  1. Hello! 

     

    My american fiancée and me have been in a long distance relationship since 2013 and are now at the stage where we are moving together. At first the plan was for me to move from Norway to United States, so we applied for a K1 visa. Everything was going as planned. We went step by step through the k1 visa process. But when we reached the last step, the k1 visa interview, I got a job in Norway which I could not turn down. We asked a lawyer and he recommended to continue with the k1 visa even though we were now moving to Norway, because everything was already paid for. So now I have a k1 visa, I am going to the US for two weeks to marry, and then we intend to abandon the k1 visa and she is coming with me to Norway after we marry in the US. Our plan is still to move to the US later, after a while at my job. So my questions are:

     

    Is there anything I could do to keep my k1 visa active without abandoning it?

     

    Was thinking of applying for advance parole, but is that possible if I am there for only two weeks and she is coming with me? Can I stay abroad while advance parole is processed?

     

    Is it possible to convert k1 visa to a CR1/IR1 visa or put the visa on break?

     

    Do we have to start a new visa application? Can we live abroad in Norway while the new application is processing and then move to US when my new visa is approved? 

     

    Is it a problem to abandon a k1 visa and then re-apply to a new visa later on? 

     

     Can someone recommend a good us immigration lawyer to ask?

    1. I have my K1 interview booked for march 16. Originally I had planned to marry and adjust status to stay in the US, but I recently secured a job in Norway . My fiancé and I still have plans to marry in the US but will not apply for adjustment of status since we will be moving back to Norway after we marry in the US. Would you advise that we proceed with the K1 visa?

     

    2. Will canceling the K1 visa/ moving forward with the K1 (and not adjust status) affect us with possible future visa applications?

     

    3. If you do think I should cancel my K1 visa, can I go to the US for around two weeks on an ESTA and then get married and go back to Norway?

  3. 1. Should renew it prior to completing DS 160/interview. (Must have at least 6 months left on the passport at time of visa issuance anyway) My fiance's passport was due to expire. Once we got NOA2 he renewed it. Makes life alot easier once arriving in USA also. Don't have to worry about renewing it here in the USA if further travel comes up.

    2. If it doesn't apply you can put "N/A". If you don't know it you can put "unknown". Not sure how you obtain it otherwise. Maybe others will comment on that.

    Regarding question 2, after some googling I was able to find this website:

    It allows me to find my 1-94 Record Number when giving my name and passport number.

  4. Hi, me (Alien) and my fiancee (US-citizen) are going to apply for K1 Visa and we have two questions regarding this.

    Question 1:

    The aliens passport expires May 2017. Applying for the K1 visa with an almost expired passport, may that pose a problem later on during the process? Could the alien get a new passport while the K1 visa is under process? Or does the alien need to get a new passport before applying for the K1 visa?

    Question 2:

    On form I-129F, Part 2 ("Information About Your Alien Fiancè"), question 15b ("I-94 Arrival/Departure Record Number?") and 15f (Travel Document Number).

    What is I-94 Arrival/Departure Record Number? The alien did not receive an 1-94 Record Number. What do we fill in on question 15b in the I-129F form when the alien did not receive an 1-94 Record Number? The alien is here on an ESTA until November 9th this year. It seems that when travelling to the US on an ESTA you do not receive and 1-94 form, so how can the alien get the 1-94 Record Number?

    And what is the Travel Document Number (under 15f)? Is that my booking reference number?
