I can expect it to take to be appointed an interview at the Reykjavík Embassy it should happen in late August or early September.

    Truth be told the last thing on our mind when we have been together is to gather evidence of our relationship

    and we only have two pictures of us together, I shot one myself and she shot the other one. I have not saved any boarding passes but I have a passport that has stamps for my three visits there last winter. So does she for her visits to me and she´s coming here with her kids for a visit in three weeks from now so i guess that´s a good time to create some evidence.

    I have saved all letters from her in their original envelopes for some reason the latest being mailed last week. Should I make copies to give at the interviews or will they want the originals? I guess in the case of the envelopes no copies are going to be able to show dates of the post stamps.

    This evidence thing just freaks me out.

    Jan Erik and I had the same relization when we started gathering evidence. We lived together in the US for 4 years before we started this process (he was on a student visa), and hadn't even thought about it at all. He also realized recently that the year is never printed on boarding passes, so they aren't such good proof, anyway.

    Don't forget long distance phone records, if you use a phone or a calling card that keeps a record. I use Pennytalk (www.pennytalk.com) -- you might want to think about switching to a card like this one if you're just starting to gather evidence. I printed a record of my calls each time I printed my cell bill and attached the two together.

    Do you have any friends that could provide affadavits that your relationship is genuine? Some friends going through some sort of spousal greencard process (forget what the actual visa mechanism is called) needed those as evidence.

    Using color photocopies of the envelopes sounds like a good idea. I had trouble photocopying my original envelopes, most of which were also sent from Reykjavik. The cancellation stamps were really blurry, and Icelandic stamps in 2000 were rather dark in color (don't know if this will still be a problem?). I didn't send in envelope copies for these reasons, and we had no problems with our evidence at any stage of the process.

    However, keep in mind that since we'd been living together in the same city for years, we did have multiple photos with recognizeable landmarks, at different times of the year, and my hair is different in all of them (e.g., demonstrating that significant time had passed). We were more panicked about not having any photos of us showing affection. We're just not all that into PDA... maybe if your photos show you being affectionate it will help?

    Wait, I'm new and a little confused by this...

    My fiance is flying in through JFK next week and hopes to get the temporary EAD that way. Our immigration attorney stressed the importance of getting married ASAP, which we're doing 3 days after his arrival, so we can submit the AOS & EAD paperwork right away. He's said that there's a chance he could get his pre-AOS, (90 day? 1 year?) EAD before the 90-day temp one from JFK runs out. Did he give us bad advice? (Wouldn't be the first time, alas...)

    What is it about filing for AOS that negates the temporary EAD? That's what I don't get...
